Book excerpt: Novelty and non-obviousness (inventive step) are patentability requirements designed to ensure a minimum of technological quality for protected inventions. Their effectiveness requires the assumption that private values of patents are positively correlated with technological quality as defined by the patent offices. This premise is taken for granted in classical industries and has recently been taken up for revision in "modern" patenting areas like business methods, but is untested for either one of them. This paper suggests an original test to disentangle the impact of (objective) technological quality - as defined by the patent offices - on private patent value. To do so, the theoretical links between private values of patents, technological invention quality, incentives to oppose patents before the European Patent Office (EPO), and observable patent characteristics are translated into a structural discrete choice equation model. Applying the model to polymer patent data between 1978 and 1990, the paper eventually confirms the assumption that for the chosen sample, objective technological quality enhances the private value of a patent and supports the effectiveness of novelty and inventive step as policy levers. At the same time, the paper refines the understanding of how patent-based measures such as citations are correlated with a patent's commercial value.

Despite the large variety of empirical studies in the field, however, the precise meaning of these indicators and their obvious relation to patent value is still based on assumptions and intuitions. This paper provides the first empirical test of patent indicators as value measures in the structural form. It disentangles the different effects reflected in patent indicators and enhances our understanding why inventions are valuable at all. Using a newly assembled data set on European polymer patents, current assumptions on the innovation incentives set by patentability requirements (novelty, inventive activity) are tested. The estimations are carried out using a custom-tailored two stage discrete choice probit model yet unknown in the literature. The results support the assumptions that novelty and inventive activity enhance a patent's value. They confirm the importance of backward citations, family size, and forward citations as va lue indicators. However, they expand on and partly break with the respective explanations why patent indicators correlate with profitability.

The rate of innovation initially rises as this standard is raised from very low levels, but eventual falls as the standard is raised to very high levels. Hence there is a unique patentability standard that maximizes the rate of innovation. Surprisingly, this critical standard is more stringent for industries disposed to innovate rapidly. The model suggests a number of important implications for patent policy.

Book excerpt: Invention arises from novel combinations of prior technologies. However, prior studies of creativity have suggested that overly novel combinations may be harmful to invention. Apart from the factors of expertise, market, etc., there may be such a thing as 'too much' or 'too little' novelty that will determine an invention's future value, but little empirical evidence exists in the literature. Using technical patents as the proxy of inventions, our analysis of 3.9 million patents identifies a clear 'sweet spot' in which the mix of novel combinations of prior technologies favors an invention's eventual success. Specifically, we found that the invention categories with the highest mean values and hit rates have moderate novelty in the center of their combination space and high novelty in the extreme of their combination space. Too much or too little central novelty suppresses the positive contribution of extreme novelty in the invention. Furthermore, the combination of scientific and broader knowledge beyond patentable technologies creates additional value for invention and enlarges the advantage of the novelty sweet spot. These findings may further enable data-driven methods both for assessing invention novelty and for profiling inventors, and may inspire a new strand of data-driven design research and practice.
