Book excerpt: It is important for society that the backlash does not result in the reburial of the problem of child sexual abuse. ‘True and False Allegations of Child Sexual Abuse’ represents an important contribution to that effort. This book is about conducting evaluations of allegations of child sexual abuse that take into account research knowledge and practice wisdom. It is not a cookbook about how to do evaluations. Rather, it provides a great deal of food for thought and is aimed at child abuse professionals who can critically read and test the material against their experiences in the field. It includes a wide spectrum of information, approaches, and opinions about child sexual abuse evaluation.

Book excerpt: This seminal book in the literature of child protective services stimulates critical thinking and informed discussion for those professionals and educators concerned with the quality of children’s protective services. The first book of its kind to present scholarly reports on false allegations, Assessing Child Maltreatment Reports tackles the age-old problem of deciding which reports, verbal or written, represent truth and which represent falsehood. When one deals with accusations in the area of child maltreatment, special problems are posed. This vital resource brings home the complexity and seriousness of confronting the need to separate true reports from false reports. Given the serious consequences of reports of maltreatment, determining the accuracy or inaccuracy of such reports is of major critical importance to all concerned and the parents, children, and professionals directly involved. This book deals effectively and practically with the everyday work of assessing the validity and reliability of maltreatment reports and guides professionals through rough waters of finding truth with helpful research. This courageous book provides hope for establishing a deeper understanding of the broad system of child protection and consequently, enables professionals to better handle individual crises and cases. Containing a range of chapters--authored by leading academic researchers and practitioners in child welfare services in the United States--which examine the policy and practice issues related to false allegations of child abuse and neglect, this volume provides guideposts for further research and discussion. College and university students in child welfare and related programs, human service practitioners working in child protective and welfare services, and the larger public--both parents and professionals working with children--who have an interest in this important issue, will find Assessing Child Maltreatment Reports a compassionate approach to a sensitive issue.

Book excerpt: Noting the increase in false accusations of child sexual abuse where divorce and custody litigation is in progress, this book examines the consequences of such accusations for everyone involved and provides defensive strategies for those falsely accused. The book draws on four case studies, including a personal one, to illustrate the chronology and effects of false allegations brought by the mother against the father, noting commonalities among the cases, and personality traits of the accuser and of the accused. The effects of false allegations and subsequent proceedings on the child are also detailed. The book then explores this phenomenon as "Sexual Allegations in Divorce" or SAID Syndrome, and identifies "red flags" during proceedings that suggest this syndrome may be occurring. The book also examines how social service agencies and courts appear to work in concert to substantiate false allegations rather than investigating to determine the truth, and how therapeutic interventions, when no abuse occurred, can affect children. The dubious use of anatomically correct dolls as evidence of sexual abuse in such cases is also examined. Finally, the book summarizes the legal and social service problems inherent to such cases, offering solutions, and then presents legal and emotional strategies for fighting false allegations. Three appendices include a questionnaire for identifying SAID syndrome, guidelines for determining presence of abuse, and a court monitor checklist. A list of support organizations is included, along with state listings of the Vocal National Network and a 29-item bibliography. (HTH)

Available in PDF, EPUB and Kindle. Book excerpt: "This cogently-argued book is a timely contribution to the general literature on child sexual abuse." -- British Journal of Social Work "[The authors] have gathered information on 206 cases and focus on five representative examples that illustrate what they see as an increasing anti-mother bias in the courts. These five cases of the failure to safeguard children are... effective... Whatever may have happened in the past, the authors make a well-researched, convincing... case that the pendulum has now swung the other way. Now many lawyers, child advocates, psychologists and judges accept a 'crazy mother' or 'vindictive ex-' syndrome, thus allowing real perpetrators to continue abuse with no supervision.... In these cases, judges acquiesce to a paternalistic myth of the American family and in so doing, ignore the reality of American children." -- Publishers Weekly (starred review) "A needed assessment of a terrible problem." -- Booklist "... provocative... " -- Library Journal "Recommended." -- Choice "Without anger, or hysteria, Rosen and Etlin document the interlocking, complex ways in which our antiquated system fails incested children and those who struggle to protect them. Just as important, they propose an innovative solution. This is 'must' reading for anyone interested in the problem of child sexual abuse." -- Elizabeth Morgan, M.D., Ph.D. It is comfortable to believe that incest and child sexual abuse need not concern us because we have institutions set up to deal with these problems. This book disallows that comfort and shows that the system has failed, and worse -- that it has generated a dangerous atmosphere of denial and cover-up. While Rosen and Etlin expose a system whose breakdown is shocking and fundamental, at the same time they present a proposal for relief for the children who are now trapped -- like hostages -- in this social war.

Book excerpt: When domestic abuse and children are involved, divorce and custody can be the epitome of high-stakes conflict and frustration and all too frequently protective parents lose custody of their child to a named abuser. Domestic Abuse, Child Custody, and Visitation helps mental health professionals, attorneys, and lay readers navigate the judicial process so that decisions are truly made in the best interest of children. The text reveals how all the puzzle pieces of the judicial process fit together -- judges, attorneys, mental health experts, children, spouses -- and how to overcome many of the obstacles they will confront along the way. This runs the gamut, from the selection of a lawyer and experts, to setting necessary groundwork for an appeal. Domestic Abuse, Child Custody, and Visitation is an essential read for mental health professionals and lay people involved in divorce and custody, family court judges, family law attorneys, and mental health professionals involved in domestic abuse and custody matters.

Book excerpt: Child Custody Litigation: Allegations of Child Sexual Abuse is an invaluable resource for forensic mental health professionals involved with conducting custody evaluations in family court proceedings. Each of the book's five chapters reviews an important component of the evaluation process when allegations of child sexual abuse have been made, moving beyond the description of each parent's psychological functioning and parenting capacity, the identity and needs of the child, and the parent's ability to meet those needs. The book's contributors examine the organizational structure of a child custody evaluation, the meanings of sexual behaviors demonstrated by children, descriptions of sex offenders assessment instruments, the usefulness of Rorschach examinations, and observations from presiding judges.

Book excerpt: What are the social and cultural features that have the most impact on the interpretation of the legal standard, “best interest of the child”? One method for answering this question is through a comparison of two societies, Sweden and the United States, both of which apply the same legal standard to similar contested custody and visitation cases. This study views love, law, and knowledge as separate discourses. Love encompasses the interpretations of the actors whose claims arise from the emotions associated with care, concern, and relationships, namely parents, the children who are the subject of a case, and other family members. Justice encompasses the interpretations and claims which are made by judges, but its discourse includes the legal process and legal policies. Knowledge is encompassed by the concerns and claims of professionals and/or experts including social science discussions of care, welfare, and psychology and the interpretations and descriptions given by the professionals and experts regarding the actors in the cases. This book hypothesizes that a comparison of two societies that focuses on the interaction between the discourses of love, justice, and knowledge, in the process of decision-making in best interests of the child disputed custody cases, reveals features of decision-making that would be unavailable to researchers studying custody disputes in only one society.

Book excerpt: With the rise in divorce and child custody battles, child abuse charges have become a weapon of choice, often times false, and it is these accusations that are tearing apart lives, affecting all involved. The Child Welfare system supposedly designed to help children is actually helping children to destroy their lives. This book affords those falsely accused and their defence attorneys, who often find themselves in a 3-ring circus...juvenile, family and/or criminal courts, a vehicle for countering and defeating abuse allegations. The book is a life jacket for the falsely accused parent and inexperienced attorney. Dean Tong is an internationally known forensic consultant on related child abuse, domestic violence and child custody cases.
