Por fim, mais recentemente, é possível se referir a um "terraplanismo" constitucional no sentido de compreender as Forças Armadas como Poder Moderador, conforme entendimento do Supremo Tribunal Federal. O livro se desenvolve em três capítulos abordando a teoria moderadora dentro da divisão orgânica de poder, sendo que a primeira parte trata da teoria de Benjamin Constant, ou seja, sua conceitualização de Poder Neutro na estrutura do sistema constitucional. O segundo capítulo tem como vetor a implantação do Poder Moderador na Constituição do Império de 1824, quando instituiu o quarto poder de forma inédita no universo constitucional. Já a última parte trata do Poder Moderador na República, ou seja, a proposta de reinserção desse poder na Assembleia Constituinte de 1933 por Borges de Medeiros. Ainda nessa terceira parte, discutir-se-á a recolocação hodierna do tema do Poder Moderador como uma atribuição das Forças Armadas, todavia a tese foi rechaçada pela suprema corte."

No regime orleanista (1830-1848), o Governo deve dispor da confiança do Rei e do Parlamento. A Constituição do Império do Brasil (1824) descreve as prerrogativas do Poder Moderador. Sob a influência de Pedro II, obtém-se a alternância das forças políticas no Governo. A Constituição da V® República francesa (1958) institui o Poder Moderador do Presidente da República. O chefe de Estado assegura, por meio de sua arbitragem, o funcionamento regular dos poderes públicos. A coabitação sublinha a importância dessa missão. A experiência portuguesa do regime semipresidencial evoca também a teoria de Benjamin Constant. Eleito pelo sufrágio direto, o Presidente português é dotado de capacidade de unificação social. Na Espanha, o Rei possui significativa autoridade, cujo valor é reconhecid.
