Book excerpt: English summary: This volume contains the expanded articles written by a group of specialists in comparative legal history, oriental law and ethnological legal research who dealt with various aspects of the position and the function of the judge in Western and Islamic law during the 30th conference for comparative law in Wurzburg in 2005. In both legal systems, the main issue is basically the just judge. Attempts to guarantee that justice is done by a judge can be made in various ways and can complement each other, such as for example through a selection according to general knowledge and honesty, preordained professional careers or rules of procedure for the trial. Book excerpt: German Idealism develops its philosophy of history as the theory of becoming absolute and as absolute knowledge. Historism also originates from Hegel's and Schelling's discovery of absolute historicity as it turns against Idealism's philosophy of history by emphasizing the singular and unique in the process of history. German Idealism and Historism can be considered as the central German contribution to the history of ideas. Since Idealism became most influential for modern philosophy and Historism for modern historiography, they are analyzed in this volume in a collaboration of philosophers and historians. German Idealism is presented in Schelling and its critics Schlegel, Baader, and Nietzsche; Historism in Ranke, Droysen, Burckhardt, and Treitschke. The volume further presents the impact of Idealism and Historism on present German approaches to the philosophy of history and outlines the debates on the possibility of a philosophy of history and on the methodology of the historical sciences.

Book excerpt: A COMPANION TO THE ARCHAEOLOGY OF THE ANCIENT NEAR EAST A Companion to the Archaeology of the Ancient Near East is a comprehensive and authoritative overview of ancient material culture from the late Pleistocene to Late Antiquity. This expansive two-volume work includes 58 new essays from an international community of ancient Near East scholars. With coverage extending from Asia Minor, the eastern Mediterranean, and Egypt to the Caucasus, Central Asia, and the Indo-Iranian borderlands, the book highlights the enormous variation in cultural developments across roughly 11,000 years of human endeavor. In addition to chapters devoted to specific regions and particular periods, many contributors concentrate on individual industries and major themes in ancient Near Eastern archaeology, ranging from metallurgy and agriculture to irrigation and fishing. Controversial issues, including the nature and significance of the antiquities market, ethical considerations in archaeological praxis, the history of the foundation of departments of antiquities, and ancient attitudes towards the past, make this a unique collection of studies that will be of interest to scholars, students, and interested readers alike.

And she recounts many affecting stories from young people who have contacted her for advice on how to step out of limiting views of Islam and the restrictions they put on life, love, family, and careers.

Book excerpt: This book focuses on the Hanafite school of fiqh which originated in the eight century and is, geographically, the most widespread and, numerically, the most important representative of Muslim normativeness. The fiqh consists of liturgical, ethical and legal norms derived from the Islamic revelation. The introduction outlines the main boundaries between fiqh and theology and follows the modern debate on the comparison between the fiqh and the secularized law of the modern Occident. The core of the book is dedicated to the way in which the fiqh, in the period between the 10th and the 12th centuries, adapted to changing circumstances of urban and agricultural life (chapters I and II), to the way in which it marked off legal from ethical norms (chapter III), religious from legal status (chapters IV to VI) and legal propositions from religious judgment (chapter VII). The forms in which change of norms was made acceptable is discussed in chapter VIII. The last chapter deals with an attempt of Shi'i scholars in the Islamic Republic of Iran to answer new problems in old forms.

Available in PDF, EPUB and Kindle. Book excerpt: The current Syrian crisis has its roots in the sectarian nature of the country's multi-religious society. Since Ottoman times, the different religious communities have enjoyed the right to regulate and administer their own family relations. Matters of personal status including marriage, divorce, child custody and inheritance continue to be managed by a variety of religious laws and courts operating simultaneously within the legal system of the state. However, this complex system of competing jurisdictions has also affected inter-communal relations and has been used to deepen communal divides. Esther van Eijk discusses socio-legal practices in Syria by focusing on three courts: a shar'iyya, a Catholic court and a Greek-Orthodox court. While the plurality of Syrian family law is clear, she shows how - irrespective of religious affiliation - it is nevertheless characterised by the prevalence of shared cultural or patriarchal views and norms on marital relations, family and gender. Based on extensive fieldwork, Family Law in Syria offers a detailed analysis of a country that has in recent years been inaccessible to researchers. The book is a vital contribution to the growing literature on personal status laws in the Middle East and sheds light on the historical, socio-political and religious complexities and fault-lines that mark contemporary Syria.

Since the early 1990s, and especially after the terrorist attacks of September 11, 2001, vexing policy questions have emerged about the religious rights of native-born and immigrant Muslims. Britain has struggled over whether to give state funding to private Islamic schools. France has been convulsed over Muslim teenagers wearing the hijab in public schools. Germany has debated whether to grant public-corporation status to Muslims. And each state is searching for policies to ensure the successful incorporation of practicing Muslims into liberal democratic society. This book analyzes state accommodation of Muslims religious practices in Britain, France, and Germany, first examining three major theories: resource mobilization, political-opportunity structure, and ideology. It then proposes an additional explanation, arguing that each nation s approach to Muslims follows from its historically based church-state institutions.

Book excerpt: Eastern Turkestan, now known as Xinjiang or the New Territory, makes up a sixth of China's land mass. Absorbed by the Qing in the 1880s and reconquered by Mao in 1949, this Turkic-Muslim region of China's remote northwest borders on formerly Soviet Central Asia, Afghanistan, Kashmir, Mongolia, and Tibet, Will Xinjiang participate in twenty-first century ascendancy, or will nascent Islamic radicalism in Xinjiang expand the orbit of instability in a dangerous part of the world? This comprehensive survey of contemporary Xinjiang is the result of a major collaborative research project begun in 1998. The authors have combined their fieldwork experience, linguistic skills, and disciplinary expertise to assemble the first multifaceted introduction to Xinjiang. The volume surveys the region's geography; its history of military and political subjugation to China; economic, social, and commercial conditions; demography, public health, and ecology; and patterns of adaption, resistance, opposition, and evolving identities.
