Book excerpt: This book presents a novel framework for studying historical legalisation using quantitative methods, with 10 fully-preserved laws from medieval Sweden, written between c. 1225 and 1350, serving as a case study. By applying a systematic classification scheme to each legal provision, it is possible to investigate the major differences and similarities in structure and content between the 10 laws. This, in turn, allows for the re-assessment of many long-standing problems in Swedish and European medieval legal history that have been challenging to address with traditional methods based on text analyses. Over the course of the thirteenth and fourteenth centuries, major changes in the proportion of legal provisions devoted to different fields of law, and to prescribed consequences, are found. The book shows how the proportions of civil law and public law expanded at the expense of criminal law. Furthermore, a clear transition from casuistic to more abstract law provisions can also be witnessed.

Book excerpt: The significance of religion for the development of modern racist antisemitism is a much debated topic in the study of Jewish-Christian relations. This book, the first study on antisemitism in nineteenth-century Sweden, provides new insights into the debate from the specific case of a country in which religious homogeneity was the considered ideal long into the modern era. Between 1800 and 1900, approximately 150 books and pamphlets were printed in Sweden on the subject of Judaism and Jews. About one third comprised of translations mostly from German, but to a lesser extent also from French and English. Two thirds were Swedish originals, covering all genres and topics, but with a majority on religious topics: conversion, supersessionism, and accusations of deicide and bloodlust. The latter stem from the vastly popular medieval legends of Ahasverus, Pilate, and Judas which were printed in only slightly adapted forms and accompanied by medieval texts connecting these apocryphal figures to contemporary Jews, ascribing them a physical, essential, and biological coherence and continuity – a specific Jewish temporality shaped in medieval passion piety, which remained functional and intelligible in the modern period. Relying on medieval models and their combination of religious and racist imagery, nineteenth-century debates were informed by a comprehensive and mostly negative "knowledge" about Jews.

The indictment, investigation, and classification of suspected suicides and the mental state of a person already deceased were challenging, and depended on local co-operation and lay testimonies. Not all suicides were considered alike; a widespread view on the heinousness of suicide was not the same as agreement about specific cases, and did not result in uniform handling of them. The social status and local ties of the deceased influenced the interpretations and responses at the local lower courts and communities. Esteemed local community members had a better defence and greater chance to escape the shameful penalties.

Book excerpt: Between 1150 and 1400 Sweden was transformed from a society which was predominantly reliant on oral communication into a society which increasingly deployed writing. Latin, the traditional language of government and records, was gradually replaced by vernacular Swedish. The watershed moment in this process was the drafting of national and town laws in the 1350s, an event which established Swedish as the language of the judiciary and judicial records. From this period written documentation was gradually integrated into legal procedure. Pragmatic Literacy argues that the Crown, the expanding bureaucracy, the editing of the laws in Swedish, and the laws' demands for written documentation in everyday transactions were the main driving forces behind the development in medieval Sweden of lay literacy for practical purposes. The book demonstrates how the early use of writing by the royal administration and the writing of provincial laws in Swedish created centres of literacy from which literate ways of thinking and acting spread both geographically and socially. It further illustrates how literacy moved beyond the confines of the clerical elite, by exploring how different members of the laity adopted pragmatic literacy for private purposes. Pragmatic Literacy thus traces the history of pragmatic literacy in Sweden through the lens of the judicial and administrative archive.
