It has been considered as an important right for the local communities living around or across protected areas. However, the right to land is almost absent from international instruments of human rights. Land rights are not typically perceived to be a human rights issue.1 Land rights is corporeal hereditament as they are physical or tangible objects incorporated in land while rights to land is incorporeal which fall under property rights. In the same vein, rights to land aÌ22́Ơ¿3broadly refer to rights to use, control, and transfer a parcel of land, and include the rights to: occupy, enjoy and use land and resources; restrict or exclude others from land; transfer, sell, purchase, grant or loan; inherit and bequeath; develop or improve; rent or sublet; and benefit from improved land values or rental incomeaÌ22́Ơ℗+.2 Legally, according to Gilbert, land rights fall in the aÌ22́Ơ¿3categories of land laws, land tenure agreements but they are rarely associated with human rights lawaÌ22́Ơ℗+.3 Internationally, there is no treaty or any specific declaration that refers to human rights to land.4 Even land rights are absent from international instruments of human rights. The African Charter on Human and PeoplesaÌ22́Ơ4́Ø Rights stipulates in article 14: aÌ22́Ơ¿3the right to property shall be guaranteed. It may only be encroached upon in the interest of public need or in the general interest of the community and in accordance with the provisions of appropriate lawsaÌ22́Ơ℗+5. This can be construed to cater for land rights in international law. Land dispossession has a negative impact on the local communities and on all mankind as it impacts on their livelihood and also has a negative impact on the environment. It is extremely true that local communities also want to share the resources of their land and to benefit from them. The establishment of protected areas is a worldwide practice that intends to defend biodiversity and wildlife from human development.6 Such a policy tends to neglect the rights of local communities, generally in the practice of protected areas. Most protected areas have followed the conventional and exclusionary approach that was applied at Yellowstone7 in 1972 and have failed to fully integrate other important factors such as social and cultural issues. The dispossession of land can be considered as a restrictive measure that imposes difficult and most of the time conflicting effects to the people settled around protected areas. The dispossession of land has triggered adverse social impacts on local communities in some cases by disrupting their traditional ways of living and limiting their control of and access to resources.8 The dispossession of land undermines protection policies through conflicts between protected area managers and local communities. The prohibition of communities from their land without consultation violates the obligations for free, prior and informed consent (FPIC). This study investigates the human rights implications on protected land of Luki Reserve in the Democratic Republic of the Congo (DRC). It will also explore the DRC land rights framework and their implications on socio-economic rights of local communities such as: the right to food, right to clean water, right to housing, right to health and the right to culture.

Book excerpt: Garret Hardin's famous article published in 1968 entitled The Tragedy of the Commons triggered a heated debate over the capacity of local communities, leading to the development of a new field of research on how shared resources could be depleted, and how collective action could prevent it. This research, however, has not yet been applied fully to broader conservation policy. Protected areas have a particularly close relationship to property rights, to which the knowledge on common property could contribute to a higher degree. This research aims to integrate them better by proposing a hybrid concept - the common property protected area (CPPA). It identifies different characteristics between the two bodies of literature in governance structures, objects of management, values and uses, and stakeholder relationships. Then, this thesis conceptualizes CPPA as a bounded area of land and/or water under legal or other effective common property governance, and managed for both nature conservation and well-being of local people. The empirical part of the research looks at Costa Rica as a country-level case study with emphasis on policies and examples of forest conservation by government and non-governmental sectors, followed by two site-specific case studies in Costa Rica. One site was a forest reserve owned and managed by a local community for local well-being and conservation values. This case was selected as an example of a CPPA. The other was a forest reserve belonging to an individual owner, which allowed for a comparison with a CPPA. This research identified key preconditions and promoting factors for grassroots institutions aimed at combining nature conservation and local people's well-being, roughly grouped in four categories: physical and environmental characteristics; social capacity; property rights and roles of various stakeholders; and driving forces. Several preconditions were identified in the studied cases, including clear boundaries, normative values favoring conservation, the well-being of core property owners, and flexibility in the bundles of property rights held by stakeholders.

Book excerpt: Reviewing the conditions in which the Reduction of Emissions from Deforestation and Forest Degradation (REDD+) mechanism is being established in the Democratic Republic of Congo (DRC) is part of Component 1 of the Global Comparative Study on REDD+ (GCS-REDD) being conducted by the Center for International Forestry Research. The overall aim of this global study is to provide decision-makers, practitioners, donors and the scientific community with reliable information on the dynamics of national actions related to the REDD+ mechanism. Discussions on REDD originally seemed to focus on the construction of a global structure and the establishment of a multilateral instrument to replace the Kyoto Protocol. But at the 14th Conference of Parties (CoP 14), held in Poznan in 2008, discussions on the reliability of REDD+ focused more on the dynamics of national- and local-level actions and brought out the need to better understand, analyze and explain the national institutional context of REDD+ development. Subsequently, this review used the extractive approaches. The first inputs were reports, articles, books and documents on the DRC that were directly related to forest management, socioeconomic and political institutions, etc., whether published or not. Because of the diversity of sources, the quantitative data sometimes seem contradictory and conflictual. In the next step, semi-structured interviews were held with experts working in the forestry sector and data were obtained from the participants observations. Since this analysis covers the period between May 2011 and June 2012 actions in the field and the institutions after those dates were not included.

The country experiences complex relationships between drivers, agents, and institutions of deforestation nationally. The REDD+ policy arena is influenced by both governmental and non-governmental actors whose number have increased in the policy arena over the years; however, weak coordination among these actors remains an issue. Since 2009, the DRC has announced several reforms relating to land tenure, land-use planning and agricultural policy, to create an institutional environment that motivates the implementation of REDD+ in the DRC. By 2019, none of these reforms had materialized, due to both political changes and a lack of finance, capacity, and political will. Between 2013 and 2019, little progress has been made on REDD+ in the DRC, as a result of conflicting interests among actors both at national and decentralized levels; information asymmetry; elite capture and corruption; and the pre- and post-election situation. To date, the effectiveness of REDD+ activities in the DRC remain unclear, due to the absence of rigorous impact assessment. However, efforts can be observed on the field where there is increased number of participants to forest policy process compared to REDD+ early years; and several ongoing projects are testing policy options within and across levels. If these efforts are sustained, they can contribute in putting in place conditions to achieve REDD+ objectives.
