Diante disso, buscou-se apresentar os desafios das políticas de atendimento infanto-juvenis, de acordo com uma perspectiva histórica e cultural, desde as primeiras décadas do século XVIII até a aplicação das medidas socioeducativas de internação – como meio de privativo de liberdade – previstas pelo Estatuto da Criança e do Adolescente (ECA) e reiteradas pelo Sistema Nacional de Atendimento Socioeducativo (SINASE). As determinações da criminalização após o processo de institucionalização têm como fonte a perda de pertencimento dos sujeitos acolhidos, fragilizando assim as possibilidades destes em encontrarem sentido e perspectivas para o futuro. As condições e o modo de vida das crianças e adolescentes retratam a vulnerabilidade e o fator de risco social, a desfiliação (devido ao afastamento gerado entre a criança e a família natural), a falta de base educacional e qualificação para o trabalho. Com isso, abrem-se as portas das drogas e do mundo criminoso, como forma ilusória de aliviar o sofrimento, experimentar novas formas de interação, adquirir visibilidade e o tão sonhado pertencimento. Na esfera privada – qual seja as relações familiares e do contexto social próximo – os adolescentes vivenciam a ruptura de vínculos e carecem da intervenção do Estado quanto à efetivação de políticas públicas que fomentem a resiliência. Os adolescentes reincidentes, além disso, passam despercebidos pelas estruturas do Estado ou são excluídos por não corresponderem aos padrões de comportamento desejado (ou esperado), dado o problema dos estigmas ou rótulos sociais criados pela sociedade. Assim, apesar dos progressos conceituais acerca dos direitos e garantias infanto- juvenis, preponderam práticas punitivas em detrimento ao caráter socioeducativo das medidas, perdendo totalmente o sentido para os jovens. O abrigo se torna a moradia do acolhido. A estrutura desse ambiente é precária. O tratamento não se torna individualizado. O Sistema reforça a história de segregação e desqualificação social. O rótulo da reincidência funciona como um condutor para a focalização cada vez maior do Sistema de Atendimento em medidas repressivas, que corroboram a manutenção do adolescente no status que lhe é atribuído.
