Book excerpt: The International Criminal Court emerged in the early twenty-first century as an ambitious and permanent institution with a mandate to address mass atrocity crimes such as genocide and crimes against humanity. Although designed to exercise jurisdiction only in instances where states do not pursue these crimes themselves (and are unwilling or unable to do so), the Court's interventions, particularly in African states, have raised questions about the social value of its work and its political dimensions and effects. Bringing together scholars and practitioners who specialise on the ICC, this collection offers a diverse account of its interventions: from investigations to trials and from the Court's Hague-based centre to the networks of actors who sustain its activities. Exploring connections with transitional justice and international relations, and drawing upon critical insights from the interpretive social sciences, it offers a novel perspective on the ICC's work. Book excerpt: In the 1990s, the promise of justice for atrocity crimes was associated with the revival of international criminal tribunals (ICTs). More recently, however, there has been a renewed emphasis on domestic accountability for international crimes across the globe. In identifying a 'complementarity turn', a paradigm shift toward domestic accountability in the field of international criminal justice, this book investigates how the shadow of international criminal tribunals influences the treatment of serious crimes at the national level. Drawing on research and interviews in Rwanda, the Democratic Republic of Congo, and Sierra Leone, this book develops a tripartite framework to analyse how states and tribunals work with, despite, or against one another in the fight against impunity. While international prosecutors and judges use the principle of complementarity to foster cooperation and decrease tension with government actors, Patryk I. Labuda argues that too much deference by ICTs toward states reduces the likelihood of accountability and may enable national elites to consolidate authoritarian power. By interrogating how international accountability stakeholders relate to their domestic counterparts, International Criminal Tribunals and Domestic Accountability advocates improvements to ICTs' institutional design and more dynamic interactions with states to strengthen the enforcement of international criminal law.

Parcourant l’Europe occidentale, il se veut méthodologique et initiateur, éclairant une réalité transnationale à l’aide d’études de cas, inscrites dans le temps et l’espace. Until recently, the history of military justice has been largely neglected. As a hybrid concept, it has for many years been the subject of hasty judgments from both military institutions and lawyers. Members of the military institutions kept repeating harsh criticisms while the lawyers kept justifying themselves. This volume brings together 20 contributions that focus on the early 20th century in Western Europe with the aim of examining the tensions, practices and limitations of military justice during the two World Wars. In doing so, it uses a methodological and original approach, from the perspective of transnational reality and uses case studies from a range of countries at different times. The contributions were all presented during multiple seminars held at the Maison des sciences de l’Homme between 2004 and 2008. Using a comparative perspective, these seminars explored the evolution of the military justice system since the 16th century.

She shows how the war radicalised captivity treatment in Britain, France and Germany, dramatically undermined international law protecting prisoners of war and led to new forms of forced prisoner labour and reprisals, which fuelled wartime propaganda that was often based on accurate prisoner testimony. This book reveals how, during the conflict, increasing numbers of captives were not sent to home front camps but retained in western front working units to labour directly for the British, French and German armies - in the German case, by 1918, prisoners working for the German army endured widespread malnutrition and constant beatings. Dr Jones examines the significance of these new, violent trends and their later legacy, arguing that the Great War marked a key turning-point in the twentieth-century evolution of the prison camp.

Lake shows that state fragility in DR Congo has created openings for human rights NGOs to influence legal processes in ways that have proved impossible in countries like South Africa, where the state is stronger. Yet exploiting opportunities presented by state fragility to pursue narrow human rights goals invites a host of new challenges.
