For example, in two cases, the vacancy announcements appeared tailored to include specific work experiences possessed by the two appointees.

Book excerpt: Pursuant to a congressional request, GAO examined the number and patterns of career appointments to the civil service made between October 1984 and June 1994. GAO found that: (1) between October 1984 and June 1994, 1,090 former political and congressional employees received career appointments, including 552 noncompetitive appointments under the Ramspeck Act, 502 competitive appointments, and 36 White House service appointments; (2) 42 of the appointments were to the Senior Executive Service (SES), while the remaining 1,048 appointments were to positions equivalent to GS-15 or below; (3) Ramspeck Act appointments have followed a cyclical trend over the 10-year period, increasing greatly during the years immediately following federal elections; (4) these noncompetitive appointments are generally associated with congressional membership turnover and the consequent involuntary separation of congressional employees; and (5) cabinet-level departments accounted for 81 percent of the Ramspeck Act appointments, 76 percent of former Schedule C and noncareer SES appointments, and 81 percent of White House service appointments.

Although merit system principles require that selections be determined solely on the basis of merit after fair and open competition, questions have been raised about whether some individuals have received political favoritism or an unfair advantage, even the appearance of which could adversely compromise the integrity of the system. The 45 agencies GAO surveyed reported that 100 employees converted from political appointments and 11 converted from congressional staff positions from October 1998 through April 2001. All the conversions took place at 21 agencies. Ninety-five of the 111 conversions were to positions at the GS-12 level and above. GAO found that the 21 agencies used appropriate appointment authorities, such as civil service certificates from the competitive selection process, and generally followed merit system procedures. In 17 instances, however, the appointments could give the appearance that individuals had received political favoritism or preferences.

Book excerpt: Pursuant to a congressional request, GAO reviewed the career appointments that agencies granted to employees who held either noncareer Senior Executive Service (SES) or Schedule C appointments before their career appointments, focusing on: (1) whether the appointments adhered to merit system principles dealing with fair and open competition and Office of Personnel Management (OPM) implementing regulations; and (2) OPM oversight of the appointments. GAO found that: (1) the propriety of conversions and agencies' adherence to merit system principles are difficult to ensure, because officials can easily give the appearance that fair and open competition was achieved when it was not; (2) of 46 conversions made in the period February 1988 through December 1989, 37 appeared proper, 7 were questionable, and 2 did not fully comply with merit staffing requirements; (3) OPM has established a review process that has identified and prevented some improper conversions; and (4) the subjectivity in the selection process will continue to make it difficult for OPM to oversee conversions.
