Book excerpt: This manual is intended to assist federal prosecutors in the preparation and litigation of cases involving the Racketeer Influenced and Corrupt Organizations Act (RICO), 18 U.S.C. §§ 1961 1968. Prosecutors are encouraged to contact the Organized Crime and Racketeering Section (OCRS) early in the preparation of their case for advice and assistance. All pleadings alleging a violation of RICO, including indictments, informations, and criminal and civil complaints, must be submitted to OCRS for review and approval before being filed with the court. Also, all pleadings alleging forfeiture under RICO, as well as pleadings relating to an application for a temporary restraining order pursuant to RICO, must be submitted to OCRS for review and approval prior to filing. Prosecutors must submit to OCRS a prosecution memorandum and a draft of the pleadings to be filed with the court in order to initiate the Criminal Division approval process.

Available in PDF, EPUB and Kindle. Book excerpt: Challenging Organized Crime in the Western Hemisphere: A Game of Moves and Countermoves takes the unusual approach of exploring and describing how organized crime groups develop their capacities in response to heightened powers of law enforcement; and how law enforcement in turn responds, creating an ongoing dynamic interaction. The book shows how a state, such as the United States, has and can develop new laws and practices in ways that enable them to deal with relatively large violent groups—and yet preserve the rule of law and civil liberties. While most texts describe organized crime groups and the challenges to government they impose from a static perspective, the authors dissect the interaction over time of organized crime and democratic governance that has created the present structure and balance of advantages in the United States. Readers learn about the markets for contraband and extortionate protection that form the bulk of organized criminal enterprise, the vulnerabilities of the traditional practices and rules of law enforcement, the effects of globalization of criminal enterprises on their contest with the state, the effectiveness of various practices of law enforcement, and the continuing forces of change, often technological, in the businesses of organized crime and law enforcement that play important roles in the contest between them. This thought- provoking book is ideal for students of organized and transnational crime in university programs and law schools, as well as researchers and legal practitioners, who seek to look beyond the simple traditional history of organized crime and develop a strategy to confront organized crime in the future.

Available in PDF, EPUB and Kindle. Book excerpt: From Truman to Trump, the deep corruption of our political leaders unveiled. Many critiques of the Trump era contrast it with the latter half of the twentieth century, when the United States seemed governed more by statesmen than by special interests. Without denying the extraordinary vigor of President Trump’s assault on traditional ethical and legal norms, Jonathan Marshall challenges the myth of a golden age of American democracy. Drawing on a host of original archival sources, he tells a shocking story of how well-protected criminals systematically organized the corruption of American national politics after World War II. Marshall begins by tracing the extraordinary scandals of President Truman, whose political career was launched by the murderous Pendergast machine in Missouri. He goes on to highlight the role of organized crime in the rise of McCarthyism during the Cold War, the near-derailment of Vice President Johnson’s political career by two mob-related scandals, and Nixon’s career-long association with underworld figures. The book culminates with a discussion of Donald Trump’s unique history of relations with the traditional American Mafia and newer transnational gangs like the Russian mafiya—and how the latter led to his historic impeachment by the House of Representatives.

Book excerpt: While J. Edgar Hoover was denying that there was such a thing as organized crime, in the forties, fifties, and sixties the mob was busy forming powerful syndicates in many northeastern cities. This book tells the fascinating, first-hand story of how FBI Special Agent Joe Griffin, with the help of a team of courageous professionals, succeeded through dogged determination and uncanny street smarts to convict major La Cosa Nostra leaders in Buffalo, Cleveland, Rochester, and Youngstown. Forget Hollywood''s version of the mafia; this is the real inside story from a man who observed the day-by-day behavior of these "instinctual killers" and for whom "it was a matter of principle to destroy them." FBI Medal of Valor recipient Joe Griffin, with the help of writer/researcher Don DeNevi, provides intimate details of mob intrigue, drug deals, gambling rings, hits, bloody gangland wars, and even a plot to plant a "mole" in the Cleveland FBI office. All the more fascinating because it''s true, Mob Nemesis is an engrossing story of the underworld from a man who took them on and won.
