Book Synopsis The Expert Consumer by : Alain Chatriot
Download or read book The Expert Consumer written by Alain Chatriot and published by Routledge. This book was released on 2017-09-29 with total page 355 pages. Available in PDF, EPUB and Kindle. Book excerpt: Recent work has focused on the politics of consumption and its manifestation in a number of situations. This volume extends these debates, providing a tighter focus and contributing to a noticeable gap in the field that numerous scholars are beginning to turn towards: that is, organizations of consumers themselves who have chosen to speak for all consumers and similar such bodies of experts which act on behalf of consumers. The volume is fortunate in drawing upon a number of scholars who are about to publish major works on the subject, but who are happy to provide summary versions of their work for the volume. The book pays particular attention to specific moments in consumer mobilization and expertise, capturing the range of types of expert consumers across the twentieth century, from ethical consumer groups at the beginning, to intellectuals, housewives, economists and public officials. It addresses questions on the nature of consumer organizing, which bodies can speak for consumers, whether one consumer voice can ever be identified and the relationship between consumption and citizenship. Overview pieces demonstrate the larger narratives involved in the study of the expert consumer, whilst more comparative essays set out the nature of transatlantic exchanges. Other contributions point to the similarities across seemingly different consumption regimes, while case studies of specific organisations and key historical moments draw out the particularities of consumer expertise.

Book Synopsis The Architecture of European Codes and Contract Law by : Stefan Grundmann
Download or read book The Architecture of European Codes and Contract Law written by Stefan Grundmann and published by Kluwer Law International B.V.. This book was released on 2006-01-01 with total page 394 pages. Available in PDF, EPUB and Kindle. Book excerpt: The nineteen outstanding contributors to this deeply insightful book concur in envisioning a fundamentally new systematic concept of contract law that, while preserving the essential andarchitectureand of the existing European codes, would nonetheless find cogent ways to integrate such modern developments as mass transactions, chains and networks of contracts, regulation of markets and contracts to protect consumers, and service and long-term contracts into an optional European code. The book is organised along three major avenues: and the systematic arrangement of a contract law code - how it deals with core questions of formation and performance or breach of contract, such as mistake and misrepresentation, standard contract terms, and remedies in the case of breach of contract; and the apparent necessity to merge consumer contract law (i.e. such issues as product safety and liability, warranties, and consumer debt and insolvency) with traditional core contract law concepts; and and the importance to substantive contract law of the pre-contractual phase, in which information duties are becoming steadily more paramount. The authors perspectives cover a wide range of jurisdictions, including new EU Member States. The bookands commitment to an integration of comparative law, EC law, and the debate on European codification offers practitioners and academics fertile ground for the development of a new model of contract law that is more than a common denominator of what has been in force so far. This model may serve as a basis for Europe-wide and perhaps even worldwide discussion.

Book Synopsis Class Actions in Europe by : Alan Uzelac
Download or read book Class Actions in Europe written by Alan Uzelac and published by Springer Nature. This book was released on 2021-06-23 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: Not so long ago, class actions were considered to be a textbook example of American exceptionalism; many of their main features were assumed to be incompatible with the culture of the civil law world. However, the tide is changing; while there are now trends in the USA toward limiting or excluding class actions, notorious cases like Dieselgate are moving more and more European jurisdictions to extend the reach of their judicial collective redress mechanisms. For many new fans of class actions, collective redress has become a Holy Grail of sorts, a miraculous tool that will rejuvenate national systems of civil justice and grant them unprecedented power. Still, while the introduction of various forms of representative action has virtually become a fashion, it is anything but certain that attempting to transplant American-style class action will be successful. European judicial structures and legal culture(s) are fundamentally different, which poses a considerable challenge. This book investigates whether class actions in Europe are indeed a Holy Grail or just another wrong turn in the continuing pursuit of just and effective means of protecting the rights of citizens and businesses. It presents both positive and critical perspectives, supplemented by case studies on the latest collectivization trends in Europe’s national civil justice systems. The book also shares the experiences of some non-European jurisdictions that have developed promising hybrid forms of collective redress, such as Canada, Brazil, China, and South Africa. In closing, a selection of topical international cases that raise interesting issues regarding the effectiveness of class actions in an international context are studied and discussed.

Book Synopsis Codifying Contract Law by : Mary Keyes
Download or read book Codifying Contract Law written by Mary Keyes and published by Routledge. This book was released on 2016-05-23 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: Exploring the advantages and disadvantages of codifying contract law, this book considers the question from the perspectives of both civil and common law systems, referring in detail to issues of international and consumer law. With contributions from leading international scholars, the chapters present a range of opinions on the virtues of codification, encouraging further debate on this topic. The book commences with a discussion on the internationalization imperative for codification of contract law. It then turns to regional issues, exploring first codification attempts in the European Union and Japan, and then issues relevant to codification in the common law jurisdictions of Australia, New Zealand and the United States. The collection concludes with two chapters which consider the need to draw upon both private and comparative international law perspectives to inform any codification reforms. This book will be of interest to international and comparative contract law academics, as well as regulators and policy-makers.
