Book excerpt: Cette recherche propose une analyse critique, à la lumière du droit du travail français, de la négociation collective et, plus largement du développement du partenariat social en Russie postsoviétique. Sont ainsi présentés tous les aspects du droit de la négociation collective dans une perspective comparative : la nature juridique de l'accord collectif et de la convention collective de travail, leur place dans la hiérarchie des normes, mais aussi les acteurs du partenariat social (syndicats, organisations patronales, Etat fédéral ou sujets de la Fédération de Russie). Naturellement sont également examinés les principes applicables à la procédure de négociation collective. Dans ce cadre, est étudiée l'effectivité de la norme collective négociée à travers son évolution dans le temps et le contrôle de son application par les parties et le juge. La qualité de source du droit n'a été reconnue à la norme collective négociée que récemment. Sa nature juridique et sa place dans la hiérarchie des normes restent ambiguës. Les acteurs de la négociation collective n'ont découvert ce procédé démocratique qu'après la chute de l'URSS. La faiblesse des acteurs rejaillit sur le contrôle de la norme collective négociée qui demeure imparfait à ce stade de son développement Le manque d'indépendance et d'efficience de la justice sociale russe est un autre obstacle important à l'effectivité de ce contrôle. Et la doctrine russe reste encore marquée par le dogme de l'autorité de l'acte de gouvernement hérité de l'époque soviétique. Pour mettre en lumière ces défectuosités du droit contemporain, l'histoire du droit français et celle du droit russe sont convoquées pour comprendre les dynamiques évolutives qui parfois ont été mises en perspective avec des recherches sociologiques et des données économiques. Ce sujet touchant à la démocratie sociale, est à replacer dans la dynamique des processus de démocratisation postsoviétique dans lesquels sont engagés, avec plus ou moins de bonheur, les pays d'Europe de l'Est.

Book excerpt: Ernst Kantorowicz was a complex figure whose long incident-filled life seemed to embody many of the contradictions of the twentieth century. A Jew from a disputed area between Germany and Poland who fought on the German side in World War I, he first achieved academic success with Frederick II (1927), a work whose language, in Gabrielle Spiegel's words, "often came perilously close to that of the Nazi party" in its desire to see a reconstituted German nation once again dominant on the world stage. Forced to emigrate when the Nazis came to power, Kantorowicz later became embroiled in controversy when, at Berkeley during the McCarthy era, he refused to sign an oath of allegiance designed to identify Communist Party sympathizers. Resigning from Berkeley as a result of the controversy over the loyalty oath, Kantorowicz moved to the Institute of Advanced Study in Princeton, where he remained for the rest of his life and where he wrote his masterpiece, The King's Two Bodies. Kantorowicz the historian, however, had no wish to see his own life become a subject of historical study. When he died in 1963, his will directed that all his personal papers be destroyed. Why had a historian so involved in history wished to erase himself from it? In Kantorowicz: Stories of a Historian, Alain Boureau confronts this question by writing a unique work which is as much a speculation on the nature of biography as it is a biographical study. In the absence of personal records, Boureau seeks to get at the interior life of this enigmatic individual through the recourse of "parallel lives"—real-life figures and characters from novels of the time who were faced with similar crises and who shared aspects of upbringing, training, and circumstance. Book excerpt: International law has long differentiated between international and non-international armed conflicts, traditionally regulating the former far more comprehensively than the latter. This is particularly stark in the case of detention, where the law of non-international armed conflict contains no rules on who may be detained, what processes must be provided to review their detention, and when they must be released. Given that non-international armed conflicts are now the most common form of conflict, this is especially worrying, and the consequences of this have been seen in the detention practices of states such as the US and UK in Iraq and Afghanistan. This book provides a comprehensive examination of the procedural rules that apply to detention in non-international armed conflict, with the focus on preventive security detention, or 'internment'. All relevant areas of international law, most notably international humanitarian law and international human rights law, are analysed in detail and the interaction between them explored. The book gives an original account of the relationship between the relevant rules of IHL and IHRL, which is firmly grounded in general international law scholarship, treating the issue as a matter of treaty interpretation. With that in mind, and with reference to State practice in specific non-international armed conflicts - including those in Sri Lanka, Colombia, Nepal, Afghanistan, and Iraq - it is demonstrated that the customary and treaty obligations of States under human rights law continue, absent derogation, to apply to detention in non-international armed conflicts. The practical operation of those rules is then explored in detail. The volume ends with a set of concrete proposals for developing the law in this area, in a manner that builds upon, rather than replaces, the existing obligations of States and non-State armed groups.
