Since the demise of communism, the building up of an independent judiciary and a general reorientation of the police role within society have been key-issues On the basis of three country studies in Russia, Lithuania and Mongolia, this book analyses the present state of policing in a variety of post-communist societies in terms of police-public violence, democratic policing, the rule of law and human rights. It is also complemented by recent comparable and previously unpublished police data for Romania, Bulgaria and Poland. Those studies have been carried out amongst the rank-and-file of the uniform branch in Lithuania and Russia which were commissioned by the Soros Open Society Foundation. They were specifically concerning views and experiences concerning police-public violence and current policing problems in general. A third study was carried in Mongolia amongst criminal investigators, and sought to explore (violent) investigative practices. This book seeks to combine a thorough theoretical analysis with unique empirical data. It analyses the different problems of transition of post-communist societies towards more democratic forms of government with unique data from both outside and inside the police.

Here Richard Quinney provides a critical look at the legal order in capitalist society. Using a traditional Marxist perspective, he argues that the legal order is not intended to reduce crime and suffering, but to maintain class differences and a social order that mainly benefits the ruling class. Quinney challenges modern criminologists to examine their own positions. As "ancillary agents of power," criminologists provide information that governing elites use to manipulate and control those who threaten the system. Quinney's original and thorough analysis of "crime control bureaucracies" and the class basis of such bureaucracies anticipates subsequent research and theorizing about the "crime control industry," a system that aims at social control of marginalized populations, rather than elimination of the social conditions that give rise to crime. He forcefully argues that technology applied to a "war against crime," together with academic scholarship, is used to help maintain social order to benefit a ruling class. Quinney also suggests alternatives. Anticipating the work of Noam Chomsky, he suggests we must first overcome a powerful media that provides a "general framework" that serves as the "boundary of expression." Chomsky calls this the manufacture of consent by providing necessary illusions. Quinney calls for a critical philosophy that enables us to transcend the current order and seek an egalitarian socialist order based upon true democratic principles. The collapse of the Soviet Union initiated fundamental changes in aspirations, ideologies and governing practices among former members of the socialist camp. Reforming policing systems which had served primarily to protect the party-states from their opponents into systems which serve and protect civic society has come to be seen as an essential prerequisite and concomitant of the democratisation process in transitional countries. The chapters in this book describe what has happened to the policing systems in 14 countries in Central and eastern Europe; what reforms in ideology, organisation, policies and practices have been undertaken; what has changed in the way policing is done; and assessment of whether the policing system has moved closer toward democratic policing. In combining descriptions of reforms and assessments of whether reforms have moved policing systems toward more democratic forms, the book provides a comparative overview of what has been achieved since 1989 and what has been learned so far about how to reform policing systems along democratic lines. Such lessons offer insights for further reform in transitional countries and for Western democracies as well, and we hope will stimulate more theoretical discussions of the nature and dynamics of policing systems, state-society relations, and the role of processes of democratisation of policing systems.
