Available in PDF, EPUB and Kindle. Book excerpt: Domestic violence, the most pervasive form of violence against women, is accepted internationally as a violation of human rights and about 125 countries have policies to address it. Women's movement and activism first brought the issue of violence against women onto the mainstream policy making agenda. The focus now rests on how efficient these policies are. However, few impact assessment studies on these policies are available. This research seeks to fill this gap. An impact assessment of the Indian Protection of Women from Domestic Violence Act (PWDVA) 2005 was done in three States of India: Delhi, Madhya Pradesh and Uttar Pradesh. The research assessed the impact of accessing PWDVA in the lives of 78 women from these three States. Since States have allocated different resources and used different models of implementation, this research also assessed the impact of the State's commitment and resources on the outcomes for women. For this research, a gendered impact analysis framework was used, which focussed on assessing the level of strategic gender needs of women that were being met. Feminists have argued that gender-aware policies might not result in gender equitable goals due to the law implementer's gender bias. The women interviewees reported on the law implementers' behaviour and its impact on the outcomes. They also reported on their overall satisfaction with the outcomes through PWDVA and its impact on their lives in reducing violence, homelessness and economic dependence. The women rated judges, police, lawyers, protection officers appointed under this Act and NGOs that had been registered as service providers. It was found that the judges were most influential in impacting the outcomes for women inside court and police were most influential outside the court. However, negative behaviours from both adversely impacted outcomes. It was found that judges also highly influenced the relief granted to women and that protection orders were granted to only one third. Maintenance was the relief most often granted. The research findings also show that protection officers, intended to be the main law implementers for the PWDVA, were the least accessed law implementers in the given research sample. Overall, about 37 percent of women were extremely satisfied or satisfied with the outcomes and about same number of women, that is 37 percent, were not satisfied with the outcomes. There were about 23 percent who were partially satisfied. Analysis of the behaviour of the key stakeholders reveals that civil society, in the form of women's organisations, NGOs and activists, are the only institutions that consistently provide gender-sensitive support to women. The other stakeholders can be characterised as still representing the patriarchal state; with gender-insensitive behaviours negatively influencing the gender relations that women share with men. This research highlights the need to further incorporate civil society into implementation of the Act and into capacity-building for other stakeholders such as the judiciary and police.

Available in PDF, EPUB and Kindle. Book excerpt: This book critically examines domestic violence law in India. It focuses on women’s experiences and perspectives as victims and litigants, with regard to accessibility to law and justice. It also reflects on the manner in which the legal process reproduces gender hierarchies. This volume: Analyzes the legal framework from a gender perspective to pinpoint the inherent stereotypes, prejudices and discriminatory practices that come into play while interpreting the law; Includes in-depth interviews and case studies, and explores critical themes such as marriage, rights, family, violence, property and the state; Presents alternatives beyond the domain of law, such as qualitative medical care and legal aid facilities, shelter homes, short-stay homes, childcare facilities, and economic and social security provisions to survivors and their children. Drawing on extensive testimonies and ethnographic studies situated in a theoretical framework of law, this book will be of great interest to scholars and researchers of law, gender, human rights, women’s studies, sociology and social anthropology, and South Asian studies.

Book excerpt: Mainstream counselling in domestic violence often fails to address critical issues, such as gender socialisation processes and the abuse of power that allows violence against women, and focuses primarily on the intra-psychic nature of individual women. In contrast, feminist counselling is an effective alternative model, owing to its ability to address the fundamental correlation of abuse with power. In going beyond the individual, it helps women locate the source of their distress in the larger social context of power and control, manifesting in intimate, interpersonal relationships, and enables them to resist systemic oppression. This volume offers one of the first systematic documentations of feminist psychosocial interventions in India. It situates the issue of domestic violence in the historical context of the women’s movement, and examines institutional factors such as family and marriage that perpetuate abuse. Using extensive case studies, it discusses the methods, principles, techniques, skills and procedures followed by feminist organisations across the country, and their role in women’s empowerment. The book will serve as a practical reference guide to practitioners such as social workers, counsellors and para-counsellors, health activists, grassroots workers, protection officers and service providers. It will also be useful to scholars and students of psychology, sociology, women’s studies, law and public policy.

Available in PDF, EPUB and Kindle. Book excerpt: This book discusses health care issues related to domestic violence, using extensive case studies from India. By discussing the global literature, legal systems, methodological challenges of gathering information on domestic violence, and health systems issues, along with learnings from case studies, it fills a significant gap in the literature between health care policy and practice vis-à-vis victims of domestic violence. It therefore enables a systemic and systematic response to incidents of domestic violence. Policy instructions, court verdicts, government interventions, community-based direct interventions and related case discussions in the book help in the understanding and management of cases. Though the book uses case studies from India, it addresses globally relevant issues for health care professionals. In view of the paucity of application of systematic evidence-based knowledge, the holistic perspective presented in the book is important to prevent domestic violence, protect women’s rights, and promote healthcare and wellbeing of women and children facing domestic violence. Medical professionals are expected to intervene in instances of injuries related to domestic violence---a responsibility that they are currently unable to fulfil due to lack of training in recognizing abuse and lack of tools for intervention. This book improves hands-on-knowledge by providing information on where to refer victims for assistance and timely intervention. Comprehensive yet lucid, this book is useful for academics, policy makers, non-government organizations and women’s rights groups in helping victims during and after a violent episode and also in improving reporting and referral services.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the prevailing legal discourse surrounding domestic violence law in India. It investigates the myths, patriarchal stereotypes, and misconceptions that undermine the process of justice and dilute legal provisions to the detriment of survivors. The volume: Develops arguments based on legal case studies and draws extensively on knowledge from various fields of study, as well as the experience of women survivors. Examines fallacies within the legal framework through a study of strategic lawsuits against public participation suits within the Indian context. Proposes measures for a fair and more gender inclusive legal system that focuses on facilitating access to justice. Suggests that emphasis be laid on establishing the rule of law and eliminating the culture of violence. A key text on gender and law in India, this book will be indispensable to scholars and researchers of socio-legal studies, law, gender, human rights, women’s studies, social science, political science, and feminist jurisprudence in South Asia. It will also be of interest to NGOs, activists, and lawyers.
