Book excerpt: This book analyses the EU's Constitutional Treaty, which emerged in draft form from the European Convention in the summer of 2003 and which was finalised by an Intergovernmental Conference (IGC) in June 2004. It describes the main novelties of the treaty and looks at policies of important actors, Member States and Community actors (the Commission and European Parliament) and the roles played by the Convention and the Italian and Irish Presidencies during the process of deliberation and negotiation that produced the treaty. It further studies the failure of ratification in France and the Netherlands and the implications for the process of European integration of this failure. It finally touches on the question whether a constitutional equilibrium has been reached. Since the new Lisbon Treaty negotiated in 2007 contains much of what was in the Constitutional Treaty the analyses of the book remain pertinent for this latest EU treaty.

The very limited power to issue sanctions has often been deemed a gap in the EC legal order. Over the years, the situation has progressively changed. In addition, the so-called competence creep has led the EU to play an increasingly prominent role in several areas of EU law enforcement, including the issuing of sanctions. This book examines these developments, focusing on both the general features of the EU legal order and the analysis of key-substantive areas, such as banking and monetary union, environmental law, and data protection. Book excerpt: This publication brings together the texts adopted by the Congress of Local and Regional Authorities of the Council of Europe. The Congress, a consultative body of the Council of Europe, is made up of two chambers: one representing local authorities, the other the regions. Its aim is to reinforce democratic structures at local and regional level, and in particular to help the newly-emerging democracies in central and eastern Europe. The Congress meets once a year in Strasbourg, and is open to delegations from other European organisations which have consultative status with the Council, as well as to special guests or observers from some countries which are not members of the Organisation. The Congress adopts three different types of texts: recommendations, opinions and resolutions. Recommendations are proposals to the Committee of Ministers, and their application is left up to each member government. Sometimes they are also addressed to other international organisations. Opinions usually refer to questions to the Congress from the Committee of Ministers or the Parliamentary Assembly. The Committee of Ministers and the Parliamentary Assembly consult the Congress on questions which are likely to affect the competence and the basic interests of the local and regional authorities which the Congress represents. Resolutions reflect the décisions that the Congress is authorised to take, or make recommendations to local and/or regional authorities and their associations.
