Book excerpt: " FTA's Capital Investment Grant program provides roughly $2 billion in appropriated funds each year to help states, cities, and localities plan and build new or extensions to existing fixed-guideway transit systems. Under this program, project sponsors-usually local transit agencies-have typically applied for their projects to receive federal funding as either a New Starts or a Small Starts project. In 2012, MAP-21 created a new category of eligible projects called Core Capacity Improvement projects and also revised the process proposed projects must follow to be eligible for and receive federal funding. MAP-21 included a provision for GAO to biennially review FTA's and the Department of Transportation's implementation of this program. This report discusses: (1) FTA's progress in implementing changes to the program required by MAP-21 and (2) how selected project sponsors view the MAP-21 changes and FTA's implementation of those changes. To conduct this review, GAO reviewed the relevant provisions of pertinent laws and FTA's policy guidance, interviewed FTA officials and representatives from 13 project sponsors representing 17 of 52 projects participating in the program, and visited the sites of two Core Capacity Improvement projects.

Book excerpt: Pursuant to a congressional request, GAO reviewed the Federal Transit Administration's (FTA) grant program, focusing on: (1) the effect of FTA oversight weaknesses; (2) FTA and legislative initiatives designed to correct oversight problems; and (3) the mix of FTA regional office and headquarters staff and FTA use of contractors to conduct oversight activities. GAO found that: (1) FTA failed to give high priority to grant oversight and relied on grantees' assurances for proper federal funds management; (2) FTA oversight inadequacies included noncompliance with federal reporting requirements, improper expenditures of grant funds, and grantee financial, technical, procurement, inventory, and management control deficiencies; (3) FTA failed to properly use management oversight tools including triennial reviews, single audits, quarterly progress and financial reports, procurement system reviews, third-party contracting activities, site visits, quarterly project review meetings, and contractor oversight; (4) FTA failed to withhold or suspend funds to compel grantees to comply with requirements and take corrective actions; (5) FTA initiatives and legislative requirements should strengthen grant management and oversight and help reduce grant fraud, waste, abuse, and mismanagement; (6) continued inconsistent, unfocused, and disproportionate staffing oversight problems jeopardized the implementation of new oversight strategies; and (7) FTA spent less than $17 million for contractor oversight responsibilities and failed to provide contractors with oversight guidelines.

The New Starts program-administered by the U.S. Department of Transportation's (DOT) Federal Transit Administration (FTA)-is an important source of new capital investment in mass transportation, providing grants to project sponsors (e.g., state and local government authorities), for the construction of major transit facilities. FTA uses contractors-known as project management oversight contractors (PMOC) and financial management oversight contractors (FMOC)-to help oversee the planning, construction, and financing of major capital projects, including those funded under the New Starts program. This report, as mandated by law, discusses (1) how FTA uses PMOCs and FMOCs to oversee New Starts projects and how the agency procures, monitors, and evaluates the contractors' services; and (2) the benefits of FTA's oversight approach and the challenges FTA faces in conducting its oversight. GAO reviewed applicable statutes, FTA guidance, regulations, and budget data, and interviewed DOT officials, project sponsors, contractors, and industry stakeholders. In 2005, the Safe, Accountable, Flexible, Efficient Transportation Equity Act - A Legacy for Users (SAFETEA-LU) authorized $727 million for JARC for fiscal years 2005 through 2009, changed how these funds were to be awarded after fiscal year 2005, and required FTA to evaluate the program by August 2008. GAO examined (1) SAFETEA-LU's changes to JARC, (2) FTA's progress in implementing these changes, (3) states' and localities' efforts to respond and challenges they have encountered, and (4) FTA's proposed strategy for evaluation and oversight. GAO's work included analyzing program guidance as well as interviewing officials from FTA, industry groups, and more than 30 state and local agencies.
