Available in PDF, EPUB and Kindle. Book excerpt: This new edited volume examines contemporary European security from three different standpoints. It explores security dynamics, first, within Europe; second, the interaction patterns between Europe and other parts of the world (the United States, Africa, the Middle East, China and India); and, finally, the external perceptions of European security. The first part of the book analyses the European security landscape. The roles of EU, NATO and the OSCE are given particular attention, as is the impact of their evolution- or enlargement- on the European security architecture and European security dynamics. In this context, Russia’s repositioning as a major power appears as a shaping factor of contemporary European geopolitics. The second part presents European security from an external perspective and considers interactions between Europe and other states or regions. Security trends and actors in Europe are examined from an American, Chinese, and Indian perspective, while Europe--Africa and Europe--Middle East relations are also addressed. This book will be of great interest to students of European Security, European politics and IR in general.

Available in PDF, EPUB and Kindle. Book excerpt: At first, it was believed that accession to the EU would have a positive effect on the process of democratization in former communist countries. However, over time it became clear that difficulties with the democratic system endured in a number of these countries. This book reconsiders the results of the process of democratization in Central and Eastern Europe and evaluates the nature and effectiveness of the Europeanization process. It comparatively explores the process of democratic consolidation and accession to the European Union in Poland, Slovakia and Bulgaria. Using these case studies, the book assesses the impact of the EU on the accountability and integrity of governments in this part of Europe. This text will be of key interest to scholars and students of democratization studies, European studies, EU studies, transition studies, area studies, and international relations.

Available in PDF, EPUB and Kindle. Book excerpt: Thirty years after Bulgaria’s democratic breakthrough, this book provides a “balance sheet” of the country’s democratic institutions through a number of interdisciplinary contributions. The volume is organized around three themes—democratic institutions, civil society, and European Union (EU) processes—and examines such topics such as voting, political parties, populism, media, civil society organizations, identity, and the rule of law. While the contributors argue that Bulgaria’s democracy is successful in terms of the procedural norms of democracy, civic participation, and compliance with EU rules, they also identify serious problem areas. Bulgaria’s democratic institutions struggle with obstacles such as populist Euroscepticism, political elitism, corruption, and a lack of political accountability, though this volume fully acknowledges the historical development of Bulgarian democracy, including its achievements and continuing setbacks.

Book excerpt: The Balkan countries have responded differently to the EU’s conditional offer of membership. This book examines the diverging compliance patterns of the Balkan accession states and asks why some of them have complied substantially, some only partially and others have defied the EU. The book examines the compliance of the Balkan states with the EU accession conditionality, arguing that the variation in the compliance behavior of Balkan governments hinges on three main factors – the legitimacy of the EU conditions as seen domestically in the accession states, the costs of compliance and the EU’s ability and willingness to use its superior power resources to impose compliance when faced with domestic defiance. Placing important events from the most recent political history of the Balkans in a broader historical perspective, the author evaluates the successes and failures of the EU’s state building policies in the Balkans, a geographical area of the highest priority for the EU’s foreign policy and a test case for the EU’s capacity and willingness for foreign policy action. Based on detailed empirical data, European Foreign Policy and the Challenges of Balkan Accession will be of interest to scholars and students of EU and comparative politics, and those focusing on policy impact in EU integration.

Available in PDF, EPUB and Kindle. Book excerpt: The European Union (EU) was launched as a response to the economic dominance of the United States and – to a lesser degree – the Soviet Union. The nations of Western Europe were too small to compete against large scale and diversi?ed economies on their own. Six countries, eventually expanding to 27 (and counting), took a series of steps toward progressively deeper integration: the removal of int- nal tariffs, the construction of a common external tariff, the elimination of many (but not all) non-tariff barriers leading to a single market, and the adoption of a c- mon currency by 15 of the member states. The EU today equals and even exceeds the U. S. on many key indicators of performance. In the process, two similar but nonetheless divergent models of social and economic life stand in contrast with each other. The U. S. is more committed to capitalism and does little to dilute its harsh edges while the nations of Europe support wider social safety nets and more active regulation of commercial activity to mute the crueller aspects of the free-market. Until recently, the economic dynamism of the U. S. called into question whether the so-called European social model was sustainable in an era of globalization. The EU was slipping in competitiveness and was being challenged by new global pow- houses like China and India. Although the U. S. economy has slowed, there is little indication that European countries are capable of leveraging the situation to their advantage.

