Taking Russia and Ukraine between 2000 and 2012 as its empirical focus, the book advances these arguments by drawing on more than 150 qualitative interviews with business owners, policy makers, and bureaucrats, as well as an original large-N survey of firms.

Book excerpt: What is property? It is neither what it may first appear nor what we are first told it might be. Let me explain. What property first appears to be is a means of allocating goods and resources. Typically, philosophers and other social and legal theorists begin by saying that property is a system whereby scarce resources -- usually everything that people can either see or imagine -- are allocated amongst individuals (individuals can be natural -- you and me; and legal -- corporations). It is often difficult to work out how a system of property achieves the initial allocation of a particular good or resource. For that reason, those who acquire a good or resource on that initial allocation are sometimes said to have won the lottery of enjoying the resource. Joseph William Singer calls this initial allocation of a resource a “magic moment” (Singer 172; drawing on Nozick 151-64), aptly capturing the mystical and mystifying way in which the law allows some to end up as “haves” while others, usually a large majority, end up as “have nots.”

For refugees living in camps, in some cases for as long as generations, the link between citizenship and property ownership becomes strained. How do refugees protect these assets and preserve communal ties? How do they maintain a sense of identity and belonging within chaotic settings? Protection Amid Chaos follows people as they develop binding claims on assets and resources in challenging political and economic spaces. Focusing on Palestinians living in refugee camps in Lebanon and Jordan, it shows how the first to arrive developed flexible though legitimate property rights claims based on legal knowledge retained from their homeland, subsequently adapted to the restrictions of refugee life. As camps increased in complexity, refugees merged their informal institutions with the formal rules of political outsiders, devising a broader, stronger system for protecting their assets and culture from predation and state incorporation. For this book, Nadya Hajj conducted interviews with two hundred refugees. She consults memoirs, legal documents, and findings in the United Nations Relief Works Agency archives. Her work reveals the strategies Palestinian refugees have used to navigate their precarious conditions while under continuous assault and situates their struggle within the larger context of communities living in transitional spaces.

Book excerpt: Successful governance implies that organizations, networks, or practices create public or club goods by constraining behavior, sharing information, or providing resources. While effective governance may require a functional state, compelling studies have theorized informal governance without Leviathan's backing in a vast number of domains, so much so that few exceptions exist in which the state is deemed an absolute sine qua non. One such exception is the security of private property rights. The consensus on the impossibility of informal property rights' protection partly derives from our ruler-centric concept of the state as a powerful sovereign, first vividly conceptualized in analytic narratives based on medieval Europe. The conventional diagnosis of top-down ruler-sanctioned predation generates the key prescription for sovereigns aiming to increase tax revenue and investment: institutional commitment constraining the upper executive. I offer an alternative perspective on PR security and informal governance. I conceptualize and empirically validate four ideal types of state threats to private property, and show that informal governance is a viable solution to a particularly pernicious - but understudied - threat type.

In Lawlessness and Economics, Avinash Dixit examines the theory of private institutions that transcend or supplement weak economic governance from the state. In much of the world and through much of history, private mechanisms--such as long-term relationships, arbitration, social networks to disseminate information and norms to impose sanctions, and for-profit enforcement services--have grown up in place of formal, state-governed institutions. Even in countries with strong legal systems, many of these mechanisms continue under the shadow of the law. Numerous case studies and empirical investigations have demonstrated the variety, importance, and merits, and drawbacks of such institutions. This book builds on these studies and constructs a toolkit of theoretical models to analyze them. The models shed new conceptual light on the different modes of governance, and deepen our understanding of the interaction of the alternative institutions with each other and with the government's law. For example, one model explains the limit on the size of social networks and illuminates problems in the transition to more formal legal systems as economies grow beyond this limit.
