Book excerpt: The European Community Customs Code (Council Regulation [EEC] No. 2913/92) was changed in a so-called 'small Customs Code revision' by Regulation (EC) No. 648/2005 of the European Parliament and the Council. All changes of this 'security initiative' will enter into force after the so-called implementing provisions (CCIP) which were changed by Commission Regulation (EC) No. 1875/2006 are entering in force. With the help of two tables, this article explains the complicated system by which several new articles are entering into force from 26 December 2006 (first step), and shall apply from 1 January 2008 (second step) and from 1 July 2009 (third step). Furthermore, a first conclusion about the impact on economic operators and custom administrations is made.

Book Synopsis EC Customs Law by : Timothy John Lyons
Download or read book EC Customs Law written by Timothy John Lyons and published by Oxford University Press, USA. This book was released on 2001 with total page 596 pages. Available in PDF, EPUB and Kindle. Book excerpt: EC Customs Law is an important new study which places the law relating to customs duty in its broader international and EC context. It is a key resource for those already familiar to the area, whether as practitioners, government or Community officials, or graduate students, as well as anaccessible introduction for readers who are coming to the subject for the first time. It aims, in particular, to highlight the role of the European Court of Justice in customs matters. After looking at the fundamental concepts of the customs union and the Community Customs Code and implementing regulations, the author moves on to consider the administration and interpretation of the Tariff, paying special attention to the decisions of the ECJ. Then the various internationalagreements and arrangements between the EC and third countries are considered, and their significance for traders, and the importance of international law generally, is emphasized. The book also deals with the important matters of the origin of goods and their valuation, customs entry and declarations, customs procedures, inward and outward processing, and approved uses and treatments. Chapters follow on the customs debt and reliefs from duty, repayment and remission of duty, and customs appeal. The book concludes with a short overview of some of the issues which are being addressed by the Commission and customs administration in deepening the customs union, and it looks, briefly, at some of the matters which traders must bear in mind in planning theiractivities.
Book Synopsis Customs Law of the European Union by : Massimo Fabio
Download or read book Customs Law of the European Union written by Massimo Fabio and published by Kluwer Law International B.V.. This book was released on 2020-03-12 with total page 660 pages. Available in PDF, EPUB and Kindle. Book excerpt: Today, global competition obliges companies dealing in international trade to modernize their procedures of delivery in order to minimize the customs burden and simplify the relation with customs authorities. Customs planning is the current option to be effective in the worldwide marketplace. However, customs officials are facing new challenges: they must ensure the smooth flow of trade while applying necessary controls on the one hand, while protecting the health and safety of the Community's citizens on the other. To achieve and maintain the correct balance between these demands, control methods are constantly evolving raising major challenges to those charged with planning and compliance. This book is a highly practical work dealing with the ins and outs of European Union (EU) customs law. Cases of study, jurisprudence and comparative law support the analysis of the different legal tools. The consolidated principles ruling the transactions within WTO Member States applied in EU law offer the readers the opportunity to understand how customs rules can be applied in any customs jurisdiction. Authored by an international tax lawyer with extensive experience enforcing EU customs law as a former member of Italy’s financial police, this handy resource is designed to help the reader stay in compliance with the laws controlling EU importing and exporting while structuring transactions in a business-friendly manner. “This book is a reference work in the customs law field. It deals thoroughly and practically with all the matters that a customs law practitioner would need to know. This book works well both for beginners and experts, since both will find needed information and insight in it.” EU Law Live – Book Review by Darya Budova, Senior Associate, Uría Menéndez
Book Synopsis Guide to Community Customs Legislation by : Michael Lux
Download or read book Guide to Community Customs Legislation written by Michael Lux and published by Emile Bruylant. This book was released on 2002 with total page 621 pages. Available in PDF, EPUB and Kindle. Book excerpt: The customs union is an essential element of the European Community's single market with its four basic freedoms: free circulation of goods, persons, services and capital. This single market with currently 370 million consumers is the largest in the industrialised world. The single market with no internal barriers and common rules for trade with the outside world is the catalyst for economic integration within the Community as well as for the liberalisation and promotion of world trade. Customs policy and legislation are one of the cornerstones of the single market, as well as the Community's trade, development and agricultural policy. They are furthermore linked to the collection of VAT and excise duties at importation and the relief from such taxes at exportation. Globalisation of international trade, e-commerce and the forthcoming enlargement of the Community increase the need for information on customs rules. This book contains 19 well-structured chapters with summaries, illustrative examples, law tables, rulings of the European Courts, case studies, as well as a glossary of customs terms so that it can be used both as a study tool and as a reference book for all aspects of customs legislation. It is an indispensable and reliable tool for all who require clear, comprehensive and up to date information in this field, and includes a wealth of detail for all those involved in international trade issues, such as importers and exporters, customs agents, customs officials, lawyers, consultants and trade federations.

Book Synopsis Uniformity of Customs Administration in the European Union by : Kathrin Limbach
Download or read book Uniformity of Customs Administration in the European Union written by Kathrin Limbach and published by Bloomsbury Publishing. This book was released on 2015-11-19 with total page 298 pages. Available in PDF, EPUB and Kindle. Book excerpt: Uniform customs administration is of great importance for the EU and the competitiveness of EU businesses in global trade. However, the EU's so-called executive federalism raises the potential for the non-uniform application of EU customs law. This problem has already arisen in the European Communities – Selected Customs Matters WTO dispute settlement. Therefore, the central research question of this book concerns the challenge presented to executive federalism in the EU Customs Union by the WTO. It also examines those safeguard measures for uniform customs administration which are in operation. Valuable empirical analysis of the decision-making procedures and practices of the national customs authorities allows for the fullest understanding of the operation of the customs administration. An important feature of the exploration is its analysis of the reform of EU customs law and of the effectiveness of the European Union's strategies to enhance uniform customs administration. That analysis helps to identify potential weak points in the decentralised administration of EU customs law and suggests ways in which it might be improved. Scholarly, rigorous and timely, this important study will be required reading for all scholars of EU customs law.