Available in PDF, EPUB and Kindle. Book excerpt: This book fills a significant gap in recent literature on European Union politics by examining the EU’s ‘other’ eastern enlargement, completed in 2007 with the accession of Bulgaria and Romania. It focuses on both the process and the effects of the 2007 enlargement within the wider context of the post-communist countries’ accession to the EU, and, more broadly, within the context of the history of EU enlargement. The book brings together in-depth analyses of a wide range of issues, both from a comparative perspective and through single case studies. Individual contributions shed new light onto EU enlargement through a theoretical re-evaluation of the ‘strategic action’ paradigm, as well as through historical analyses of the 2007 enlargement and of its implications for future EU enlargements. Further insight into the process of EU enlargement is gained through systematic exploration of the impact of accession on policy-making and institutional structures in Bulgaria and Romania. Altogether, the contributions exemplify the multi-faceted nature of EU enlargement and accession, as well as the extent to which the process of acceding to the EU is not completed with membership, either for the EU or for the candidate countries. This book was published as a special issue of Perspectives on European Politics and Society.

Book excerpt: This book sets out the way that, through enhanced private antitrust enforcement reform, private international law has a pivotal role in EU competition law disputes with an international element. The author offers a thorough analysis of the post-2003 policy of the EU favouring private law enforcement of EU competition law and its implementation under the existing provisions for jurisdiction and recognition and enforcement of foreign judgments under the Brussels I regime. The book also considers how the jurisdiction, recognition and enforcement of judgments issues are dealt with in England under the common law rules applicable when Brussels I does not apply. The complex private international law problems in respect of cross-border class actions that have arisen in several countries, as well as judgments in relation to antitrust infringements, are also discussed. The author further examines the choice of law issues that may arise before the English courts under Rome I and Rome II. The potential problems regarding jurisdiction of arbitral tribunals and choice of law in arbitral proceedings in relation to EU competition law claims, and the jurisdiction of English courts in proceedings ancillary to arbitration claims, are dealt with accordingly. This title is included in Bloomsbury Professional's International Arbitration online service.

Book excerpt: This book analyzes the effects of European Union membership conditionality on institutional reforms in Eastern Europe, building on concrete examples from four sectors in Albania and Macedonia, two postcommunist countries that have yet to join the EU. The author discusses the theory of “consociational democracy,” often considered the key to stabilizing deeply divided countries, and reapplies it on the international stage to argue for how the EU can better direct democratization.

The strong comparative component provides a thought-provoking international perspective, while at the same time allowing readers to gain unique insights into litigation in English courts. Three important themes of the book analyse how the international element may call into question the power of the court to hear the case, whether it should exercise this power, whether foreign law applies, and whether the court should take into account any foreign judgement. Hartley provides the reader with extracts from leading cases and relevant legislation, together with an extensive reference library of further reading for those who wish to explore the topic in more detail, making this a valuable, single-source textbook. The title will benefit from a companion website, setting out all relevant case law developments for the students.

Available in PDF, EPUB and Kindle. Book excerpt: Family justice requires not only a legal framework within which personal obligations are regulated over the life course, but also a justice system which can deliver legal information, advice and support at times of change of status or family stress, together with mechanisms for negotiation, dispute management and resolution, with adjudication as the last resort. The past few years have seen unparalleled turbulence in the way family justice systems function. These changes are associated with economic constraints in many countries, including England and Wales, where legal aid for private family matters has largely disappeared. But there is also a change in ideology in a number of jurisdictions, including Canada, towards what is sometimes called neo-liberalism, whereby the state seeks to reduce its area of activity while at the same time maintaining strong views on family values. Legal services may become fragmented and marketised, and the role of law and lawyers reduced, while self-help web based services expand. The contributors to this volume share their anxieties about the impact on the ability of individuals to achieve fair and informed resolution in family matters.
