Book excerpt: Conventionally, the upsurge in the level of impoverishment experienced by retirees in the recent decades in both public and private sectors in mostly fused cum prismatic societies has exacerbated following the reluctant abdication of duties and obligatory roles bequeathed to the state via the social contract. Recently, in many developing societies, the state has ethically failed to provide the needed social safety nets for her citizens to enjoy even against those working to see that the day to day affairs of the state are systematically carried out. However, it is at this juncture that the paper consciously set to ethically investigates and at the same time interrogates the voluntary pension contribution and welfare of Retirees and ways of improving the retirement benefits of retirees using University of Nigeria, Nsukka as case study. Data were collected from the University of Nigeria Bursary Department, Pension Fund Administrators and Pension Commission (PENCOM). The paper utilized qualitative method in generating data and it was anchored on Marxian instrumentalist theory to explicate that the New contributory pension scheme is a product designed through the doctrine and practices of Neo-liberal policy, which helps the state through its agency to abdicate its fundamental roles. The findings revealed that there is a marked departure in the retirement benefits of retirees in the old and new pension schemes, with the retirees in the new contributory scheme receiving lower benefits than before. However, the study recommends the right to gratuity and pension for life for public servants and a comprehensive accounting standard for retirement benefits be seriously put in place to protect the pension funds.

This increased liquidity in the economy and created employment opportunities as well as improvement in the investment climate. The study concluded that with good risk and portfolio management by pension fund administrators and custodians, the contributory pension has the capacity to boost the Gross Domestic Product (GDP) in Nigeria and very convenient to retirees compared to the previous defined benefit scheme. The study however recommended the removal of delay payment, administrative bottlenecks and corruption in the management of the pension fund in order to boost economic growth in Nigeria.

In the absence of reforms, the system’s inability to deliver adequate outcomes for a large share of participants will continue to magnify, as demographic trends and low global interest rates will continue to reduce replacement rates. In addition, recent legislation allowing for pension savings withdrawals to counter the effects from the COVID-19 pandemic, is projected to further reduce replacement rates and increase fiscal costs. A substantial improvement in replacement rates is feasible, via a reform that raises contribution rates and the retirement age, coupled with policies that increases workers’ contribution density.

All results and values from PFAs (Pension Fund Administrator) are based on Nigeria's investment environment within the period under study. This work provides a mathematical model usable to evaluate returns of PFAs. It also advices for approval of other portfolio classes to allow best result from asset class spread for a better performance of contributors' fund in Niegria.

With the coming into force of the Pension Reform Act 2004, the Nigerian pension system was, to say the least, overhauled. A contributory pension scheme was established for every employee under the Pension Reform Act 2004. It also brought along with it a triangular relationship of the employee, pension fund administrator and pension fund custodian. The pension fund administrator was made the exclusive manager of the fund while custody of the funds was the preserve of the pension fund custodian. Though not immediately visible, the concept of trust was central to the relationship between the pension fund administrator, the pension fund custodian and the employee. In 2014, the 2004 Act was repealed and a new Pension Reform Act enacted. However, the concept of trust remained unaffected. This work, therefore aims at examining the relationship between the law of trust and Nigerian pension law. It seeks to unveil the meaning of pension trust with a painstaking analysis of the nature, parties, advantages, breach and remedies of the pension trust created under the Pension Reform Act 2014.
