Yet his influence extends well beyond European philosophy, especially within Africa and South Asia. Postcolonial Bergson traces the influence of Bergson’s thought through the work of two major figures in the postcolonial struggle, Muhammad Iqbal and Léopold Sédar Senghor. Poets and statesmen as well as philosophers, both of these thinkers—the one Muslim and the other Catholic—played an essential political and intellectual role in the independence of their respective countries. Both found, in Bergson’s work, important support for their philosophical, cultural, and political projects. For Iqbal, a founding father of independent Pakistan, Bergson’s conceptions of time and creative evolution resonated with the need for the “reconstruction of religious thought in Islam,” a religious thought newly able to incorporate innovation and change. For Senghor, Bergsonian ideas of perception, intuition, and élan vital—filtered in part through the work of the French philosopher Pierre Teilhard de Chardin—proved crucial for thinking about African art, as well as foundational for his formulations of African socialism and his visions of an unalienated African future. At a moment of renewed interest in Bergson’s philosophy, this book, by a major figure in both French and African philosophy, gives an expanded idea of the political ramifications of Bergson’s thought in a postcolonial context.

Nor has it been realized that this was one of his most basic contentions. Bergson’s conception of intuition—his fundamental insight into reality—was not limited to fugitive insights into human existence. By realizing previously unsuspected possibilities for research and discovery, his endeavors were also meant to make possible new advances in the sciences. If it enabled his cousin by marriage, Marcel Proust, to explore human memory in depth, it also inspired psychologists like Daniel Schachter to use Bergson’s ideas to make real contributions to contemporary memory science. If his notion of creative evolution brought many thinkers to a belief in human creative freedom, it brought others (notably Alexis Carrel and Pierre Lecomte de Noüy) to a scientific study of biological time. Among his successful speculations was the theory of the Big Bang cosmology. 'Getting Bergson Straight' shows many points at which Bergson’s ideas anticipated future developments in the sciences. This was seen clearly by the Nobel Prize-winning physicist Luis de Broglie who viewed Bergson’s physics as presaging quantum physics. Book excerpt: This book challenges the correspondence theory of judicial fact construction – that legal rules resemble and subsume facts ‘out there’ – and instead provides an account of judicial fact construction through legally produced times- or adjudicative temporalities- that structure legal subject and event formation in legal judgement. Drawing on Bergsonian and Gadamerian theories of time, this book details how certain adjudicative temporalities can produce fully willed and autonomous subjects through ‘time framed’ legal events – in effect, the paradigmatic liberal legal subject – or how alternative adjudicative temporalities may structure legal subjects that are situated and constituted by social structures. The consequences of this novel account of legal judgement are fourfold. The first is that judicial fact construction is not exclusively determined by the legal rule (s) but by adjudication’s production of temporalities. The second is that the selection between different adjudicative temporalities is generally indeterminate, though influenced by wider social structures. As will be argued, social structures, framed as a particular type of past produced by certain adjudicative temporalities, may either be incorporated in the rendering of the legal event or elided. The third is that, with the book’s focus on criminal law, different deployments of adjudicative temporalities effect responsibility ascription. Finally, it is argued that the demystification of time as that which structures event and subject formation reveals another way in which to uncover the politics of legal judgement and the potential for its transformative potential, through either its inclusion or its elision of social structures in adjudication’s determination of facts.
