Available in PDF, EPUB and Kindle. Book excerpt: The USA Patriot Act: A Reference Handbook is an in-depth examination of the difficult wartime task of balancing civil liberties against national security. Within weeks of the September 11 terrorist attacks, overwhelming majorities in both houses of Congress passed the USA Patriot Act. The act immediately aroused bitter controversy. Some claim it impermissibly infringes on constitutional rights; others argue it is a necessary tool to ensure the security of the American homeland. Distinguished scholar and prolific author Howard Ball provides the background necessary for a reasoned, historical examination of both positions. He details the threats to America in the last 60 years, emphasizing terrorist acts; examines the temporary surrender of civil rights during past American wars; and uses that history to analyze the USA Patriot Act, both as it exists and as arguments rage over whether to strengthen or weaken the law.

Book excerpt: Referred to as the best source for a truly fair and balanced debate on the USA PATRIOT Act, this book summarizes the provisions of the Act that are due to expire at the end of 2005 as well as several other issues that are likely to be part of the renewal debate. Gathering some of the brightest minds in national security and privacy laws, (21 authors) this book provides a series of point and counter-point essay exchanges devoted to civil and informed debate on these provisions. Stuart Taylor of the National Journal calls the book the best imaginable introduction to the PATRIOT Act. It explains the more important and contentious provisions and juxtaposes the best arguments for and against them, presented by opposing experts in a readable and civil fashion. The book focuses attention on the sometimes difficult tradeoffs between liberty and security that Congress should weigh in the balance as it considers possible amendments.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Available in PDF, EPUB and Kindle. Book excerpt: For the past three decades, many history professors have allowed their biases to distort the way America’s past is taught. These intellectuals have searched for instances of racism, sexism, and bigotry in our history while downplaying the greatness of America’s patriots and the achievements of “dead white men.” As a result, more emphasis is placed on Harriet Tubman than on George Washington; more about the internment of Japanese Americans during World War II than about D-Day or Iwo Jima; more on the dangers we faced from Joseph McCarthy than those we faced from Josef Stalin. A Patriot’s History of the United States corrects those doctrinaire biases. In this groundbreaking book, America’s discovery, founding, and development are reexamined with an appreciation for the elements of public virtue, personal liberty, and private property that make this nation uniquely successful. This book offers a long-overdue acknowledgment of America’s true and proud history.

Book excerpt: The USA Patriot Act One is of the most controversial and possibly one of the most misunderstood laws Congress has ever enacted. For many Americans, it is synonymous with an egregious and unjustifiable suspension of the Bill of Rights. Others, troubled but more cautious, identify the Patriot Act with the grant of unprecedented powers that put civil liberties at some risk. Many who reject these concerns nonetheless accept their underlying assumption —that the Patriot Act does indeed give the federal government a package of powerful new search and surveillance tools. In Rethinking the Patriot Act, Stephen J. Schulhofer explains the act's most important provisions and reviews the best information currently available to gauge their usefulness and their effects in practice. Contrary to conventional wisdom, Schulhofer argues that much of the Patriot Act was essential, and some of it, if not essential, was reasonably defensible. In fact, the act includes provisions —seldom noticed —that add new protections for certain civil liberties, extend new benefits to certain immigrant groups, and provide new remedies for violations of individual rights. Nonetheless, Schulhofer concludes, many of the act's new powers are far too broad, and even where the case for broad powers is strong, they were typically conferred with little effort to assure transparency and accountability.

Available in PDF, EPUB and Kindle. Book excerpt: Scientific Essay from the year 2007 in the subject Law - Comparative Legal Systems, Comparative Law, grade: C, National University of Juridical Sciences (National University of Juridical Sciences), language: English, abstract: Against the backdrop of the horrendous happenings of 11th September,2001 the American Congress, cloaked in fear capitulated to the Bush administration’s demand for a new anti-terror law by overlooking the tumultuous objections from the civil liberties organization from both ends of the political spectrum. The Congress approved the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act, which is better known by its acronym the U.S.A PATRIOT ACT with an overwhelming majority of 356 votes to 66 in the House and 98 votes to one in the U.S Senate1. In the process the Congress brushed aside a more promising anti-terrorism bill that the House Judiciary Committee had unanimously approved, that would have addressed a number of civil liberties concerns. The complex and far reaching legislation was drafted hastily and without being subjected to much debates and discussion or conferences or committee reports that any other significant act would undergo was signed and made a law by the president of the United States, George W. Bush on 26th October 2001. This essay deals with the implications of U.S.A. patriot act on human rights.

Carp illuminates how a determined group of New Englanders shook the foundations of the British Empire, and what this has meant for Americans since. As he reveals many little-known historical facts and considers the Tea Party's uncertain legacy, he presents a compelling and expansive history of an iconic event in America's tempestuous past.

Book excerpt: The US Patriot Act, one of the most controversial laws of our time, consists of ten titles which, among other things: give federal law enforcement and intelligence officers greater authority (at least temporarily) to gather and share evidence particularly with respect to wire and electronic communications; amend federal money laundering laws, particularly those involving overseas financial activities; create new federal crimes, increase the penalties for existing federal crimes, and adjust existing federal criminal procedure, particularly with respect to acts of terrorism; modify immigration law, increasing the ability of federal authorities to prevent foreign terrorists from entering the US, to detain foreign terrorist suspects, to deport foreign terrorists, and to mitigate the adverse immigration consequences for the foreign victims of September 11; and authorise appropriations to enhance the capacity of immigration, law enforcement, and intelligence agencies to more effectively respond to the threats of terrorism. However, the American Library Association (ALA) Council declares that the ALA "considers sections of the USA PATRIOT Act . . . a present danger to the constitutional rights and privacy rights of library users. And civil rights activists have decried the government's interpretation of the act with respect to detaining individuals who may be guilty of nothing more than being born in the Middle East. This new reader presents a section by section analysis of the Act and highlights the provisions that are supposed to expire and when.
