Available in PDF, EPUB and Kindle. Book excerpt: Political Representation in India: Ideas and Contestations, 1908–1952 maps extensive and wide-ranging debates, marked by contestations and strident demands on political representation in colonial India. Further, it explores these themes during the Constitution-framing process. These debates, previously overlooked, are significant for they helped shape the institutional structures of political representation in the form of the electoral system of Indian democracy. It assists in providing an answer to why and how independent India came to adopt its current electoral system characterised by the First-Past-The-Post (FPTP) system. It also analyses how and why the alternatives to FPTP, primarily any form of proportional representation, were rejected. Moreover, the book simultaneously provides a rich and detailed description of how communities, and religious, caste and ethnic categories came to be defined as their demands for political representation were conceded. It also briefly deals with the issue of delimitation of constituencies during the colonial and the immediate post-independence period.

Available in PDF, EPUB and Kindle. Book excerpt: Specters of Mother India tells the complex story of one episode that became the tipping point for an important historical transformation. The event at the center of the book is the massive international controversy that followed the 1927 publication of Mother India, an exposé written by the American journalist Katherine Mayo. Mother India provided graphic details of a variety of social ills in India, especially those related to the status of women and to the particular plight of the country’s child wives. According to Mayo, the roots of the social problems she chronicled lay in an irredeemable Hindu culture that rendered India unfit for political self-government. Mother India was reprinted many times in the United States, Great Britain, and India; it was translated into more than a dozen languages; and it was reviewed in virtually every major publication on five continents. Sinha provides a rich historical narrative of the controversy surrounding Mother India, from the book’s publication through the passage in India of the Child Marriage Restraint Act in the closing months of 1929. She traces the unexpected trajectory of the controversy as critics acknowledged many of the book’s facts only to overturn its central premise. Where Mayo located blame for India’s social backwardness within the beliefs and practices of Hinduism, the critics laid it at the feet of the colonial state, which they charged with impeding necessary social reforms. As Sinha shows, the controversy became a catalyst for some far-reaching changes, including a reconfiguration of the relationship between the political and social spheres in colonial India and the coalescence of a collective identity for women.

Available in PDF, EPUB and Kindle. Book excerpt: ‘A great man in Indian politics’ —Dr Ram Manohar Lohia on Dr Ambedkar Dr Ambedkar’s role in the cause of social emancipation has been researched and written about extensively. His part in the drafting of the Indian Constitution between 1946 and 1950 has also received considerable attention. In The Foresighted Ambedkar, Anurag Bhaskar argues that India’s Constitution was drafted not just between 1946 and 1950 but over the course of four decades. Dr Ambedkar was the only person to have been involved at all the stages related to the drafting of the Indian constitutional document since 1919. These stages bear the imprint of his contribution and role. This book seeks to focus on Dr Ambedkar’s influence on the Indian constitutional discourse from 1919, when he entered public life, until the actual writing of the Constitution and even beyond. Covering the different constitutional moments as and when they happened, it highlights Dr Ambedkar’s role in those moments. A seminal work of intellectual and constitutional history, this volume demonstrates why Dr Ambedkar is rightly called the ‘Father of the Indian Constitution’.

Book excerpt: The Sewel Convention seeks to ensure that the UK Parliament legislates on devolved matters only with the express agreement of the Scottish Parliament, and consent is also required for legislation on reserved matters if it alters the powers of the Scottish Parliament or Scottish Ministers. Following on from a report by the Scottish Parliament Procedures Committee on the operation of the Convention (SP paper 428, 7th report, session 2 (2005) (ISBN 1406113220) published in October 2005), the Committee's report focuses on ways of improving the communications procedure between the Scottish and Westminster Parliaments, and how MPs could be better alerted that a particular Bill before Parliament had been subject to a Sewel motion in the Scottish Parliament. Recommendations made include: the introduction of a formal process whereby the Scottish Parliament notifies Westminster when a Sewel motion has been passed and the 'tagging' of all relevant public Bills; and the need for an explicit statement on explanatory notes to Bills as to which parts of the UK the provisions will affect. The report also recommends the further consideration of the need to establish a 'Super' Scottish Grand Committee, composed of Scottish MPs, MSPs and Scottish MEPs, to discuss matters of mutual interest.

Available in PDF, EPUB and Kindle. Book excerpt: A leading expert on Indian judiciary, George Gadbois offers a compelling biography of the Supreme Court of India, a powerful institution. Written and researched when he was a graduate student in the 1960s, this book provides the first comprehensive account of the Court’s foundation and early years. Gadbois opens with Hari Singh Gour’s proposal in 1921 to establish an indigenous ultimate court of appeal. After analyzing events preceding the Federal Court’s creation under the Government of India Act, 1935, Gadbois explores the Court’s largely overlooked role and record. He goes on to discuss the Constituent Assembly’s debates about Indian judiciary and the Supreme Court’s powers and jurisdiction under the Constitution. He pays particular attention to the history and practice of judicial appointments in India. In the book’s later chapters, Gadbois assesses the functioning of the Supreme Court during its first decade and a half. He critically analyzes its first decisions on free speech, equality and reservations, preventive detention, and the right to property. The book is an institutional tour de force beginning with the Federal Court’s establishment in December 1937, through the Supreme Court’s inauguration in January 1950, and until the death of Jawaharlal Nehru in May 1964.

This book provides a unique insight into the work and daily life of Parliament. It sets out plainly and intelligibly what goes on and why things happen, but it also analyses the pressures within the institution, its strengths and weaknesses, and ways in which it might change. Covering every aspect of the work, membership, and structures of both Houses, this book also reflects the profound changes that have taken place in Parliament over the years.
