Download or read book Combating Piracy written by Graham Dawson and published by Routledge. This book was released on 2017-07-05 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: Fraud and piracy of products and ideas have become common in the early twenty-first century, as opportunities to commit them expand, and technology makes fraud and piracy easy to carry out. In Combating Piracy: Intellectual Property Theft and Fraud, Jay S. Albanese and his contributors provide new analyses of intellectual property theft and how perpetrators innovate and adapt in response to shifting opportunities. The cases described here illustrate the wide-ranging nature of the activity and the spectrum of persons involved in piracy of intellectual property. Intellectual property theft includes stolen copyrights, trademarks, trade secrets, and patents, which represent the creative work of individuals for which others cannot claim credit. The distributors of books, movies, music, and other forms of intellectual property pay for this right, and those who distribute this work without compensation to its creator effectively hijack or "pirate" that property without the owner's or distributor's permission. The problem has grown to the point where most software in many parts of the world is pirated. The World Health Organization estimates that 10 percent of all pharmaceuticals available worldwide are counterfeit.Such widespread fraud illustrates the global reach of the problem and the need for international remedies that include changed attitudes, public education, increasing the likelihood of apprehension, and reducing available opportunities. The contributors show that piracy is a form of fraud, a form of organized crime, a white-collar crime, a criminal activity with causes we can isolate and prevent, and a global problem. This book examines each of these perspectives to determine how they contribute to our understanding of the issues involved.

This book was released on 2009-01-01 with total page 341 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a book that has a lot to offer. Many of its readers will benefit from the first chapters which comprehensively analyse the case law and put it in context, whilst others will benefit more from the more conceptual chapters and the criticism of certain points and suggestions for a way forward contained in them. Paul L.C. Torremans, European Intellectual Property Review This timely volume offers a comprehensive review of case law, in various jurisdictions, on secondary liability for copyright infringement, particularly P2P file sharing and online infringements. Moreover, the book includes forward-looking contributions of prominent academics from the USA and the EU, which provide original perspectives on the future shape of online copyright law, looking at questions such as whether it could or even should evolve towards a compensation system. By combining these different avenues, the book will be of particular interest to practitioners, academics, researchers and legal scholars involved in the field of copyright law.

Available in PDF, EPUB and Kindle. Book excerpt: Essay from the year 2012 in the subject Law - Media, Multimedia Law, Copyright, grade: 2, King`s College London, language: English, abstract: This essay is focused on the unauthorized digital exploitation of copyrighted works and the enforcement options for rights holders. Therefore, it will be examined what kind of measures are available at the judicative and the legislative stage. In particular the essay refers to the unauthorised exploitation of music within the Internet. After an introduction into the topic of digital piracy and music, a brief historical overview gives an insight of certain technologies that were/are found to be infringing. Further contemporary forms of digital piracy are explained, as the peer-to-peer networks, which are a major threat to the industry. On the example of important cases of music piracy it will be shown how courts struggled with that topic. As this essay is mainly focused on the UK, the cases of Newzbin and Newzbin2 will be examined in detail, as those show important developments in both subsuming online piracy and enforcement. The legislative perspective will be examined on the example of three strike laws, which provide the so-called graduate response- an alternative way to litigation. It will be demonstrated on the examples of the UK’s Digital Economy Act and the French HADOPI law what new measures are provided and how they are operated. This will be followed by a conclusion containing the personal opinion of the author.
