Book Synopsis Harmonization, Equivalence and Mutual Recognition of Standards in WTO Law by : Humberto Zúñiga Schroder
Download or read book Harmonization, Equivalence and Mutual Recognition of Standards in WTO Law written by Humberto Zúñiga Schroder and published by Kluwer Law International B.V.. This book was released on 2011-01-01 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: Standards are a feature of virtually all areas of trade in products and services. Yet, although standards may achieve an efficient economic exchange, they have discriminatory consequences for trading partners when governments formulate or apply them in such a way as to cause obstacles to trade, thus enrolling standards among the increasingly significant 'non-tariff barriers' regulated by the WTO. This unique and original study analyses the functions that standards fulfil in the market, their effect on trade, and the legal regime based on harmonization, equivalence and mutual recognition developed by the WTO to deal with standards. The author investigates the way in which both the WTO Technical Barriers to Trade (TBT) and the Sanitary and Phytosanitary (SPS) Measures Agreements regulate these three tools, and discusses key topics including: The definition of the concept 'International Standard' in the TBT Agreement. Guidelines on equivalence issued by organizations such as the Codex Alimentarius Commission, the World Organization for Animal Health and the International Plant Protection Convention. Parallels between the EC mutual recognition regime and the WTO system. This is the first work on its subject. With its detailed and practical analysis of WTO law on standards, the book is a fundamental reference for practitioners, academics and policy makers in international trade law.

This book was released on 2022-02-15 with total page 176 pages. Available in PDF, EPUB and Kindle. Book excerpt: This incisive book tackles a controversy that has plagued the Warsaw Convention 1929 and the Montreal Convention 1999 for decades: whether the conventions provide an independent cause of action upon which a plaintiff can rely directly when pleading their action, and, if so, whether that cause of action provides the exclusive remedy. This book resolves this controversy by presenting a new conceptual framework for understanding aviation law cause of action in the conventions.

Book Synopsis The Neuropsychology of Dreams by : Mark Solms
Download or read book The Neuropsychology of Dreams written by Mark Solms and published by Psychology Press. This book was released on 2014-02-25 with total page 311 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, Mark Solms chronicles a fascinating effort to systematically apply the clinico-anatomical method to the study of dreams. The purpose of the effort was to place disorders of dreaming on an equivalent footing with those of other higher mental functions such as the aphasias, apraxias, and agnosias. Modern knowledge of the neurological organization of human mental functions was grounded upon systematic clinico-anatomical investigations of these functions under neuropathological conditions. It therefore seemed reasonable to assume that equivalent research into dreaming would provide analogous insights into the cerebral organization of this important but neglected function. Accordingly, the main thrust of the study was to identify changes in dreaming that are systematically associated with focal cerebral pathology and to describe the clinical and anatomical characteristics of those changes. The goal, in short, was to establish a nosology of dream disorders with neuropathological significance. Unless dreaming turned out to be organized in a fundamentally different way than other mental functions, there was every reason to expect that this research would cast light on the cerebral organization of the normal dream process.

Book Synopsis The Cape Town Convention by : Anton Didenko
Download or read book The Cape Town Convention written by Anton Didenko and published by Bloomsbury Publishing. This book was released on 2021-04-08 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the first detailed and comprehensive research of the history of the Cape Town Convention and its protocols. It critically engages with the challenges faced by the developers of this treaty, analyses thousands of pages of archived materials and derives important lessons for the development of transnational commercial law globally. The book is an invaluable addition to the existing literature on the Cape Town Convention. It also informs the debate about harmonisation of secured transactions regimes generally, and as such will be of interest to academics, legal practitioners and the judiciary involved in secured transactions law around the world. Practising lawyers will better understand the rationale behind the key provisions of the Cape Town Convention, while the treaty-making lessons will assist governmental officials, representatives of international organisations and legal advisors engaged in harmonisation of commercial law. The text covers all four protocols to the Cape Town Convention, including the MAC Protocol adopted on 22 November 2019 in Pretoria.
