Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Available in PDF, EPUB and Kindle. Book excerpt: The Sixteenth Amendment's interpretation and application have been widely contested on multiple fronts throughout the last century, especially where enforcement of the individual income tax is concerned. This contestation has fascinated and enraged scholars for decades as some who have protested the tax's legal legitimacy have raised some logically compelling arguments against some aspect or another, while others have readily embraced the tax and enshrined it in its entirety with a resolve to defend it as if to their last dying breath. Sadly, the defense camp of the law, the preachers of unchallenged acceptance, has all but suffocated what otherwise could be a robust discussion of possible illegitimacy and unconstitutionality of some forms of this taxation. Indeed, today, “an aura of sanctifying mysticism shrouds the concept of taxation itself.” “The concept of taxation has been so elevated from critical evaluation by the citizenery [sic] that only the foolhardy or very bold dare offer a challenge. For the very act of challenging a concept opens one to ridicule, harassment, scorn, chastisement, and banishment.” Some protests against our system of income taxation as enforced today, because protesting taxation has been so repeatedly shamed, have not yet been dealt with adequately on their logical merits. Courts accept as prima facie “frivolous” any protest arguments raised on certain grounds, no matter how compelling the logic, and so the principles of the argument remain unaddressed but quickly dismissed. This text will discuss some of the logical arguments posed both for and against the constitutionality and legality of the federal individual income tax as it is enforced today. The author concludes that the federal individual income tax, as presently imposed and enforced, is arguably unconstitutional pursuant to the Fourth and Fifth Amendments and pursuant to the doctrines laid down and never overturned by the Supreme Court. Furthermore, the author concludes that the present federal individual income tax is contrary to public policy where it is the quintessence of the graduated income tax, one of the ten pillars of the Communist Manifesto.

Available in PDF, EPUB and Kindle. Book excerpt: In America’s Constitution, one of this era’s most accomplished constitutional law scholars, Akhil Reed Amar, gives the first comprehensive account of one of the world’s great political texts. Incisive, entertaining, and occasionally controversial, this “biography” of America’s framing document explains not only what the Constitution says but also why the Constitution says it. We all know this much: the Constitution is neither immutable nor perfect. Amar shows us how the story of this one relatively compact document reflects the story of America more generally. (For example, much of the Constitution, including the glorious-sounding “We the People,” was lifted from existing American legal texts, including early state constitutions.) In short, the Constitution was as much a product of its environment as it was a product of its individual creators’ inspired genius. Despite the Constitution’s flaws, its role in guiding our republic has been nothing short of amazing. Skillfully placing the document in the context of late-eighteenth-century American politics, America’s Constitution explains, for instance, whether there is anything in the Constitution that is unamendable; the reason America adopted an electoral college; why a president must be at least thirty-five years old; and why–for now, at least–only those citizens who were born under the American flag can become president. From his unique perspective, Amar also gives us unconventional wisdom about the Constitution and its significance throughout the nation’s history. For one thing, we see that the Constitution has been far more democratic than is conventionally understood. Even though the document was drafted by white landholders, a remarkably large number of citizens (by the standards of 1787) were allowed to vote up or down on it, and the document’s later amendments eventually extended the vote to virtually all Americans. We also learn that the Founders’ Constitution was far more slavocratic than many would acknowledge: the “three fifths” clause gave the South extra political clout for every slave it owned or acquired. As a result, slaveholding Virginians held the presidency all but four of the Republic’s first thirty-six years, and proslavery forces eventually came to dominate much of the federal government prior to Lincoln’s election. Ambitious, even-handed, eminently accessible, and often surprising, America’s Constitution is an indispensable work, bound to become a standard reference for any student of history and all citizens of the United States.
