Does empirical evidence support the use of industrial policy for correcting market failures that plague the process of industrialization? To address these questions, the authors provide a critical survey of the analytical literature on industrial policy. They also review some recent industry successes and argue that only a limited role was played by public interventions. Moreover, the recent ascendance of international industrial networks, which dominate the sectors in which less developed countries have in the past had considerable success, implies a further limitation on the potential role of industrial policies as traditionally understood. Overall, there appears to be little empirical support for an activist government policy even though market failures exist that can, in principle, justify the use of industrial policy.

Ce concept est aussi une ambition collective qui sollicite le droit pour être atteinte. Or cette question a, jusqu'à aujourd'hui, peu mobilisé les juristes. C'est la raison pour laquelle l'Ecole de droit de la Sorbonne (Paris 1), l'Université Paris Est Créteil (UPEC) et l'ESSEC Business School ont organisé dans le cadre du Réseau Transnational de Droit Bancaire et Financier (RTDBF) une journée internationale d'étude, qui s'est tenue dans l'amphithéâtre Louis Liard de la Sorbonne le mardi 22 octobre 2019, sur le thème « Finance durable et droit : perspectives transnationales ». Ce livre, qui est le premier ouvrage en langue française consacré à ce sujet, rassemble la plupart des contributions de cette manifestation ainsi que quelques contributions écrites. Les contributions des chercheurs ainsi rassemblées donneront aux lecteurs une première image du droit de la finance durable dans une perspective transnationale et transsectorielle. Riches et variés, les thèmes explorés témoignent des mutations en cours, principalement tournées vers la transition écologique mais pas uniquement. Cette journée d'études a été l'occasion de constater que de nombreux projets sont encore en discussion en Europe comme en Amérique du Nord, car la finance durable n'en est qu'à ses débuts. Il est à cet égard intéressant de relever que depuis cette conférence, les initiatives de régulateurs notamment ne cessent de se multiplier. Cet ouvrage apporte de premiers éléments à une réflexion collective nécessaire... et urgente. En cette matière, le droit n'accompagne pas seulement, il se doit également d'être le promoteur de changements profonds.
