Book excerpt: Excerpt from Powers of the American People, Congress, President and Courts, According to Evolution of Constitutional Construction No argument would seem to be necessary to prove the importance of instructing the students of government in the theory and practical character of the powers of the People, Congress, the President, and the Courts of the Uni-ted States. The impression has largely obtained among students of government and others in the Old World that because of its newness the American system could present little of interest or value to 'the investigator; it Has been believed also by many that the American system was inimical to Old World systems. The fact that hitherto no convenient manual of instruction was to be had may have been largely responsible for such misconceptions, and if this work shall be the means of removing such impressions it will have accomplished its purpose. Book excerpt: Excerpt from Powers of the American People: Congress, President, and Courts, (According to the Evolution of Constitutional Construction) But whoever the investigator may be, he should not fail to observe the fact that the ceaseless progression of mankind has ever been welding the human family into a unit. In that prog ress, all governments - be they aristocratic, monarchical, or re publican - are undergoing a process of evolution. Whether or not the progression seems to result in undue advantages by one nation as against another, it tends to the ultimate good of the human family. Whether the nations like it or dislike it, Whether they approve it or disapprove it, they are steadily approaching international amalgamation through a higher humanity and a newer civilization. The American people are inseparable and integral parts of this larger movement toward a common human destiny. Nor is there anything utopian, puerile, or idealistic in the theory of such a movement. Book Synopsis Courts and Congress by : William Quirk
Download or read book Courts and Congress written by William Quirk and published by Routledge. This book was released on 2018-02-06 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: It's often said, confirmed by survey data, that the American people are losing confidence in their government. But the problem may be the reverse--the government has lost confidence in the people. Increasingly the power to make decisions in our democracy has been shifted from Congress to the court system, forcing non-elected officials to make decisions which affect the lives of Americans. In a society which is based on the democratic elections of its officials, this is clearly backwards. Quirk maintains that what he calls "The Happy Convention," an informal and unwritten rearrangement of "passing the buck" of government powers, is done to avoid blame and approval ratings becoming lower for a particular person or party. For example, The Happy Convention assigns the power to declare and make war to the President. Congress and the Court play a supporting role--Congress, when requested, gives the President a blank check to use force--the Court throws out any challenges to the legality of the war. Everyone wins if the war avoids disaster. If it turns out badly, the President is held accountable. His ratings fall, reelection is out of the question, congressmen say he lied to them; his Party is likely to lose the next election. In this way, Quirk reminds us that The Happy Convention is not what the Founders intended for us. For democracy to work properly, the American people have to know what options they have. Courts and Congress argues the case for reestablishing the balance of powers between the courts, the Congress, and the Presidency.
Book Synopsis Zones of Twilight by : Amanda DiPaolo
Download or read book Zones of Twilight written by Amanda DiPaolo and published by Lexington Books. This book was released on 2009-12-22 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Bill of Rights was designed to protect the American public from encroachments of liberty by the federal government. During times of war, the president often spearheads efforts to limit rights in the name of national security. When these cases make their way through the federal courts system, it is expected that the judiciary would use rights-based language in their adjudication of cases dealing with such rights-based claims. Zones of Twilight shows that the courts actually use the separation of powers to decide these cases. In other words, the courts look to see if Congress has authorized the president to limit the liberties in question. More often than not, if Congress is on board, so are the federal courts. Although the common conception is that the courts give the president a blank check during war, it is in fact Congress that has received that blank check. Zones of Twilight looks at four reoccurring issues during times of war where the courts have had to decide cases where the executive has limited individual freedoms: military detentions, warrantless electronic surveillance, emergency economic powers, and free speech.

Book Synopsis The Politics of Shared Power by : Louis Fisher
Download or read book The Politics of Shared Power written by Louis Fisher and published by Texas A&M University Press. This book was released on 1998 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: As Congress and the president battle out the federal deficit, foreign involvements, health care, and other policies of grave national import, the underlying constitutional issue is always the separation of powers doctrine. In The Politics of Shared Power, a classic text in the field of executive-legislative relations, Louis Fisher explains clearly and perceptively the points at which congressional and presidential interests converge and diverge, the institutional patterns that persist from one administration and one Congress to another, and the partisan dimensions resulting from the two-party system. Fisher also discusses the role of the courts in reviewing cases brought to them by members of Congress, the president, agency heads, and political activists, illustrating how court decisions affect the allocation of federal funds and the development and implementation of public policy. He examines how the president participates as legislator and how Congress intervenes in administrative matters. Separate chapters on the bureaucracy, the independent regulatory commissions, and the budgetary process probe these questions from different angles. The new fourth edition addresses the line item veto and its tortuous history and prospects. A chapter on war powers and foreign affairs studies executive-legislative disputes that affect global relations, including the Iran-Contra affair, the Persian Gulf War in 1991, and American presence in conflicts such as Haiti and Bosnia. An important new discussion focuses on interbranch collisions and gridlock as they have developed since 1992.

Book Synopsis Power Without Persuasion by : William G. Howell
Download or read book Power Without Persuasion written by William G. Howell and published by Princeton University Press. This book was released on 2003 with total page 270 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the early 1960s, scholarly thinking on the power of U.S. presidents has rested on these words: "Presidential power is the power to persuade." Power, in this formulation, is strictly about bargaining and convincing other political actors to do things the president cannot accomplish alone. Power without Persuasion argues otherwise. Focusing on presidents' ability to act unilaterally, William Howell provides the most theoretically substantial and far-reaching reevaluation of presidential power in many years. He argues that presidents regularly set public policies over vocal objections by Congress, interest groups, and the bureaucracy. Throughout U.S. history, going back to the Louisiana Purchase and the Emancipation Proclamation, presidents have set landmark policies on their own. More recently, Roosevelt interned Japanese Americans during World War II, Kennedy established the Peace Corps, Johnson got affirmative action underway, Reagan greatly expanded the president's powers of regulatory review, and Clinton extended protections to millions of acres of public lands. Since September 11, Bush has created a new cabinet post and constructed a parallel judicial system to try suspected terrorists. Howell not only presents numerous new empirical findings but goes well beyond the theoretical scope of previous studies. Drawing richly on game theory and the new institutionalism, he examines the political conditions under which presidents can change policy without congressional or judicial consent. Clearly written, Power without Persuasion asserts a compelling new formulation of presidential power, one whose implications will resound.
