Statements and comments are based upon actual analysis and in large enacted in the various states. These tables present so many typographical difficulties that it was not thought expedient to publish them. Chapter IV of the Introduction originally appeared in the Annals of the American Academy of Political and Social Science, for January, 1902; and chapters II, III, and IV of Part III appeared in the Political Science Quarterly for September, 1902. Book excerpt: Excerpt from Railway Regulation: State and Interstate To meet and wisely discharge the responsibility of regulating commerce, state and interstate, to bring railways back and hold them to their legitimate business as common carriers, is the most important work in the government of this republic for this generation of man. If the great railway corporations of the country are using their unlimited power without abusing it, if they are transporting the commerce of the country at reasonable rates, with fairness to the general public, with a just regard to the rights of individuals, and without favoritism to places and persons, then they might justly regard government control and regulation as "unnecessary and meddlesome interference." If, however, the public is suffering serious wrong, if there are far-reaching abuses in the transportation of its commerce, if the railway companies are not only carrying the commerce of the country but controlling the commerce of the country, determining where it shall be massed, where the markets shall be located, and their control; if they are discriminating in favor of the large shipper, creating and fostering industrial and commercial monopoly, then there rests upon the several state legislatures and upon congress an obligation to act, and to act at once, with all the determination and patriotism commensurate with the duty to preserve government itself. Capital and labor, wherever employed in the creation of wealth, - whether in mining, or in manufacturing, or in agriculture, - in short, material production, in every field of human activity, is absolutely dependent upon transportation. In the first flush of popular excitement, it is futile to endeavor to give a rational direction to the discussion. Statements founded upon a thorough investigation of the subject matter or upon expert knowledge are ignored. If they are from independent, impartial Observers, they usually contain some propo sitions that are unwelcome to the interests attacked or, if they favor the parties defendant, they are con temned as being either bought or biased. In fact, when one reads the newspaper accounts of such a discussion, it would almost seem that all which had been written on the subject, the result Of experience and reflection, had been written in vain. One could scarcely understand the commission system of the United States from the experience of the several State commissions and the Interstate Commerce Commission. Apart from the fact that many of the ideas which the pioneer state in railway regulation gave to the country were borrowed in turn from England and Continental Europe, a just appreciation of the importance of the circumstances and the surroundings in which the means of regu lation operates is impossible without a knowledge of the various solutions of railroad questions under different political conditions. Comparison and contrast of motives and actions is the only effect ive way of learning. Oi inconsistencies of con trol the history of railway regulation in Europe is full. Hart, Schaffner, and Marx of Chicago, who have shown a special interest in trying to draw the attention of American youth to the study of economic and commercial subjects, and to encourage the best thinking of the country to investigate the problems which vitally affect the business world of to-day. For this purpose they have delegated to the undersigned Committee the task of selecting topics, making all announcements, and awarding prizes annually for those who wish to compete. In the year ending June 1, 1906, the following topics were assigned: 1. To what extent, and by what administrative body, should the public attempt to control railway rates in interstate commerce? 2. A just and practicable method of taxing railway property. 3. Will the present policy of the labor unions in dealing with non-union men, and the "closed shop," further the interests of the workingmen? 4. Should ship subsidies be offered by the government of the United States? 5. An examination into the economic causes of large fortunes in this country. 6. The influence of credit on the level of prices. 7. The cattle industry in its relation to the ranchman, feeder, packer, railway, and consumer. Book excerpt: Excerpt from Government Regulation of Railways: An Address It might be expected, especially as I am addressing a body of lawyers, that in dealing with my subject I would consider some of the interesting legal questions which have arisen in connection with the public regulation of railways, but the greater importance of the economic and financial issues involved have induced me to discuss them rather than the more purely legal aspects of the question. If, in railway regulation, our aim is to subserve and advance the public welfare, we are aided but little by a too exclusive reliance upon mere legal learning. Our true enlightenment must come from a study of the economic and financial conditions involved. We can thus more clearly discern the public interests affected and more readily understand that these interests are not really antagonistic to those of the railways. On the contrary, these interests are interdependent, and an injury to one works to the disadvantage of the other. In adopting this line of discussion, I assume that the public interest is of first importance and my purpose is to consider how that interest can best be promoted. I am not here to make a special plea for railway interests, but shall attempt, from an independent and impartial standpoint, to arrive at the principles which should govern the proper exercise of this regulative function.
