In this second edition, Brian Orend builds on the substantial strengths of the first, adding important new material on: cyber-warfare; drone attacks; the wrap-up of Iraq and Afghanistan; conflicts in Libya and Syria; and protracted struggles (like the Arab-Israeli conflict). Updated and streamlined throughout, the book offers new research tools and case studies, while keeping the winning blend of theory and history featured in the first edition. This book remains an engaging and comprehensive examination of the ethics, and practice, of war and peace in today’s world.

Available in PDF, EPUB and Kindle. Book excerpt: Law in the Age of Pluralism contains a collection of essays on the intersection of legal and political philosophy. Written within the analytical tradition in jurisprudence, the collection covers a wide range of topics, such as the nature of law and legal theory, the rule of law, the values of democracy and constitutionalism, moral aspects of legal interpretation, the nature of rights, economic equality, and more. The essays in this volume explore issues where law, morality and politics meet, and discuss some of the key challenges facing liberal democracies. Marmor posits that a liberal state must first and foremost respect people's personal autonomy and their differing, though reasonable, conceptions of the good and the just. This basic respect for pluralism is shown to entail a rather skeptical attitude towards grand theories of law and state, such as contemporary constitutionalism or Dworkin's conception of 'law as integrity'. The values of pluralism and respect for autonomy, however, are also employed to justify some of the main aspects of a liberal state, such as the value of democracy, the rule of law, and certain conceptions of equality. The essays are organized in three groups: the first considers the rule of law, democracy and constitutionalism. The second group consists of several essays on the nature of law, legal theory, and their relations to morality. Finally, the collection concludes with essays on the nature of rights, the limits of rights discourse, and the value of economic equality.

Two volumes. Reprinted 2003 by The Lawbook Exchange, Ltd. LCCN 2002044392. ISBN 1-58477-345-6. Cloth $160. * Reprint of second edition. First published in 1838 and 1839, Lieber's Manual of Political Ethics, a comprehensive theory of the state, is one of his most significant and influential works. It was one of the first treatises on political science, and the first written in the United States. Strongly influenced by German Idealism, it argues that the state is the ultimate expression of humanity's ancient quest for moral, ethical and spiritual fulfillment. As much a work of advocacy as it is of theory, it urges the reader to consider the moral obligations that arise from his participation in government and other civil institutions. Lieber's influence as an educator will make the work of interest to scholars of legal education as well as students of law and government. Theodore D. Woolsey [1801-1889], a professor at Yale (and later its president), was one of the founding fathers of American political science.

Available in PDF, EPUB and Kindle. Book excerpt: At a point in history marked by dramatic challenges to the existing political and social order, the question of legal and political obligation emerges as a focal point of international concern. Amid the clamor for radical change in the established order, theories of political obligation demand renewed examination. In this volume, eighteen leading specialists in the legal, philosophical, and political science aspects of the question offer their views on this timely topic. Part I examines the nature of moral, legal, and political obligation. The first essay presents a set of definitions that denies the very existence of obligation. While the second essay disagreeing particularly with respect to the relationship of political to moral tenets, and the third discussing the highly complex interplay between law and morality. The following essay approaches obligation as existing in the context of an established political and legal system and stresses the importance of evaluating the negative consequences of challenges to the law as well as those arising from the absence of challenges. The next paper maintains that political obligation is so complex that its very existence depends upon rational deliberation in particular contexts. The fifth, explores four significant theories but accepts only the one based on the broadest definition of obligation. While the final essay in this part considers political obligation a unique and generalized moral obligation. Part II takes up the conditions of obligation and of obedience. The first essay in this part discusses the conditions necessary to generate a "felt obligation." The second paper, concentrates on exposing key obstacles to empirical proof that behavior is or is not motivated by "felt obligation." While the third draws upon a large body of literature and court decisions dealing with compliance to the law. The forth essay is a case study of Rome probes the role of obligation during that city's seven cent

Book excerpt: Natural Law: Morality and Obedience This short opus is part of a collection of a larger body of work, which are dedicated to the subject of law or legal obligation. This installment focuses on natural law. The goal here is to elucidate the essentiality of citizen obedience. Another goal here is to make the case that, while in theory the notion of natural law seems to contradict the concept known as positive law, when it comes to legal obligation (in practice of course), any distinction, if it were to exist at all, is negligible. This text examines the degree to which natural law (as presently understood) could explicate the reason people may feel obligated to obey laws. The book further explores the rationale for legal obedience in terms of morality and reason. It examines popular legal precepts, notably positive law and other doctrines related to natural law. The arguments echoed throughout the text are unique. But it is important to point out that a full appreciation of the notion of Natural Law may require some anterior understanding about the concept of Legal Theory. I encourage you to keep a positive outlook as you navigate the manuscript.
