Book excerpt: Educational scholars have examined the relationship of philanthropy and its contributions to the public university. Yet, there has been little discussion of the influence of philanthropy on the governance space of the public research university, and specifically as conditional philanthropy may affect academic integrity and shared governance. In this chapter, we consider these larger issues in the context of a study of a recent case. Drawing on public records, interviews, and university documents, the chapter examines conditional donation of The Charles G. Koch Foundation (CKF) to the Florida State University (FSU). We suggest that the Koch Foundation gift appears to illustrate a new model of governance based philanthropy. It has done so by tying donations to control or influence of the internal governing mechanics of an academic unit of a public university. This model has generated controversy. Though there was substantial faculty and student backlash, the model appears to be evidence of a new philanthropic relationship between the public university and substantial donors, one in which donors may change the nature of traditional shared governance relationships within the university. We maintain that instances of such “new” strategic philanthropy require greater focus on and sensitivity to shared governance and faculty input as a way to ensure accountability, especially to preserve the integrity of the academic enterprise and its public mission where donors seek to leverage philanthropy into choices relating to faculty hires, courses and programs traditionally at the center of faculty prerogatives in shared governance.

Even as the higher education costs continue to exceed the rate of inflation, public funding from both state and federal sources is steadily declining. As traditional funding sources become less reliable, American colleges and universities seek to pursue alternative revenues such as private donations. Using panel data of public colleges and universities from 1994-2003, this study investigated how institutional characteristics and environmental factors influence overall private giving and its varying sources to public colleges and universities. It addressed two major research questions: Which institutional, state policy and governance, and socioeconomic factors are most closely associated with the generation of private giving to public postsecondary institutions? How do these factors differently influence private giving from four sources- alumni/ae, non-alumni/ae individuals, corporations, and foundations? This book is addressed to higher education researchers, policymakers, university administrators, and institutional development officers. The general conceptual framework suggested by this book will help higher education researchers better understand the dynamics of private giving in collges and universities. Findings of this study also have some practical implications to higher education policymakers and practitioners.

Book excerpt: In recent years, some public officials and advocacy groups have urged that private philanthropies be subject to more uniform standards and stricter government regulation ranging from board composition to grant distribution to philanthropies' charitable purposes. A major justification cited by advocates of these proposals is the claim that the charitable tax exemption and deduction are government subsidies, and thus philanthropic funds are "public money" and should be publicly controlled. Some advocates also claim that philanthropic assets are public money because philanthropies operate under state charters and are subject to state oversight. In the second edition of this monograph, legal scholars Evelyn Brody and John Tyler evaluate the legal basis of the "public money" claim. They conclude that it is not well founded in legal authority. State oversight of philanthropies is not based on an assertion that philanthropies are subject to state direction or that their assets belong to the public, they write. Similarly, the fact that philanthropies have state charters does not make them state agencies or subject them to the constraints that apply to public bodies. Finally, the philanthropies and their donors receive their federal tax benefits in return for the obligation to pursue public rather than private purposes and to comply with the laws designed to ensure the pursuit of such purposes. There is no evidence, Brody and Tyler find, that these benefits were meant to give government other types of control over philanthropies.

In the midst of the tumultuous 1960s, the United States Congress turned its attention to issues of tax policy and philanthropy, with special focus on abuses and responsibilities of philanthropic foundations. During the period marked by passage of the Tax Reform Act of 1969, John D. Rockefeller 3rd was one of the staunchest defenders of philanthropy in public and in behind-the-scenes lobbying in Washington. This book is a history of two major commissions initiated by Rockefeller: The Commission on Foundations and Private Philanthropy (1969-1970), dubbed "The Peterson Commission" after its chairman, Peter G. Peterson; and The Commission on Private Philanthropy and Public Needs (1973-1977), headed by John H. Filer, and known as "The Filer Commission." Brilliant analyzes the significance of the two commissions with regard to philanthropy and public policy, and in light of the value that Americans place on voluntary associations. Using original documents of the two commissions, archival material, and extensive interviews with key informants, Brilliant shows how powerful individuals and groups influence tax policy in the United States. Her analysis provides new insights into the two sides of philanthropy doing good and getting rewarded for it through tax benefits. Eleanor L. Brilliant, Professor of Social Work at Rutgers University, teaches courses on social policy, management, organization theory, and women's issues. Book excerpt: Competition for philanthropic dollars has escalated in recent years, particularly in higher education. A new type of charitable giving--venture philanthropy--has emerged and is impacting both educational policy and practice. Venture philanthropy involves donors using business models, championed practices of venture capitalists, and decision making procedures to drive their philanthropy and ongoing engagement with organizations they support. Venture philanthropy has the potential to improve the financial vitality of colleges and universities. However, it also poses significant questions to the academy as more colleges and universities engage with donors who embrace its tenets. The primary research question seeks to understand in what ways venture philanthropy has impacted shared governance of private liberal arts colleges. Secondary research questions explore who the decision makers involved in the cultivation, solicitation, acceptance, and implementation of the gift were; the benchmarks, goals, and results that were agreed to before the gift was received; the motivation and process of accepting the gift; and, the lessons learned. Administrators and faculty leaders at two liberal arts colleges were interviewed to determine how such gifts functioned within a collegial shared governance model. The study indicated that the collegial model of shared governance needs to evolve to reflect the changes of philanthropy in higher education. Faculty members want to be more engaged both in setting priorities and in the fundraising process. Administrators need to promote increased transparency, trust, and engagement with faculty in the philanthropic process. A new gift process needs to be formalized to manage venture philanthropy gifts. Finally, the collegial model, in practice, does not match theory. Venture philanthropy donors have an incredible opportunity to financially impact colleges and universities nationwide, but traditional theories of shared governance have not kept pace with the changes of external influence on higher education. Recommendations for practices include promoting a shared vision more widely, increasing transparency and consensus building, improving faculty engagement in philanthropy, strengthening leadership in negotiating gifts, creating strategies for embracing venture philanthropy, and improving the process of venture philanthropy gift acceptance.
