Book excerpt: The purpose of this Specific Contract was to provide the Commission with an overview of the existing international obligations regarding the management of discards within select Regional Fisheries Management Organisations or Agreements (RFMOs) and Sustainable Fisheries Partnership Agreements (SFPAs) beyond EU waters, and to identify to what extent such international obligations are aligned or are inconsistent with Article 15 (hereafter the EU landing obligation) of the new Common Fisheries Policy (CFP) regulation, based on all phased and final provisions to be implemented by 2019. A review of RFMO management measures and SFPA protocols identified a diverse range of binding and non-binding management obligations relevant to discarding within RFMOs and SFPAs. The majority of management measures relevant to the practice of discarding were in place as a means to achieve an alternative objective (e.g. long term management plans, TAC management etc.). Amongst the following RFMOs and SFPAs reviewed for this study: Tuna RFMOs: CCSBT, IATTC, ICCAT, IOTC, WCPFC; Non-tuna RFMOs: CCAMLR, CECAF, NAFO, NEAFC, SEAFO, SIOFA, SPRFMO; SFPAs: Greenland, Mauritania, Morocco six RFMO measures (three ICCAT Recommendations and three NAFO Conservation and Enforcement measures) have the potential to lead to fishing activities inconsistent with the EU landing obligation in these regulatory areas. As a result, a total of 28 EU métiers currently active within NAFO, ICCAT and areas of NEAFC which overlap with the ICCAT area will be impacted to varying degrees by a requirement to land catches other international vessels can discard. For many of these métiers, information available on the extent of discards of species subject to the EU landing obligation is limited. It has therefore been difficult to establish the extent to which EU metiers will be impacted by identified potential inconsistencies with the EU landing obligation.

Book excerpt: The authors estimate that between 17.9 and 39.5 million tons (average 27.0 million) of fish are discarded each year in commercial fisheries. These estimates are based on a review of over 800 papers. The highest quantities of discards are from the Northwest Pacific while tropical shrimp trawl fisheries generate a higher proportion of discards than any other fishery type, accounting for one third of the global total. Of four major gear groups, shrimp trawls stand alone at the top of the list; bottom trawls, long-lines and pot fisheries come next. The third group consists of Japanese high-seas drift net fisheries, Danish seines and purse seines for capelin. Relatively low levels result from pelagic trawls, small pelagic purse seines and some of high seas drift nets. The authors point to inadequate data to determine the biological, ecological, economic and cultural impacts of discards although economic losses run to billions of dollars. However, it appears most likely that socio-cultural attitudes towards marine resources will guide international discard policies. Techniques to reduce bycatch levels including traditional net selectivity, fishing gear development and time/area restrictions, are discussed. Effort reduction, incentive programmes and individual transferable quotas (that make the vessel responsible for bycatch reduction) are seen as promising avenues for the future. However, quick solutions to the problem are unlikely and much more information is required. The publication includes a diskette with the complete Bycatch Database, which was compiled for the study, and a summary of it.

This report provides the information and results of all the work carried out throughout the study. It includes the key content of all tasks and deliverables. In addition, the deliverables and relevant information from some sub-tasks have been included as annexes. The starting point for the development of this study are the outputs of previous initiatives (e.g. recent desk-based studies related to DSF management and VME conservation, EU research projects, etc.). In this regard, it is noteworthy that in 2018 the European Commission commissioned a specific study aiming at providing a comprehensive review and analysis of the scientific approaches adopted and in development by each of the RFMOs and RFBs that manage bottom-fishing activities. Its findings demonstrated the panoply of methodologies and criteria that are currently in place across RFMOs. This study (hereafter "SC08") provides an appropriate starting point upon which to compare and contrast the performance of different RFMOs, with respect to DSF, and with a particular focus on the avoidance and mitigation measures designed to conserve and protect VMEs, species, habitats and biodiversity in the deep sea.

Book excerpt: This third update of FAO’s global discard estimate adopted the ‘fishery-by-fishery’ approach employed in the second discards assessment published in 2005. The update included publicly available discard data in the last 20 years to establish a baseline of a time series of global marine fisheries discards. This is essential for monitoring the status and trends of discard management, which is the first step of the ecosystem approach to fisheries management cycle. In addition, the study developed a new fisheries data table incorporating landings data from the FAO Global Capture Production dataset (FishStat J) from 2010 to 2014, which allocated the landings to over 2 000 fisheries worldwide. The current study estimated that the annual discards from global marine capture fisheries between 2010 and 2014 was 9.1 million tonnes (95% CI: 6.7 – 16.1 million tonnes). About 46 percent (4.2 million tonnes) of total annual discards were from bottom trawls that included otter trawls, shrimp trawls, pair bottom trawls, twin otter trawls and beam trawls. The study included a synthesis of estimates of bycatch and discards of endangered, threatened and protected (ETP) species. Substantial advances have been made in quantifying fisheries interactions with such species so as to make informed decisions on their protection. However, many challenges remain, especially for small-scale fisheries. The development of standardized data collection techniques, risk-based sampling and sharing of data across agencies and regions will help to identify management priorities and allow implementation and enforcement of mitigation measures. A review of previous research showed that discard practices were often related to a wide range of factors, so it is difficult to assess the effectiveness of fishery management actions on the amount and practice of discards. Many regulations are inconsistently enforced, and their implementation is often less strict than intended. Piecemeal approaches in many bycatch and discards management measures can result in unintended cross-taxa conflicts, where regulations designed to reduce bycatch and/or discards of one species or species group may increase bycatch and/or discards of another. Examination of approaches to accounting for and mitigating against pre-catch, post-capture and ghost fishing mortalities demonstrates that an understanding of the relative importance of factors affecting indirect fishing mortality is necessary for estimating total fishing-induced mortality and for designing and implementing mitigation measures.

