Einzelne Geldbußen können Größenordnungen von mehreren hunderttausend Euro erreichen. Das Rechtshandbuch über Ordnungswidrigkeiten in Rundfunk und Telemedien gilt zwischenzeitlich als Standardwerk. Es ist auf die Bedürfnisse der Praxis zugeschnitten ohne auf wissenschaftlichen Anspruch zu verzichten. Mit einem Überblick über den praxisrelevanten allgemeinen Teil des Ordnungswidrigkeitenrechts, ausführlichen Erläuterungen der materiellen Bußgeldtatbestände und wichtigen Hinweisen zum Verfahrensrecht gibt das Handbuch Orientierung in einem vielgestaltigen Rechtsgebiet mit nicht immer einfach zu bestimmenden Zuständigkeiten der Bußgeldbehörden. Anspruch ist es, Anbietern von Telemedien, Plattformbetreibern und Rundfunkveranstaltern das Rüstzeug für eine sorgfältige Compliance an die Hand zu geben. Das erscheint gerade vor dem Hintergrund der Aufsichtspflichtverletzung von Geschäftsführern (§ 130 OWiG) und hoher Verbandsgeldbußen, die gegen das Unternehmen verhängt werden können (§ 30 OWiG), als unverzichtbar. Genauso finden Bußgeldbehörden, Staatsanwälte und Strafrichter hier die notwendigen Informationen zur richtigen Beurteilung der Ordnungswidrigkeiten in Rundfunk und Telemedien, zu denen erst spärliche Rechtsprechung existiert. Der Autor leitet als Justiziar den Bereich Recht der Bayerischen Landeszentrale für neue Medien in München und ist Honorarprofessor an der rechts- und wirtschaftswissenschaftlichen Fakultät der Johannes Gutenberg-Universität Mainz. Er kommentiert die Bußgeldbestimmungen im führenden Loseblattkommentar von Hartstein/Ring/Kreile/Dörr/Stettner/Cole zum Rundfunkstaatsvertrag und Jugendmedienschutz-Staatsvertrag sowie die Bußgeldvorschriften des Telemediengesetzes im neuen Online-Kommentar von Gersdorf/Paal, BeckOK Informations- und Medienrecht. Darüber hinaus hat sich der Autor als Initiator und Mitherausgeber des Loseblattkommentars von Bornemann/v.Coelln/Hepach/Himmelsbach/Lörz zum Bayerischen Mediengesetz sowie mit zahlreichen Veröffentlichungen in juristischen Fachzeitschriften einen Namen gemacht. Book excerpt: This book identifies and explains the different national approaches to data protection – the legal regulation of the collection, storage, transmission and use of information concerning identified or identifiable individuals – and determines the extent to which they could be harmonised in the foreseeable future. In recent years, data protection has become a major concern in many countries, as well as at supranational and international levels. In fact, the emergence of computing technologies that allow lower-cost processing of increasing amounts of information, associated with the advent and exponential use of the Internet and other communication networks and the widespread liberalization of the trans-border flow of information have enabled the large-scale collection and processing of personal data, not only for scientific or commercial uses, but also for political uses. A growing number of governmental and private organizations now possess and use data processing in order to determine, predict and influence individual behavior in all fields of human activity. This inevitably entails new risks, from the perspective of individual privacy, but also other fundamental rights, such as the right not to be discriminated against, fair competition between commercial enterprises and the proper functioning of democratic institutions. These phenomena have not been ignored from a legal point of view: at the national, supranational and international levels, an increasing number of regulatory instruments – including the European Union’s General Data Protection Regulation applicable as of 25 May 2018 – have been adopted with the purpose of preventing personal data misuse. Nevertheless, distinct national approaches still prevail in this domain, notably those that separate the comprehensive and detailed protective rules adopted in Europe since the 1995 Directive on the processing of personal data from the more fragmented and liberal attitude of American courts and legislators in this respect. In a globalized world, in which personal data can instantly circulate and be used simultaneously in communications networks that are ubiquitous by nature, these different national and regional approaches are a major source of legal conflict.

This noise results from the always dangerous combination of wishful thinking on the part of research and industry and of a lack of clear understanding of how Web services came to be. On the one hand, multiple contradictory interpretations are created by the many attempts to realign existing technology and strategies with Web services. On the other hand, the emphasis on what could be done with Web services in the future often makes us lose track of what can be really done with Web services today and in the short term. These factors make it extremely difficult to get a coherent picture of what Web services are, what they contribute, and where they will be applied. Alonso and his co-authors deliberately take a step back. Based on their academic and industrial experience with middleware and enterprise application integration systems, they describe the fundamental concepts behind the notion of Web services and present them as the natural evolution of conventional middleware, necessary to meet the challenges of the Web and of B2B application integration. The rights of the citizens in Europe are protected by the European Fundamental Rights and Freedoms. The aim of this textbook is to grasp and illustrate the meaning of these rights and to integrate it into a coherent system. For this purpose the book not only deals with the pertinent law of the European Union and the European Community, but also with the European Convention for the Protection of Human Rights and Fundamental Freedoms which, too, is becoming more and more important. In addition, regard is had to the Charter of Fundamental Rights of the Union which forms part of the Treaty establishing a Constitution for Europe. Although the Charter is not yet legally binding since the Constitution has not been ratified by all EU Member States, the Community Courts already make reference to it as a concentrate of the constitutional traditions common to the Member States. It therefore does not seem entirely unlikely that the Charter might be included into the existing Treaties irrespective of the future constitutional developments on the EU level. On a similar anticipatory basis the book also takes into account those Protocols to the European Convention for the Protection of Human Rights and Fundamental Freedoms that have not yet entered into force.
