Book excerpt: Port state control (PSC) involves the inspection of foreign ships in national port areas to verify that the condition and operation of a ship and its equipment comply with the requirements of international regulations. While IMO has always acknowledged that enforcement of global maritime standards is the responsibility of flag states, the organisation nevertheless recognises that exercising the right to carry out Psc makes an important contribution to ensuring those standards are implemented consistently on ships of different nationalities. The sub-committee on flag state implementation has developed and maintained a framework to promote the global harmonisation and co-ordination of Psc activities resulting in the adoption of resolution A.1052(27) by the assembly of November 2011. This resolution contains the Procedures for port state control, 2011, and revokes resolutions A.787(19) and A.882(21).

Book excerpt: International Maritime Security Law by James Kraska and Raul Pedrozo defines an emerging interdisciplinary field of law and policy comprised of norms, legal regimes, and rules to address today's hybrid threats to the global order of the oceans. Worldwide shipping commerce, fishing fleets, pleasure craft, and coastal states are exposed to the menace of offshore terrorism, weapons of mass destruction, piracy, smuggling, robbery, marine insurgency and anti-access threats. Land-based institutions and maritime constabulary forces operate within an increasingly integrated network that blends elements of humanitarian law, human rights law, criminal law, and law of the sea, with inspection regimes, commercial enterprise, and marine safety and environmental stewardship. The new authorities fuse together a global maritime partnership among states, international organizations and commercial interests to protect the maritime commons from the most dangerous risks and hazards.

Book excerpt: Those who work on fishing vessels often face extraordinary and unpredictable hazards, frequently working long hours in harsh conditions. The Work in Fishing Convention, 2007 (No.188), aims to ensure that these seafarers have decent conditions of work on board, including occupational safety and health protection, and medical care and social security. The Convention also provides that living and working conditions on fishing vessels may be inspected while such vessels are in foreign ports. Guidelines for port State control officers carrying out inspections under the Work in Fishing Convention, 2007 (No.188) is an important international resource for the implementation of these port State responsibilities and for the harmonization of inspections of foreign fishing vessels. These guidelines include an overview of the features and key concepts of Convention No.188, outline the port State control responsibilities under this Convention and the guidance in its accompanying Recommendation No.199, and specify the professional profile and qualifications required of port State control officers. They examine all aspects of conducting port State inspections and address basic requirements, indicative sources of information and examples of non-conformities for specific inspection areas. The guidelines also cover the actions that may be taken by port State control officers when finding non-conformities with respect to the Convention.

Book excerpt: A sharp, informed and thoroughly practical guide to contemporary and developing issues relating to sea pollution, prepared by leading academics and practitioners with everyday hands-on experience. Pollution at Sea focuses on a number of the vital private law issues – compensation, insurance, contract and tort – thrown up by contemporary developments in the law of pollution. The book also intends to offer a critical analysis on emerging public law concepts, such as the legal position of seafarers from the perspective of criminal law in cases of pollution and the impact of port state control as a pollution control mechanism. Pollution at Sea is divided into three parts: 1. Private Law Liability Regimes 2. Rights and Liabilities of Particular Parties 3. The Impact of Public Law on the Actors Concerned In part 1; various liability regimes are dissected, including those which have been under the spotlight in recent years. This section has particular international appeal, and many of the regimes discussed are based at least in part on international conventions, agreements or practices. In part 2; the impact of pollution at sea on third parties is considered, with respect to the legal position of parties that might be perused either by the victims of pollution incidents or in some cases by the parties liable by way of a recourse action. Finally in part 3; recent relevant developments, particularly in the realm of public law are covered.

Although the CAS does not specify structural standards in excess of the provisions of other IMO conventions, codes and recommendations, its requirements stipulate more stringent and transparent verification of the reported structural condition of the ship and that documentary and survey procedures have been properly carried out and completed. The Scheme requires that compliance with the CAS is assessed during the Enhanced Survey Program of Inspections concurrent with intermediate or renewal surveys currently required by resolution A.744(18), as amended.--Publisher's description.

Available in PDF, EPUB and Kindle. Book excerpt: The first modern title to cover the varied and complex world of ship management in the 21st century. Ship management has constantly had to evolve to take into account the advancements in technology as well as the demands of the shipping industry. Having internet access and email on board ship has meant that the ship manager has to possess certain sets of skills to function effectively in the post, including computer literacy. The emergence of large multi-national ship management companies has also changed how business is conducted, and this in turn means that the ship manager and tiers of management within the organization have had to evolve to cope with the demands of working with a multi-national workforce. Furthermore, since the mid-1980s there has been an ever expanding raft of legislation that is more restrictive for companies to meet, and a shrinking of profit margins has seen a shift in how companies are required to operate to survive. This book addresses the demands of 21st century ship management with the focus of the book as much on the people who manage ships as on the theory and practice of ship management.

This book was released on 2011-06-16 with total page 217 pages. Available in PDF, EPUB and Kindle. Book excerpt: Advances in medical, biomedical and health services research have reduced the level of uncertainty in clinical practice. Clinical practice guidelines (CPGs) complement this progress by establishing standards of care backed by strong scientific evidence. CPGs are statements that include recommendations intended to optimize patient care. These statements are informed by a systematic review of evidence and an assessment of the benefits and costs of alternative care options. Clinical Practice Guidelines We Can Trust examines the current state of clinical practice guidelines and how they can be improved to enhance healthcare quality and patient outcomes. Clinical practice guidelines now are ubiquitous in our healthcare system. The Guidelines International Network (GIN) database currently lists more than 3,700 guidelines from 39 countries. Developing guidelines presents a number of challenges including lack of transparent methodological practices, difficulty reconciling conflicting guidelines, and conflicts of interest. Clinical Practice Guidelines We Can Trust explores questions surrounding the quality of CPG development processes and the establishment of standards. It proposes eight standards for developing trustworthy clinical practice guidelines emphasizing transparency; management of conflict of interest ; systematic review-guideline development intersection; establishing evidence foundations for and rating strength of guideline recommendations; articulation of recommendations; external review; and updating. Clinical Practice Guidelines We Can Trust shows how clinical practice guidelines can enhance clinician and patient decision-making by translating complex scientific research findings into recommendations for clinical practice that are relevant to the individual patient encounter, instead of implementing a one size fits all approach to patient care. This book contains information directly related to the work of the Agency for Healthcare Research and Quality (AHRQ), as well as various Congressional staff and policymakers. It is a vital resource for medical specialty societies, disease advocacy groups, health professionals, private and international organizations that develop or use clinical practice guidelines, consumers, clinicians, and payers.
