Available in PDF, EPUB and Kindle. Book excerpt: Offering a comprehensive analysis of the human right to development and its realistic application in an era of economic globalization, Daniel Aguirre provides a multidisciplinary overview of economic globalization and examines its challenges to the realization of human development. He takes this further by engaging with these challenges and highlighting the human rights opportunities presented by economic globalization and the international investment system. The volume proposes a triadic system of responsibility for human rights in development, to include mapping the overlapping human rights responsibilities of corporations at the micro-level, of states at the macro-level and of the international community at the meso-level. The scope of the book is broad and the approach to the subject is new. It will generate interest across many disciplines including political science, international law and economics. Activists, academics and development practitioners in many fields should also read this book.

Available in PDF, EPUB and Kindle. Book excerpt: The terrorist attacks of 9/11 precipitated significant legal changes over the ensuing ten years, a "long decade" that saw both domestic and international legal systems evolve in reaction to the seemingly permanent threat of international terrorism. At the same time, globalization produced worldwide insecurity that weakened the nation-state's ability to monopolize violence and assure safety for its people. The Long Decade: How 9/11 Changed the Law contains contributions by international legal scholars who critically reflect on how the terrorist attacks of 9/11 precipitated these legal changes. This book examines how the uncertainties of the "long decade" made fear a political and legal force, challenged national constitutional orders, altered fundamental assumptions about the rule of law, and ultimately raised questions about how democracy and human rights can cope with competing security pressures, while considering the complex process of crafting anti-terrorism measures.

Book excerpt: The human rights project is one that brings together ideas, policies, and laws, as well as national civil society and international cooperation. Yet despite progress, human rights are still being grossly violated in vast numbers in many parts of the world, and the challenge remains to keep expanding the circles of achievements and opportunities for a universal culture of human rights. This handbook brings together a broad collection of documents from different parts of the world, from global and regional institutions, attesting to the fact that the universality of human rights resides in the spirit and aspirations of the peoples of the world. Divided into thematic sections, the volume brings together primary sources on topics such as philosophical and religious perspectives, international human rights policy, sustainable development, economic, social, and cultural rights, among many more, complete with a thorough introduction to each theme. The result is a remarkable collection of documents and teaching materials in support of the universality of human rights.

Book excerpt: Georges Enderle proposes a radically new understanding of corporate responsibility in the global and pluralistic context. This book introduces a framework that integrates the ideas of wealth creation and human rights, which is illustrated by multiple corporate examples, and provides a sharp critique of the maximizing shareholder value ideology. By defining the purpose of business enterprises as creating wealth in a comprehensive sense, encompassing natural, economic, human and social capital while respecting human rights, Enderle draws attention to the fundamental importance of public wealth, without which private wealth cannot be created. This framework further identifies the limitations of the market institution and self-regarding motivations by demonstrating that the creation of public wealth requires collective actors and other-regarding motivations. In line with the UN's Guiding Principles on Business and Human Rights, this book provides clear ethical guidance for businesses around the world and a strong voice against human right violations, especially in repressive and authoritarian regimes and populist and discriminatory environments.

Available in PDF, EPUB and Kindle. Book excerpt: The rise of economic liberalism in the latter stages of the 20th century coincided with a fundamental transformation of international economic governance, especially through the law of the World Trade Organization. In this book, Andrew Lang provides a new account of this transformation, and considers its enduring implications for international law. Against the commonly-held idea that 'neoliberal' policy prescriptions were encoded into WTO law, Lang argues that the last decades of the 20th century saw a reinvention of the international trade regime, and a reconstitution of its internal structures of knowledge. In addition, the book explores the way that resistance to economic liberalism was expressed and articulated over the same period in other areas of international law, most prominently international human rights law. It considers the promise and limitations of this form of 'inter-regime' contestation, arguing that measures to ensure greater collaboration and cooperation between regimes may fail in their objectives if they are not accompanied by a simultaneous destabilization of each regime's structures of knowledge and characteristic features. With that in mind, the book contributes to a full and productive contestation of the nature and purpose of global economic governance.
