Available in PDF, EPUB and Kindle. Book excerpt: Youths are on trial today in two ways. In the first sense, whereas youths once faced delinquency hearings in juvenile courts, now with increasing frequency they stand trial in criminal courts. In the second sense, recent reforms in juvenile justice have placed the notion of youth itself on trial. Society's trend toward responding to adolescent offenders as adults asks that we set aside traditional presumptions about adolescence as a condition of immaturity that warrants mitigation. The ensuing debate highlights the need for evidence to address whether youths' capacities are sufficiently different from adults to warrant different legal responses to their transgressions.

Book excerpt: In this original, far-reaching, and timely book, Justice Stephen Breyer examines the work of the Supreme Court of the United States in an increasingly interconnected world, a world in which all sorts of activity, both public and private—from the conduct of national security policy to the conduct of international trade—obliges the Court to understand and consider circumstances beyond America’s borders. Written with unique authority and perspective, The Court and the World reveals an emergent reality few Americans observe directly but one that affects the life of every one of us. Here is an invaluable understanding for lawyers and non-lawyers alike.

Available in PDF, EPUB and Kindle. Book excerpt: At a time of unprecedented national power, why do so many Americans believe that our nationhood is fragile and precarious? Why the talk--among politicians, academics, and jurists--of "coups d'etat," of culture wars, of confederation, of constitutional breakdown? In this wide-ranging book, Robert Nagel proposes a surprising znswer: that anxiety about national unity is caused by centralization itself. Moreover, he proposes that this anxiety has dangerous cultural consequences that are, in an implosive cycle, pushing the country toward ever greater centralization. Carefully examining recent landmark Supreme Court cases that protect states' rights, Nagel argues that the federal judiciary is not leading and is not likely to lead a revival of the complex system called federalism. A robust version of federalism requires appreciation for political conflict and respect for disagreement about constitutional meaning, both values that are deeply antithetical to the Court's function. That so many believe this most centralized of our Nation's institutions is protecting, even overprotecting, state power is itself a sign of the depletion of those understandings necessary to sustain the federal system. Instead of a support for federalism, Nagel finds a commitment to radical nationalism throughout the constitutional law establishment. He traces this commitment to traditionally American traits like perfectionism, optimism, individualism, and legalism. Under modern conditions of centralization, these attractive traits are leading to unattractive social consequences, including tolerance, fearfulness, utopianism, and deceptiveness. They are degrading our political discourse. All this encourages further centralization and further cultural deterioration. This book puts the major federalism decisions within the framework of the Court's overall record, including its record on individual rights in areas like abortion, homosexuality, and school desegregation. And, giving special attention to public debate over privacy and impeachment, it places modern constitutional law in the context of political discourse more generally.

Book excerpt: In this volume, top experts in the field of delinquency discuss the implications of the findings of the Pittsburgh Youth Study for current conceptualizations of antisocial behavior. Violence and Serious Theft is unique in that it combines the strengths of three disciplines to explain delinquency in young people: developmental psychopathology, criminology, and public health. The book addresses questions in two main areas: serious offending as an outcome over time and developmental aspects of serious offending; and factors which explain why some young males become violent and/or commit serious crime while others do not. Violence and Serious Theft is a resource for researchers, practitioners and students in developmental, school and counseling psychology; psychopathology, psychiatry, public health and criminology.

Book excerpt: As constitutional scholar John Nowak noted when the book was first released, "Professor Choper's Judicial Review and the National Political Process is mandatory reading for anyone seriously attempting to study our constitutional system of government. It is an important assessment of the democratic process and the theoretical and practical role of the Supreme Court." That view is no less true today, as borne out by the countless citations to this landmark work over the decades, including scores in the last few years alone. It is simply part of the foundational canon of constitutional law and political theory, an essential part of the library of scholars, students, and educated readers interested in considering the hard choices inherent in what the courts should decide and how they should decide them.

Available in PDF, EPUB and Kindle. Book excerpt: In the twenty-first-century world of juvenile justice policy and practice, nearly everyone agrees that one of the most pressing issues facing the nation's juvenile courts is their proper response to delinquent youths with mental disorders. Recent research indicates that about two-thirds of adolescent offenders in juvenile justice facilities meet the criteria for one or more mental disorders. What are the obligations of our juvenile justice system, then, as the caretaker for delinquent youth with such disabilities? How do issues of adolescent development create special challenges in determining the court's proper response to delinquents with special mental health needs? Thomas Grisso considers these questions while offering new information to assist the juvenile justice system in its responses to the needs of our children. Double Jeopardy considers the newest data on the nature of youths' mental disorders—their relationships to delinquency, the values and limits of methods to treat them, and the common patterns of adolescent offending. That information is used to chart a rational course for fulfilling the juvenile justice system's duty—as a custodian of children in need of health care, as a legal system promoting fairness in youth adjudication, and as a protector of public safety—to respond to delinquent youths' mental disorders. Moreover, Double Jeopardy provides a scientific yet practical foundation for lawmakers, judges, attorneys, and mental health care professionals, as well as researchers who must fill the knowledge gaps that limit the juvenile justice system's abilities to meet youths' mental health needs.

Book excerpt: Until very recently, no society had seen marriage as anything other than a conjugal partnership: a male–female union. What Is Marriage? identifies and defends the reasons for this historic consensus and shows why redefining civil marriage as something other than the conjugal union of husband and wife is a mistake. Originally published in the Harvard Journal of Law and Public Policy, this book’s core argument quickly became the year’s most widely read essay on the most prominent scholarly network in the social sciences. Since then, it has been cited and debated by scholars and activists throughout the world as the most formidable defense of the tradition ever written. Now revamped, expanded, and vastly enhanced, What Is Marriage? stands poised to meet its moment as few books of this generation have. Sherif Girgis, Ryan T. Anderson, and Robert P. George offer a devastating critique of the idea that equality requires redefining marriage. They show why both sides must first answer the question of what marriage really is. They defend the principle that marriage, as a comprehensive union of mind and body ordered to family life, unites a man and a woman as husband and wife, and they document the social value of applying this principle in law. Most compellingly, they show that those who embrace same-sex civil marriage leave no firm ground—none—for not recognizing every relationship describable in polite English, including polyamorous sexual unions, and that enshrining their view would further erode the norms of marriage, and hence the common good. Finally, What Is Marriage? decisively answers common objections: that the historic view is rooted in bigotry, like laws forbidding interracial marriage; that it is callous to people’s needs; that it can’t show the harm of recognizing same-sex couplings or the point of recognizing infertile ones; and that it treats a mere “social construct” as if it were natural or an unreasoned religious view as if it were rational.

Linda Spear provides a detailed and illuminating overview of the genetic, hormonal, and neurological developments that take place during adolescence, and shows how these changes, along with influential sociocultural factors, interact to produce distinctly adolescent behaviors and thought processes. The tension between taking risks, impulsivity, and self-control—a struggle evinced by many adolescents, especially those in therapeutic treatment—is also examined for its sources within the brain. The result is a fascinating overview of the adolescent brain, with profound implications for the clinical treatment of adolescents.