Book excerpt: In this report the Environment, Food and Rural Affairs Committee concludes that radical reform is needed to ensure that the Common Fisheries Policy (CFP) delivers for the fish, the fishermen, and the coastal communities that depend on them. The widespread desire to deliver a more local approach to fisheries management is hampered by the EU's exclusive competence over the conservation of marine resources under the CFP as only the EU can make rules regarding fisheries conservation. The Commission has baulked at repatriation of fishing policy through a full-scale Treaty change but the Committee highlights an alternative: this can be done by amending the CFP regulation itself. This approach would give Member States genuine freedom and responsibility and would set clear boundaries to the Commission' role. The Commission also wants to implement a discard ban on many commercial species starting in 2014, but the MPs question whether the proposal will prove effective. Instead, the Committee argues for a more gradual approach built on a sound science base and the local experience of fishermen to find workable solutions to the discard problem that has blighted European fisheries. The Committee also urges Defra not to abandon its commitment to domestic fisheries reform that delivers a fairer deal to small-scale fishermen. The Committee proposes a novel mechanism to reallocate unused fishing rights from 'slipper skippers' to active fishermen (a topic that was covered in an earlier report on the CFP and domestic fisheries management, sixth report of session 2010-12, HC 858, ISBN 9780215559944).

It introduced a phased implementation of a discard ban: a prohibition on discarding catch, generally described as the Landing Obligation (LO). The introduction of the LO was essentially a change from a 'landing' to a 'catch quota' system. In January 2019, the phased implementation was completed and the LO was fully implemented, covering all quota stocks in EU waters and those with Minimum Sizes in the Mediterranean. However, the transition towards a fully implemented catch quota regime has proved very challenging for some fisheries. The ultimate objective of the landing obligation is to reduce the wasteful practice of discarding, to create incentive to fish more selectively and avoid unwanted catches. Member States undertook several initiatives and voluntary measures to facilitate the LO. Most were related to selective gear trials. Stakeholder interviews and questionnaires conducted in this study showed that the process for approving newly developed gear is long and severely delayed implementation of these measures. Avoidance (or 'move-on') rules were facilitated by voluntary agreements and helped to increase knowledge of areas with high discard levels in pelagic and demersal fisheries. These move-on rules, together with improvements in fishing gear selectivity, were considered the most effective in facilitating the implementation of the LO. Despite this, these technical measures were considered less viable from an economic point of view, as they require extra investments from vessel owners in new fishing gear and, also, the potential loss of efficiency in catching the most valuable target species. Other examples of measures taken to facilitate the LO were: adaption of national quota management to better fit the challenges the LO presented, initiatives to increase survivability, weekly catch limits and initiatives focused on improving accountability and quota alignment. Consultation with stakeholders through interviews, questionnaires and online workshops pointed out that areal closures were classified as 'less effective', as were TAC removals and changes in Minimum Conservation Reference Size (MCRS). There was concern among some stakeholders that the removal of TACs as a management measure would be solely based on the desire to avoid choke species problems and, therefore, bypass the need to protect vulnerable stocks in mixed fisheries in the first place. As a result, removing TACs was thought to be un-precautionary, as it would have negative effect on sustainable management of stocks. When aiming to mitigate potential lasses in fishing opportunities due to choke considerations, adaptions of national quota management to better fit LO challenges and quota swaps between Member States were the preferred options, followed by high survivability exemptions.

To assess the viability of a waste compaction operation, the main operation factors governing the process were identified, and their influence upon the performance of a prototype at pre-industrial scale was investigated by a statistical approach. The main drawback associated to fish waste compaction is the generation of a variable amount of wastewaters, which cannot be directly discharged without a suitable depuration treatment. To this regard, the proposed wastewater treatment comprised two series filter cartridges, able to remove most of the fine solids followed by a membrane batch concentration unit able to produce a final permeate meeting the current environmental regulations.
