North’s theoretical work during the last twenty years on economic history as well as on new institutions economics and institutional change. While the paper is more concerned on how North approaches the origin and development of the state via property rights it also will take his theory of institutional change and the way he emphasizes economies of scale and transaction costs into account. Part One of this paper will give a short introduction into the topic of the philosophy of the state. This will be followed by North’s argumentation and thus his philosophy of the state derived in his numerous works. To begin with, Part Two of this paper gives an introduction into North’s argumentation on the role of property rights for economic growth. Part Three will then explain what role government has in economic organization. The role of economies of scale for property rights and fiscal policies will be looked upon thereafter in Part Four. The circle will then be closed by linking economic growth and property rights with the development of the state. Analogously to North’s argumentation in his book “The Rise of the Western World” the paper takes a section of ten millennia in economic history in order to explain the tension between property rights and the role of government as North sees it. North’s model of the state will then be introduced in Part Six, followed by a short introduction into his Theory of Institutional Change in Part Seven of this paper. A short critique will be given at the end.

According to the standard interpretation, echoed by as lofty an authority as Supreme Court Justice Harry Blackmun, the courts did little in the way of protecting property rights in the early years of our nation. Not only does Siegan find this accepted teaching erroneous, but he finds post-Colonial jurisprudence to be firmly rooted in English common law and the writings of its most revered interpreters. Siegan conducts an exhaustive examination of property rights cases decided by state courts between the time of the ratification of the U.S. Constitution in 1788 and the adoption of the Fourteenth Amendment in 1868. This inventory, which in its sweep captures scores of cases overlooked by previous commentators on the history of property rights, reveals that the protection of these rights is neither a relatively new phenomenon nor a heritage with precarious pedigree. These court cases, as well as early state constitutions, consistently and repeatedly embraced key elements of a property rights jurisprudence, such as protection of the privileges and immunities of citizens, due process of law, equal protection under the law, and prohibitions on the taking of property without just compensation. Case law provides overwhelming evidence that the American legal system, from its inception, has held property rights and their protection in the highest regard. The American Revolution, Siegan reminds us, was fought largely to affirm and protect private property rights-that is, to uphold the "rights of Englishmen"-even if it meant that the colonists would cease being Englishmen. John Locke and other great theoreticians of property rights understood their importance, not only to individuals who happened to possess property, but to the preservation of a free society and to the prosperity of its inhabitants. Siegan's contribution to this venerable tradition lies in his faithful reconstruction of our legal history, which allows us to see just how central property rights have been to the American experiment in liberty-from the very beginning.

They advocated the stock law, which required livestock owners to fence in their animals, arguing that the existing system (in which farmers built protective fences around crops) was outdated and inhibited economic growth. The reformers steadily won their battles, and by the end of the century the range was on the way to being closed. In this original study, Kantor uses economic analysis to show that, contrary to traditional historical interpretation, this conflict was centered on anticipated benefits from fencing livestock rather than on class, cultural, or ideological differences. Kantor proves that the stock law brought economic benefits; at the same time, he analyzes why the law's adoption was hindered in many areas where it would have increased wealth. This argument illuminates the dynamics of real-world institutional change, where transactions are often costly and where some inefficient institutions persist while others give way to economic growth.
