Book excerpt: This book examines how the functioning of the International Criminal Court has become a forum of convergence between the common law and civil law criminal justice systems. Four countries were selected as primary examples of these two legal traditions: the United States, England and Wales, Germany and Poland. The first layer of analysis focuses on selected elements of the model of accusation that are crucial to the model adopted by the ICC. These are: development of the notion of the prosecutor’s independence in view of their ties to the countries and the Security Council; the nature and limits of the prosecutor’s discretional powers to initiate proceedings before the ICC; the reasons behind the prosecutor’s choice of both defendants and charges; the role the prosecutor plays in the procedure of disclosure of evidence and consensual termination of proceedings; and the determinants of the model of accusation used during trial and appeal proceedings. The second layer of the book consists in an analysis of the motives behind applying particular solutions to create the model of accusation before the ICC. It also shows how the model of accusation gradually evolved in proceedings before the military and ad hoc tribunals: ICTY and ICTR. Moreover, the question of compatibility of procedural institutions is addressed: In what ways does adopting a certain element of criminal procedure, e.g. discretional powers of the prosecutor to initiate criminal proceedings, influence the remaining procedural elements, e.g. the existence of the dossier of a case or the powers of a judge to change the legal classification of the criminal behavior appearing in the indictment?

Available in PDF, EPUB and Kindle. Book excerpt: The book provides a global perspective of local government response towards the COVID-19 pandemic through the analysis of a sample of countries in all continents. It examines the responses of local government, as well as the responses local government developed in articulation with other tiers of government and with civil society organizations, and explores the social, economic and policy impacts of the pandemic. The book offers an innovative contribution on the role of local government during the pandemic and discusses lessons for the future. The COVID-19 pandemic had a global impact on public health, in the well-being of citizens, in the economy, on civic life, in the provision of public services, and in the governance of cities and other human settlements, although in an uneven form across countries, cities and local communities. Cities and local governments have been acting decisively to apply the policy measures defined at national level to the specific local conditions. COVID-19 has exposed the inadequacy of the crisis response infrastructures and policies at both national and local levels in these countries as well as in many others across the world. But it also exposed much broader and deeper weaknesses that result from how societies are organized, namely the insecure life a substantial proportion of citizens have, as a result of economic and social policies followed in previous decades, which accentuated the impacts of the lockdown measures on employment, income, housing, among a myriad of other social dimensions. Besides the analysis of how governments, and local government, responded to the public health issues raised by the spread of the virus, the book deals also with the diversity of responses local governments have adopted and implemented in the countries, regions, cities and metropolitan areas. The analysis of these policy responses indicates that previously unthinkable policies can surprisingly be implemented at both national and local levels.

Available in PDF, EPUB and Kindle. Book excerpt: Nation Branding, Public Relations and Soft Power: Corporatizing Poland provides an empirically grounded analysis of changes in the way in which various actors seek to manage Poland’s national image in world opinion. It explores how and why changes in political economy have shaped these actors and their use of soft power in a way that is influenced by public relations, corporate communication, and marketing practices. By examining the discourse and practices of professional nation branders who have re-shaped the relationship between collective identities and national image management, it plots changes in the way in which Poland’s national image is communicated, and culturally reshaped, creating tensions between national identity and democracy. The book demonstrates that nation branding is a consequence of the corporatization of political governance, soft power and national identity, while revealing how the Poland "brand" is shaping public and foreign affairs. Challenging and original, this book will be of interest to scholars in public relations, corporate communications, political marketing and international relations.

Book excerpt: Civil Society: Ideas, Interpretations, Transgressions is essential to learning about the place and importance of civil society in creating and maintaining a liberal democracy. Edyta B. Pietrzak takes us on a journey of interpretation, addressing the critical role the idea of a civil society has for our world and how it has evolved over time. She uncovers the meanings of theories and clarifies ways of thinking that are sensitive to peculiarities, intermittences, contrasts, or unique things. Part I introduces the theory and key terms. What is the public sphere and how can it be understood? Is it synonymous with civil society or does it only establish its area of activity? It aims to illustrate how social life has changed over centuries and its basic components have been experienced and interpreted in various ways. Part II represents a collection of interpretations and approaches to the idea of civil society. Pietrzak begins with the traditional Republican interpretation, continues with liberal, Hegelian, sociological, and historical‐materialistic interpretations, and concludes with modern communitarian and neo‐liberal concepts. Part III reminds us that civil society is not an abstract concept, nor does it exist in a vacuum or out of context. When describing the process of change and transformation in civil society, reference must be made to transgressions. Here we learn about issues such as transnational civil society, citizenship and diversity, feminist citizenship, and civil society in the era of the Anthropocene, to name a few.
