Book excerpt: UPDATED EDITION FEBRUARY 24, 2017On February 5, 1917 a dynamic and vigorous era began in Mexico, this was possible with the signing of the Constitution made in the city of Queretaro. It was not a "simple" Magna Carta, which is no small thing, it was a document emanating from the revolutionary process that made it the first constitution that openly expressed a social agenda. Among its relevant points, it emphasizes the interpretation it made of Democracy as a system of life based on the constant economic, social and cultural improvement of the people and not only as a legal or political framework. With this the State initiated a series of commitments for the construction of a Welfare State, although the concept as such did not exist in 1917.The Mexican Constitution has also been noted for being a flexible document that addresses the need of the Mexican people to change their maximum regulatory framework according to the demands of each time. It is necessary for anyone interested in their study to have the current text, recalling the Latin sentence Ignorantia juris non excusat, ignorance does not exempt from compliance with the law. This particular edition has the most modern elements of electronic publishing, which allow you to highlight contents and include annotations, in addition to being able to see the annotations that others make to it, besides that its format does not require to be consulted only when there is a connection To the Internet, but can be reviewed in areas lacking Wi-Fi or mobile data. Finally, it is necessary for the publisher to continue updating the text, according to the additions, reforms or derogations that the subsequent congresses make so that when buying the text will permanently have an updated version of it.

Book excerpt: The current Constitution of 1917 is the first such document in the world to set out social rights, serving as a model for the Weimar Constitution of 1919 and the Russian Constitution of 1918. Some of the most important provisions are Articles 3, 27, and 123; these display profound changes in Mexican political philosophy that helped frame the political and social backdrop for Mexico in the twentieth century. Aimed at restricting the Roman Catholic Church in Mexico, Article 3 established the basis for a free, mandatory, and secular education; Article 27 laid the foundation for land reforms; and Article 123 was designed to empower the labor sector, which had emerged in the late nineteenth century and which supported the winning faction of the Mexican Revolution.Articles 3, 5, 24, 27, and 130 seriously restricted the Roman Catholic Church in Mexico, and attempts to enforce the articles strictly by President Plutarco Calles (1924-1928) in 1926 led to the violent conflict known as the Cristero War.In 1992, under the administration of Carlos Salinas de Gortari, there were significant revisions of the constitution, modifying Article 27 to better guarantee private property rights and ended redistribution of land, and the articles restricting the Roman Catholic Church in Mexico were largely repealed.

Book excerpt: The legal principle of ne bis in idem proclaims that no person shall be tried twice for the same matter. This principle is important in theory and practice, as it safeguards a fundamental individual interest and spares the accused the burden of a repeat trial. This book provides a comprehensive examination of the ne bis in idem principle in international criminal law. Readers will find a detailed account of ne bis in idem rules in the law and practice of the International Criminal Court and other international criminal courts. The book also examines international law ne bis in idem rules that govern the domestic prosecution of international crimes. The book will be a valuable resource for researchers, academics and policy-makers working in the areas of International Criminal Law and International Human Rights law. It will be of particular use to those interested in defense rights, admissibility of cases before international criminal courts, and issues arising from prosecution of international crimes in multiple criminal jurisdictions.

Book excerpt: This ground-breaking collection of essays outlines and explains the unique development of Latin American jurisprudence. It introduces the idea of the Ius Constitutionale Commune en América Latina (ICCAL), an original Latin American path of transformative constitutionalism, to an Anglophone audience for the first time. It charts the key developments that have transformed the region and assesses the success of the constitutional projects that followed a period of authoritarian regimes in Latin America. Coined by scholars who have been documenting, conceptualizing, and comparing the development of Latin American public law for more than a decade, the term ICCAL encompasses themes that cross national borders and legal fields, taking in constitutional law, administrative law, general public international law, regional integration law, human rights, and investment law. Not only does this volume map the legal landscape, it also suggests measures to improve society via due legal process and a rights-based, supranational and regionally rooted constitutionalism. The editors contend that with the strengthening of democracy, the rule of law, and human rights, common problems such as the exclusion of wide sectors of the population from having a say in government, as well as corruption, hyper-presidentialism, and the weak normativity of the law can be combatted more effectively in future.

Book excerpt: American history told from the vantage of immigration politics It is often said that with the election of Donald Trump nativism was raised from the dead. After all, here was a president who organized his campaign around a rhetoric of unvarnished racism and xenophobia. Among his first acts on taking office was to block foreign nationals from seven predominantly Muslim countries from entering the United States. But although his actions may often seem unprecedented, they are not as unusual as many people believe. This story doesn’t begin with Trump. For decades, Republicans and Democrats alike have employed xenophobic ideas and policies, declaring time and again that “illegal immigration” is a threat to the nation’s security, wellbeing, and future. The profound forces of all-American nativism have, in fact, been pushing politics so far to the right over the last forty years that, for many people, Trump began to look reasonable. As Daniel Denvir argues, issues as diverse as austerity economics, free trade, mass incarceration, the drug war, the contours of the post 9/11 security state, and, yes, Donald Trump and the Alt-Right movement are united by the ideology of nativism, which binds together assorted anxieties and concerns into a ruthless political project. All-American Nativism provides a powerful and impressively researched account of the long but often forgotten history that gave us Donald Trump.
