This book was released on 2013-10-01 with total page 914 pages. Available in PDF, EPUB and Kindle. Book excerpt: Complex Criminal Litigation: Prosecuting Drug Enterprises and Organized Crime provides practitioners and others interested in the federal criminal justice system with a comprehensive analysis of the arsenal of federal laws that provide federal prosecutors the means to combat criminal organizations, their leadership (i.e. the so-called "kingpins") and their infrastructure. These statutes include the Racketeer Influenced and Corrupt Organizations Act (RICO); the Continuing Criminal Enterprise or CCE statute; the Money Laundering Control Act; federal firearms statutes; and criminal and civil forfeiture laws that permit the seizure and forfeiture of the profits and instrumentalities of illegal enterprises. Further, the treatise includes an analysis of the principal legal issues that federal prosecutors and defense attorneys need to consider in handling long-term, complex criminal conspiracies that frequently involve multiple and diverse criminal acts from the rules relating to grand jury secrecy, granting immunity, bail, criminal discovery, and all points in between. Finally, because organized criminal activity respects no national boundaries, the treatise includes a comprehensive discussion of international criminal law, including extraterritorial jurisdiction and extradition. Criminal trial attorneys involved in litigating complex criminal cases will benefit greatly from reading this treatise.

Book excerpt: "Misuse of Drugs has for many years enjoyed a well-deserved reputation as the core reference on the laws of drug misuse and trafficking. Written by specialist author Dr Don Mathias, the nineteen chapters of Misuse of Drugs are a treatment of central topics in criminal law from the perspective of drug offences. Indeed, the book guides the reader through all major aspects of this complex and multi-faceted area of the law, including: the range of offences related to the possession, manufacture, supply, production, import, export, procurement, production, cultivation, or consumption of controlled drugs; the court processes (including those relevant to bail applications, prevention of abuse of process, and sentencing) relevant to drug offences; the application of the law of evidence, search and seizure, and surveillance to drug offences; important forensic issues such as the need for the prosecution to prove that substances involved in alleged offences are in fact controlled drugs; The law related to forfeiture of proceeds of offending, proceeds of crime and money laundering. These features make the text essential reading for all criminal lawyers, and for judges, the police, probation officers, forensic scientists, students and members of the public interested in the law of drug misuse and trafficking."--Publisher's website.

Drawing on their valuable experience, authors address the enforcement tools designed by Congress & the regulatory agencies to prevent & prosecute false billing & corruption. Chapters focus on federal criminal statutes, the civil False Claims Act, the Food & Drug Act, the Anti-Kickback Statute & Stark Prohibitions (and related safe harbors), & Department of Health & Human Services advisory opinions. The authors also explain the litigation & settlement process & the various outcomes.
Book Synopsis What's Changing in Prosecution? by : National Research Council
Download or read book What's Changing in Prosecution? written by National Research Council and published by National Academies Press. This book was released on 2001-05-23 with total page 72 pages. Available in PDF, EPUB and Kindle. Book excerpt: This workshop arose out of the efforts of the Committee on Law and Justice to assist the National Institute of Justice in identifying gaps in the overall research portfolio on crime and justice. It was designed to develop ideas about the kinds of knowledge needed to gain a better understanding of the prosecution function and to discuss the past and future role of social science in advancing our understanding of modern prosecution practice. The Committee on Law and Justice was able to bring together senior scholars who have been working on this subject as well as current or former chief prosecutors, judges, and senior officials from the U.S. Department of Justice to share their perspectives. Workshop participants mapped out basic data needs, discussed the need to know more about recent innovations such as community prosecution, and discussed areas where one would expect to see changes that have not occurred. The resulting report summarizes these discussions and makes useful suggestions for learning more about prosecution.

