Thus the reports of the rail committee of the American Railway Associa tion1 show 36 641 rail failures, in 12 688 714 tons laid, for the year ending October 31, 1911, and 61 047 failures for 13 736 956 tons in 1912. It is natural, on the one hand, for the rail manufacturer to claim that the railroads, with their increased speed and weight of trains, are mainly responsible for this condition, and that the rails now made are better than ever before; and, on the other hand, for the railroads to claim that the fault lies mainly with the rail manu facturer, who might furnish a sounder product. With the many deplorable and still unsettled aspects of this very vital question this paper makes no pretension of dealing.
