Available in PDF, EPUB and Kindle. Book excerpt: This book is open access under a CC BY-NC 4.0 license. It explores the diverse phenomena which are challenging the international law of the sea today, using the unique perspective of a simultaneous analysis of the national, individual and common interests at stake. This perspective, which all the contributors bear in mind when treating their own topic, also constitutes a useful element in the effort to bring today’s legal complexity and fragmentation to a homogenous vision of the sustainable use of the marine environment and of its resources, and also of the international and national response to maritime crimes. The volume analyzes the relevant legal frameworks and recent developments, focusing on the competing interests which have influenced State jurisdiction and other regulatory processes. An analysis of the competing interests and their developments allows us to identify actors and relevant legal and institutional contexts, retracing how and when these elements have changed over time.

Vlasic explore the new frontiers and wealth and resources that are altering the patterns of the world economy. Since rapid and dramatic technological progress poses problems that can be solved only by international or multinational controls these legal specialists emphasize the urgent need for nonviolent measures capable of reconciling the interests of the wealthy and impoverished nations and of satisfying the rising demands of the underdeveloped world for participation in the scientific revolution. The existing situation and current trends are described, and detailed recommendations to strengthen the role of international law in the decades ahead are made. Originally published in 1970. The Princeton Legacy Library uses the latest print-on-demand technology to again make available previously out-of-print books from the distinguished backlist of Princeton University Press. Book excerpt: It is a truism that the increasingly rapid movement in technology is forcing change and shift in the norms of international law. The 149 states of the Law of the Sea Conferences of the United Nations have been attempting to establish and develop adequate legal norms that will take into account the need for the orderly growth and use of the changing technological capabilities and the resulting economic development that cannot and should not be hindered by in adequate law. When such norms are identified and agreed by a substantial majority of states, they are usually set out and placed into multilateral treaties. The rules governing the resource and non-resource allocation of the oceans and the uses ofthe oceans have posed major difficulties for the development of international law for many years. The Geneva Conference of 1958 building upon the groundwork of the International Law Commission of the United Nations shaped a rough structure for a 20th Century Law of the Seas and for mulated the effort in four major international conventions. But a majority of the states failed to ratify or accede to the conventions. Even had they become effec tive as the expression of the Law of the Seas in the second half of the 20th Cen tury, there was one glaring area of omission: a conventional law for the waters of mid-ocean archipelagos and archipelagic states.

Book excerpt: The issues of conflict management treated in this volume are relatively recent consequences of the scientific and technological revolution, and are in significant respects unprecedented in man's history: food distribution, population, ocean resources, air and water pollution. Such new global problems cannot be adequately solved except by international effort—effort that requires adjustments in the present international system. What adjustments arc practicable, and at least minimally necessary, are assessed by seventeen lawyers and specialists in international affairs. They approach the subject from two perspectives: the international legal aspects of man in his environment; and the institutions, agencies, and movements that must be further adapted to the rapidly changing needs of mankind. Contributors: Harold Lasswell, Mary Ellen Caldwell, Dennis Livingston, Howard J. and Rita F. Taubenfeld, L.F.E. Goldie. Leon Gordenker, John Carey, Hans Baade, Gidon Gotlieb, Richard B. Lillich, Joseph Nye, Donald McNemar, James Patrick Sewell, Gerald F. Sumida, Harold and Margaret Sprout. Originally published in 1972. Book excerpt: This is the last of three volumes dealing with the International Legal Environment (see list in back of book), included in the Collected Research Studies of the Royal Commission on the Economic Union and Development Prospects for Canada. The Third United Nations Conference on the Law of the Sea (UNCLOS 3) culminated in the adopted of the United Nations convention on the law of the sea in 1982. Since then 150 countries, including Canada, have signed this historic treaty. It affects Canada's four major ocean industries: fishing, offshore petroleum, shipping and ocean mining. As Canada contemplates ratification of this agreement, it must consider these as well as several other maritime matters, including transit management, offshore development, marine-technology development and ocean-science policy. This volume delineates the issues and their implications for Canada's future at sea, and recommends the establishment of an independent advisory body to ensure serious and comprehensive treatment of maritime concerns.

Available in PDF, EPUB and Kindle. Book excerpt: A counterintuitive and compelling argument that existing laws already protect the entirety of our oceans—and a call to understand and enforce those protections. The world’s oceans face multiple threats: the effects of climate change, pollution, overfishing, plastic waste, and more. Confronted with the immensity of these challenges and of the oceans themselves, we might wonder what more can be done to stop their decline and better protect the sea and marine life. Such widespread environmental threats call for a simple but significant shift in reasoning to bring about long-overdue, elemental change in the way we use ocean resources. In Future Sea, ocean advocate and marine-policy researcher Deborah Rowan Wright provides the tools for that shift. Questioning the underlying philosophy of established ocean conservation approaches, Rowan Wright lays out a radical alternative: a bold and far-reaching strategy of 100 percent ocean protection that would put an end to destructive industrial activities, better safeguard marine biodiversity, and enable ocean wildlife to return and thrive along coasts and in seas around the globe. Future Sea is essentially concerned with the solutions and not the problems. Rowan Wright shines a light on existing international laws intended to keep marine environments safe that could underpin this new strategy. She gathers inspiring stories of communities and countries using ocean resources wisely, as well as of successful conservation projects, to build up a cautiously optimistic picture of the future for our oceans—counteracting all-too-prevalent reports of doom and gloom. A passionate, sweeping, and personal account, Future Sea not only argues for systemic change in how we manage what we do in the sea but also describes steps that anyone, from children to political leaders (or indeed, any reader of the book), can take toward safeguarding the oceans and their extraordinary wildlife.

Book excerpt: A treasure lies at the bottom of the oceans. This treasure takes the form of a legal and ethical principle which may illuminate the potential for an enriching international community in a world of growing disparities. It is the principle of the Common Heritage of Humanity. The 1982 United Nations Convention on Law of the Sea delineated an Area and then proclaimed the Area and its resources `the common heritage of mankind'. The author suggests that the terms `common', `heritage', and `humanity' invite a larger perspective on the law underlying the Convention. Cries of the Sea provides a unique view of `the deep blue sea' through the lens of the politics of international ocean law and policy and in particular through the exposition of the Common Heritage of Humanity as a fundamental principle of international law. The book explains why - and how - the Common Heritage principle constitutes an indispensable ingredient in any global programme for sustainable development. Legal philosophers and practitioners alike, in the ocean arena and beyond, will find that this work offers an intriguing intellectual and moral challenge. This book received the first Arvid Pardo Prize for outstanding scholarship on the Law of the Sea.
