As that initial publication recognized, however, patent infringement damages is a continuously evolving area of law. In the intervening years, the courts not only have continued to refine the legal principles that govern the determination of patent infringement damages, but also have implemented a variety of case-management techniques that focus on patent damages. Judge Jeremy Fogel, director of the Federal Judicial Center, therefore requested a revised patent damages guide to reflect the current state of the law and the courts' evolving case-management efforts. This second edition is the result. As with the original, this revised guide does not attempt to provide a comprehensive explication of substantive damages law or to predict its future evolution. Rather, it is intended to focus on case-management practices that may be helpful to the courts in the adjudication of patent infringement damages. Because judges have requested inclusion of more substantive damages law, however, we have added more detail in this regard, but we have stopped well short of presenting a patent damages treatise.

Book excerpt: The past three decades have witnessed an “evidence-based practice” movement in which scholars and practitioners across a wide variety of disciplines have begun to use the best available evidence to test and improve pre-existing practices that lack the support of rigorous data. This movement has also reached legal practice and scholarship, but many areas of law still lack a solid evidence base.This Article examines one such area -- the law governing patent damages -- which is both highly important to any modern economy and the subject of a substantial amount of litigation. Currently, the controlling case law requires courts to determine damages based on the royalties that would have been due had the patentee and the accused infringer negotiated a license prior to any infringement. No study, however, has ever compared the legal doctrines of this “hypothetical negotiation” against actual licensing practices. The Article examines a carefully assembled dataset of 400 actual licenses filed with the Securities and Exchange Commission (SEC) and finds divergences between the legal doctrines and actual practices in at least three areas: (i) royalty adjustments based on “ex post” information developed after licensing; (ii) the selection of a proper “royalty base” for the calculation of payments; and (iii) the ways to curb excessive royalties due to the “stacking” of multiple licenses.At a narrow level, this Article recommends that courts and litigants should use a more evidence-based approach to the determination of patent damages, by importing some elements from actual licensing contracts to the existing legal doctrines. At a broader level, it points out certain impediments to implementing the evidence-based approach to law.
