Book excerpt: In her new collection of essays, Cynthia Ozick, everywhere acclaimed as a critic, novelist, and storyteller, examines some of the world's most illustrious writers and their work, tackles compelling contemporary literary and moral issues, and looks into the wellsprings of her own lifelong engagement with literature. She writes--quarrelsomely--about Crime and Punishment, about William Styron's Sophie's Choice, about the Book of Job. She inquires into the subterranean dispositions and quandaries of Kafka and Henry James. She discusses the difficulties inherent in the translation of great books, whether into film or into another language. She explores what she calls "the selfishness of art" and courts controversy with her views on The Diary of Anne Frank and its transformation for the stage. Her reflections on the "rights of history" and the "rights of imagination" tap a profound concern for truth in regard to the Holocaust. She considers the shifting splendors of New York City, past and present. And she revisits her youth more deeply and with more feeling--and comedy--than ever before, in essays that reveal some of the formative experiences of her life as a writer. Quarrel & Quandary is a literary event and a cause for celebration.

Available in PDF, EPUB and Kindle. Book excerpt: This lively book reassesses a century of jurisprudential thought from a fresh perspective, and points to a malaise that currently afflicts not only legal theory but law in general. Steven Smith argues that our legal vocabulary and methods of reasoning presuppose classical ontological commitments that were explicitly articulated by thinkers from Aquinas to Coke to Blackstone, and even by Joseph Story. But these commitments are out of sync with the world view that prevails today in academic and professional thinking. So our law-talk thus degenerates into "just words"--or a kind of nonsense. The diagnosis is similar to that offered by Holmes, the Legal Realists, and other critics over the past century, except that these critics assumed that the older ontological commitments were dead, or at least on their way to extinction; so their aim was to purge legal discourse of what they saw as an archaic and fading metaphysics. Smith's argument starts with essentially the same metaphysical predicament but moves in the opposite direction. Instead of avoiding or marginalizing the "ultimate questions," he argues that we need to face up to them and consider their implications for law.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides insights into the everyday practices of school leaders as told through the real-life stories of principals. The editors and their contributors blend practice with theory, helping aspiring leaders to discover that school leadership is not simply putting prescribed solutions into action, but a constant encounter with quandaries that demand thinking, responding, and adjusting to the situations at hand. Readers build their capacities to view quandaries from multiple lenses, consider a variety of responses, and draw conclusions based on perspectives that may vary from those initially identified. The chapter authors encourage a sharper self-awareness of what scholars value and envision about education, encouraging them to think about how to navigate decision-making through a variety of theoretical frameworks and practices while balancing their own leadership platform development.

Available in PDF, EPUB and Kindle. Book excerpt: In the face of an uncertain and dangerous world, Americans yearn for a firm moral compass, a clear set of ethical guidelines. But as history shows, by reducing complex situations to simple cases of right or wrong we often go astray. In Morality's Muddy Waters, historian George Cotkin offers a clarion call on behalf of moral complexity. Revisiting several defining moments in the twentieth century—the American bombing of civilians during World War II, the My Lai massacre, racism in the South, capital punishment, the invasion of Iraq—Cotkin chronicles how historical figures have grappled with the problem of evil and moral responsibility—sometimes successfully, oftentimes not. In the process, he offers a wide-ranging tour of modern American history. Taken together, Cotkin maintains, these episodes reveal that the central concepts of morality—evil, empathy, and virtue—are both necessary and troubling. Without empathy, for example, we fail to inhabit the world of others; with it, we sometimes elevate individual suffering over political complexities. For Cotkin, close historical analysis may help reenergize these concepts for ethical thinking and acting. Morality's Muddy Waters argues for a moral turn in the way we study and think about history, maintaining that even when answers to ethical dilemmas prove elusive, the act of grappling with them is invaluable.

Available in PDF, EPUB and Kindle. Book excerpt: Medical Professionals: Conflicts and Quandaries in Medical Practice offers a fresh approach to understanding the role-related conflicts and quandaries that pervade contemporary medical practice. While a focus on professional conflicts is not new in the literature, what is missing is a volume that delves into medical professionals’ own experience of the conflicts and quandaries they face, often as a result of inhabiting multiple roles. The volume explores the ways in which these conflicts and quandaries are exacerbated by broader societal forces, including changing scientific and technological paradigms, commercialization, and strengthened consumer movements, which simultaneously expand the scope of roles and responsibilities that medical professionals are expected to fulfill, and make it more difficult to do so. Several empirical chapters analyze data from qualitative interview studies with clinicians and other stakeholders. The studies highlight the burdens on clinicians who are expected to make informed and justified judgments and decisions in the midst of competing pressures; authors describe the methods that clinicians use to address the associated tensions within specific contexts. Two conceptual chapters follow and offer some innovative ways to think about the challenges facing medical professionals as they strive to make sense of the changing landscape within healthcare. The first reflects on the challenges to clinical practice in the midst of shifting and often competing definitions of disease and associated ideologies of care. The second reflects more broadly on the utility of value pluralism as a framework for conceptualizing and working through moral and professional quandaries. The book concludes with a chapter containing suggestions for how members of the medical profession might reframe their thinking about their roles, responsibilities, and decision-making in the midst of inevitable quandaries such as those presented here. This book will be of vital reading for academics, researchers, educators, postgraduate students, and interested health care practitioners and administrators.

With technology standards becoming increasingly common, particularly in the information and communications technology (ICT) sector, the complexities and contradictions at the interface of intellectual property law and competition law have emerged strongly. This book talks about how the regulatory agencies and courts in the United States, European Union and India are dealing with the rising allegations of anti-competitive behaviour by standard essential patent (SEP) holders. It also discusses the role of standards setting organizations / standards developing organizations (SSO/SDO) and the various players involved in implementing the standards that influence practices and internal dynamics in the ICT sector. This book includes discussions on fair, reasonable and non-discriminatory (FRAND) licensing terms and the complexities that arise when both licensors and licensees of SEPs differ on what they mean by “fair”, “reasonable” and “non-discriminatory” terms. It also addresses topics such as the appropriate royalty base, calculation of FRAND rates and concerns related to FRAND commitments and the role of Federal Trade Commission (FTC) in collaborative standard setting process. This book provides a wide range of valuable information and is a useful tool for graduate students, academics and researchers.

Available in PDF, EPUB and Kindle. Book excerpt: Knowledge is power, and the way knowledge is shared in a congregation can build up or break down community. When congregational leaders are sensitive to the ways that information should be shared, the congregation can become safe and strong. Unfortunately, congregations can easily fall into patterns of communication that lead to disastrous interpersonal and organizational outcomes. Even in times of crisis, however, congregations can learn and practice new skills and healthy communication management. Congregational consultants Kibbie Ruth and Karen McClintock show clergy and laity how to appropriately handle information. From proper ways to respond to rumors to relating information about a staff firing to the congregation, Healthy Disclosure is filled with step-by-step ideas for handling different types of sensitive material. It helps clergy and other congregational leaders understand levels of disclosure, including how and when to reveal information, the difference between privacy and secrecy, legal issues related to public knowledge, and the power of secrets from a congregation's past. What we don't know can hurt us. The more conscious congregational leaders are of the information they have and how they pass it along to others, the better off the congregation will be. Information management is both a technical process and a spiritual undertaking. Leaders need the ability to spiritually discern, not just intellectually decide, the solutions to congregational dilemmas. Ruth and McClintock guide readers in developing the skills needed to create a congregational environment of healthy disclosure.
