Zunächst werde ich auf maßgebliche Veränderungen von Kindheit und Jugend eingehen, um mich im Folgenden näher den Strukturen und Rechtsgrundlagen der Jugendhilfe zu widmen. Des weiteren sollen die entsprechenden Paragraphen des KJHG (Kinder- und Jugendhilfegesetz) und ihre Anwendung erläutert und wesentliche Begriffe definiert werden. In einer Vertiefung der einzelnen Hilfen zur Erziehung werde ich jeweils den methodischen Bezug zur Praxis herstellen und den Kreis der Zugangsberechtigten benennen. Abschließend widme ich mich dem Hilfeplan, der Finanzierung von Leistungen und dem Datenschutz. Die Arbeit endet mit einem abschließenden Fazit.

Dabei muss nicht unbedingt ein schuldhaftes Versagen der Erziehungsperson vorliegen. Schlechte Lebensbedingungen der Familie wie Arbeitslosigkeit, Armut oder aber auch belastende Lebensereignisse wie Trennung oder Scheidung können zu Situationen führen, die einen Bedarf begründen. Jedoch gilt auch hier eines der Strukturprinzipien des Gesetzes, nämlich die Orientierung am Vorzug der elterlichen Erziehungsverantwortung.

Die Fragestellung beschäftigt sich damit, wie der Hilfeplan mit dem systemischen Arbeiten kombinier- und umsetzbar ist. Das KJHG ist 1991in Kraft getreten und hat dort die Hilfen zur Erziehung (HzE) und den Hilfeplan definiert. Die Voraussetzungen und Rahmenbedingen haben sich seitdem enorm ausgeweitet und ausdifferenziert. Fast eine Million junger Menschen werden durch HzE begleitet und erfahren in einer wichtigen Phase ihres Lebens Unterstützung. Die Tendenz zur Inanspruchnahme der Hilfe ist ansteigend. Wabnitz (2014) führt mehrere Faktoren als mögliche Gründe für den Zuwachs an Hilfen zur Erziehung an. Zum einen sind es die Pluralisierungen der Familienformen und heiklen Lebenslagen von Familien, geprägt durch Trennungen, Arbeitslosigkeit, Wohnraumproblemen oder ähnlichem. Auf der anderen Seite sind es gesellschaftliche und politische „Diskurse“, wie der des „achtsameren Staats“ oder der ausgeübte Druck auf die Fachkräfte, die Hilfe zu Erziehung veranlassen. Menschen sind keine Maschinen und alle haben ihre persönlichen Hintergründe, deswegen ist der Hilfeplan „so schwierig umzusetzen“. Der erste Abschnitt legt den Fokus auf den §36 Mitwirkung, Hilfeplan SGB VIII. Dafür werden die Voraussetzungen des Inkrafttretens und die Inhaltlichen Schwerpunkte vorgestellt. Außerdem wird aufgezeigt, in welchen Bereichen der Hilfeplan seine Anwendung findet. Um einen Überblick über die Grundbegriffe zu verschaffen, werden diese anschließend definiert. Im zweiten Abschnitt erfolgt eine Auseinandersetzung mit den individuellen Qualitätsmerkmalen, wie die Partizipation oder die Ressourcen- und Sozialraumorientierung eines Hilfeplans. Diese Merkmale sind der Grundstein, um den Hilfeplan mit dem systemischen Arbeiten in Verbindung zu setzen. Der dritte Abschnitt stellt den Hilfeplan als einen pädagogischen Prozess dar und beinhaltet die vier Phasen, die in jedem Prozess durchlaufen werden. Der vierte Abschnitt zeigt die Schnittmenge zwischen Hilfeplan und systemischer Arbeit auf und nimmt dabei Bezug auf die vorangegangenen Abschnitte. Das Fazit ergibt sich aus einer zusammenfassenden Betrachtung der wichtigsten Ergebnisse dieser Hausarbeit sowie einem Ausblick für zukünftig mögliche und notwendige Entwicklungen des Hilfeplans.
