The first is more famous, but the second was most essential because, without federalism, there could have been no United States of America. Federalism has always been about setting the balance of power between the federal government and the states-and that's revolved around deciding just how much inequality the country was prepared to accept in exchange for making piece among often-warring states. Through the course of its history, the country has moved through a series of phases, some of which put more power into the hands of the federal government, and some rested more power in the states. Sometimes this rebalancing led to armed conflict. The Civil War, of course, almost split the nation permanently apart. And sometimes it led to political battles. By the end of the 1960s, however, the country seemed to have settled into a quiet agreement that inequality was a prime national concern, that the federal government had the responsibility for addressing it through its own policies, and that the states would serve as administrative agents of that policy. But as that agreement seemed set, federalism drifted from national debate, just as the states began using their administrative role to push in very different directions. The result has been a rising tide of inequality, with the great invention that helped create the nation increasingly driving it apart"--

However, studies on the territorial effects of European integration and on the Europeanization of parliaments as well as parliamentarism have so far disregarded this group of parliaments. In the existing theoretical concepts of 'multi-level parliamentarism' subnational parliaments do not have a place until now. The book addresses this theoretical and empirical gap. Referring TO STUDIES ON PARLIAMENTARISM, FEDERALISM, AND EUROPEANIZATION the contributions discuss how to include subnational parliaments in the existing research. A total of 74 subnational parliaments from eight member states is affected by the new system, which allows them to participate in the so-called Early Warning Mechanism of subsidiarity control. The situation in six EU member states is analyzed in detail. The country chapters illustrate and analyze how subnational parliaments in the federal member states (Austria, Belgium, Germany) and in the decentralized/devolved ones (Great Britain, Italy, Spain) functionally adapt to the new opportunity structure and discuss the repercussions on legislative-executive relations as well as on interparliamentary relations. Book excerpt: It has become apparent that a clear gap exists between European Union (EU) level policymaking and Member State implementation. Previous research has neglected to fully define factors that encourage or prevent implementation processes and instead focused on upstream decision making processes or downstream effects of policy. Simona Milio here proposes a shift in analytical focus towards policy-implementation since this constitutes a crucial common pathway that determines whether a policy actually becomes effective or not. EU implementation deficits appear to be influenced by problems related to the multi-level structure of European policy making. Successful implementation will only occur if relevant policy actors at national and sub-national levels are persuaded to co-operate with EU policy goals. Furthermore, this co-operation is not possible unless all parties manage the complex policy networks and implementation regimes responsible for putting European policies into force. Within this framework, this book answers three important questions: 1 Is the EU multi-level governance system weakening the implementation of policies? 2 Are national and sub-national governments capable of dealing with the challenges imposed by multi-level governance? 3 Which factors account for differences in implementation performance among Member States? In order to answer these questions, Simona Milio's research explores the influence of two variables on implementation processes: Administrative Capacity and Political Stability. Cohesion Policy is chosen as the focus of this study since it has demonstrated a dramatically different implementation pace among EU Member States over the past 20 years. Three EU Member States are chosen to test the hypothesis. Italy appears to be a pertinent example, given its constant struggle to conform to EU directives and to implement Cohesion Policy. Spain is chosen since, in contrast to the Italian scenario, it represents the best performing Member State in terms of implementation. Finally Poland is studied, as a case where a shift from centralization towards decentralization has occurred in order to implement Cohesion Policy and integrate the multi-level governance system.

While the implementation of land reforms can be a lengthy process, the need to swiftly identify key land policy challenges and devise responses that allow the monitoring of progress, in a way that minimizes conflicts and supports broader development goals, is clear. The Land Governance Assessment Framework (LGAF) makes a substantive contribution to the land sector by providing a quick and innovative tool to monitor land governance at the country level. The LGAF offers a comprehensive diagnostic tool that covers five main areas for policy intervention: Legal and institutional framework; Land use planning, management and taxation; Management of public land; Public provision of land information; and Dispute resolution and conflict management. The LGAF assesses these areas through a set of detailed indicators that are rated on a scale of pre-coded statements (from lack of good governance to good practice). While land governance can be highly technical in nature and tends to be addressed in a partial and sporadic manner, the LGAF posits a tool for a comprehensive assessment, taking into account the broad range of issues that land governance encompasses, while enabling those unfamiliar with land to grasp its full complexity. The LGAF will make it possible for policymakers to make sense of the technical levels of the land sector, benchmark governance, identify areas that require further attention and monitor progress. It is intended to assist countries in prioritizing reforms in the land sector by providing a holistic diagnostic review that can inform policy dialogue in a clear and targeted manner. In addition to presenting the LGAF tool, this book includes detailed case studies on its implementation in five selected countries: Peru, the Kyrgyz Republic, Ethiopia, Indonesia and Tanzania.

Book excerpt: This title was first published in 2001: Despite the fact that environmental directives are one of the strongest areas of policy decreed by the EU, it has a much poorer record when it comes to actual implementation of these policies. Instead of focusing on the traditional state-centrist accounts, this book compares two subnational regions within the EU, Scotland and Bavaria, and their role in the policy process. The author offers a multi-layered implementation map which highlights three main government ’layers’ involved in the filtering process and identifies various formal and informal determinants which shape EU environmental policies during the process. The book not only compares implementation performances between the two regions and their respective states, but also compares the region’s processes against the national processes, thereby exposing determinants that would otherwise remain undetected. In doing so, it confirms that subnational regions feature determinants which differ in many respects from national determinants and influence the effectiveness of EU environmental policies. The book contributes to a better understanding of the implementation deficit and presents a more refined picture of the EU environmental policy ’reality’.