Book Synopsis The Role of Monarchy in Modern Democracy by : Robert Hazell
Download or read book The Role of Monarchy in Modern Democracy written by Robert Hazell and published by Bloomsbury Publishing. This book was released on 2020-09-17 with total page 501 pages. Available in PDF, EPUB and Kindle. Book excerpt: How much power does a monarch really have? How much autonomy do they enjoy? Who regulates the size of the royal family, their finances, the rules of succession? These are some of the questions considered in this edited collection on the monarchies of Europe. The book is written by experts from Belgium, Denmark, Luxembourg, the Netherlands, Norway, Spain, Sweden and the UK. It considers the constitutional and political role of monarchy, its powers and functions, how it is defined and regulated, the laws of succession and royal finances, relations with the media, the popularity of the monarchy and why it endures. No new political theory on this topic has been developed since Bagehot wrote about the monarchy in The English Constitution (1867). The same is true of the other European monarchies. 150 years on, with their formal powers greatly reduced, how has this ancient, hereditary institution managed to survive and what is a modern monarch's role? What theory can be derived about the role of monarchy in advanced democracies, and what lessons can the different European monarchies learn from each other? The public look to the monarchy to represent continuity, stability and tradition, but also want it to be modern, to reflect modern values and be a focus for national identity. The whole institution is shot through with contradictions, myths and misunderstandings. This book should lead to a more realistic debate about our expectations of the monarchy, its role and its future. The contributors are leading experts from all over Europe: Rudy Andeweg, Ian Bradley, Paul Bovend'Eert, Axel Calissendorff, Frank Cranmer, Robert Hazell, Olivia Hepsworth, Luc Heuschling, Helle Krunke, Bob Morris, Roger Mortimore, Lennart Nilsson, Philip Murphy, Quentin Pironnet, Bart van Poelgeest, Frank Prochaska, Charles Powell, Jean Seaton, Eivind Smith.
Book Synopsis Drink and Drug Drive Case Notes by : Pauline M. Callow
Download or read book Drink and Drug Drive Case Notes written by Pauline M. Callow and published by . This book was released on 2015 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many thousands of people are prosecuted each year for drink and drug driving offences. The legislation favours the prosecution in a number of ways, for example, by requiring those under investigation to give evidence against themselves in the form of specimens of breath, blood or urine, but also affords certain safeguards to suspects. The conviction rate is exceptionally high, and the provisions have given rise to a wealth of case law.Drink and Drug Drive Case Notes comprises summaries of the many cases on drink driving, and the fewercases on drug driving, which have come before the High Court, the Court of Appeal, the House of Lords and, in one instance, the Supreme Court. Over six hundred judgments are summarised. Each note is presented as a short statement of the facts of the case, the question(s) put to the appeal court and an extract from the judgment. The notes are intended to provide a broad outline of the trends in the case law and as starting points for readers seeking guidance on particular issues. This third edition includes notes of some seventy-five cases decided since the second edition was published. Themes running through the new cases include the interpretation of the provisions on reasonable cause to believe that the breath analysis device has not produced a reliable indication of the suspect's breath alcohol level, and on the application of the Criminal Procedure Rules to proceedings for drink and drug driving. At the time of publication, the so-called "statutory option" has just been removed, and section 5A of the Road Traffic Act 1988, creating new offences of driving, attempting to drive, and in charge, with a concentration of a specified controlled drug above a specified limit, has come into force. The offences are framed in much the same terms of the excess alcohol offences, but testing will be by the analysis of blood or urine only. While much of the case law concerning drink-driving will be relevant, the new provisions will no doubt give rise to their own body of case law in due time.Drink and Drug Drive Case Notes was first published, as Drink Drive Case Notes, as a product of collaboration between Lion Laboratories - the manufacturers of much of the breath-testing equipment used in the UK and throughout the world - and the author. This expanded and updated edition of Drink and Drug Drive Case Notes will prove a useful reference for police, prosecutors, defenders and legal advisers."As a reference guide, this is an extremely helpful addition to a legal adviser's kitbag." The Justices' Clerk, of the first edition"[A]n extremely useful complement to any standard text book on drink driving matters. I would commend it not only to defence lawyers but also to those who prosecute in this area of law."Solicitors Journal, of the second edition
