It includes Festschriften from 1868 (date of the earliest legal Festschrift found) through December, 1968. A bibliography of all legal Festschriften, to be complete, could only be achieved through the cooperative effort of an international group of experts. The present bibliography is based on notes gathered by the compiler over a period of years from material available at the University of Michigan Law Library. It is therefore, inevitably, incom plete and occasionally inaccurate and must be considered as a tentative list, subject to implementation and correction at other legal centers. It was felt, however, that its publication might be of some use, since not enough bibliographical information about this important and steadily growing type of legal literature exists.

Book excerpt: The feudal system has come to be seen as one of the most characteristic features of the Western Middle Ages, yet the study of feudal law has not always received the same attention as that given to its institutions. This law, it is true, was a subject of secondary importance in the medieval universities, but there does remain a corpus of writing sufficiently large to permit the investigation of how it related to medieval practice. In these articles, now provided with extensive additional notes, Gérard Giordanengo has undertaken such an investigation, with particular reference to Southern France in the 12th-14th centuries. He shows how, in Provence, legal doctrine did exert a clear influence on feudal practice, and that it was the jurists attached to princely or ecclesiastic entourages who were the key to its dissemination. In the Dauphiné, on the other hand, theory had a more limited impact, and feudal ties became not a mark of subjection, but a means of recognising legal and social status. At the governmental level, finally, he argues that it was not any feudal theory, nor even any feudal structures, but rather the absolutist doctrines of Roman law and the Old Testament that shaped the political ideology - and practice, if possible - of the medieval king. Book excerpt: Before Vatican II, marriage was often considered, or at least popularly expressed, as a union of bodies; that is to say, marriage was an exclusive contract by which a man and a woman mutually handed over their bodies for the purpose of acts which led to the procreation of children. Matrimonial jurisprudence was primarily focused on this marital contract. With the advent of Vatican II and its emphasis on the personalist notion of marriage, a new age dawned whereby canonists, especially auditors of the Roman Rota, were henceforth to view marriage as a union of persons. "Person" is more than a "body"; rather, a person is an individual consisting of wants, needs, desires, impulses, hopes and dreams, whose life experience has been shaped by the milieu "cultural, familial, religious" from which he or she comes. "Union" is not only simply understood as a "contract", but also is now once again recognized as a "covenant", a concept which, at least in the Latin Church, was prevalent until the 12th century. One of the canons of the 1983 CIC, although almost identical in wording to its predecessor in the 1917 CIC, but which now must be understood and interpreted in light of the teachings of Vatican II, is canon 1096 which pertains to the effect of ignorance on matrimonial consent. Given the current appreciation of marriage founded in the teachings of Vatican II, especially in Gaudium et spes, reiterated by Popes Paul VI and John Paul II and described in the Catechism of the Catholic Church, complicated by today's western society's stress on individualism and permeated by a divorce mentality, what is the impact of this canon on matrimonial consent? How can its meaning, once understood as being wider than merely the sexual act itself, be better utilized by those in tribunal ministry? This is the major thrust of the present work. The research of the history and development of the concept of ignorance in canonical writings, how its understanding broadened especially after Vatican II and our conclusions on how to apply its richness to marriage nullity led us to expand the use of this canon: how it can aid in the development of pre-marital preparation programs which would not only possibly help prevent couples from being ignorant of the essence of marriage but also help them to appreciate this richness more deeply in their own lives so that marriage truly can become, as we read in canon 1055, "a partnership of the whole of life which is ordered by its nature to the good of the spouses and the procreation and education of offspring". It is our sincere hope that this study, with its extensive footnotes and up-to-date bibliography will not only be of benefit to all who read it but also will serve as a spring board for further discussion and use of this canon as a ground for nullity and other pastoral uses.

In an effort to implement the aims of sustainable development, new views of the traditional liability instrument have to be applied. The book focuses on the Environmental Liability Directive 2004/35/EC (the so-called “ELD”) on the prevention and remedying of environmental damage, and evaluates as to whether the ELD has achieved its goals and maintained its ambitions in terms of environmental protection, and what the optimal level of harmonization in terms of environmental protection is. In order to address the question of research of this book, an interdisciplinary framework of analysis and methodology combining political science and law are developed. Since environmental damage is a multidimensional and multidisciplinary problem, par excellence, a multidisciplinary approach is required. Consequently, the use of a multidisciplinary method, combining together in a systematic and rigorous fashion, law, political science, technical elements of economy, insurance law and natural science, is, in the research design of this study, necessary, in a view of tackling the topic in a scientific problem solving-oriented approach. The book draws the overall conclusions by suggesting proposals for amendments and recommendations to be utilized for possible redrafting of the ELD’s provisions for the time when the ELD will be object of a procedure of revision. This book will be of interest to practitioners in EU law and EU Environmental law, international environmental law, legal experts on the law of environmental liability, specialists within international organizations but also by political scientists, economists, insurance law specialists, and natural scientists.
