Il «procedimento sommario di cognizione» è stato sostituito dal «procedimento semplificato di cognizione», in gran parte prestato alle controversie di competenza del giudice di pace. Il giudizio di appello è stato in parte modificato, quello in Cassazione ampiamente rivisto, quello di revocazione arricchito di un’ulteriore ipotesi. Il rito delle controversie di lavoro è stato pure interessato dalla riforma in maniera diretta (con riguardo all’appello e al procedimento sui licenziamenti) o indiretta (attraverso l’applicazione delle modifiche relative agli istituti generali). Anche i procedimenti sommari di cognizione sono stati toccati dalla riforma. Autentiche novità sono state introdotte in materia di famiglia, con l’istituzione del c.d. «Tribunale della famiglia» (destinato ad entrare in funzione, però, nel 2024) e con la previsione di un procedimento di cognizione ad hoc. Sono stati pure revisionati il processo di esecuzione, la disciplina generale in tema di misure coercitive e quella in materia di arbitrato. L’opera analizza, con taglio sistematico, l’intero impianto della riforma, con la sola esclusione delle misure relative alla c.d. «giustizia complementare» (mediazione e negoziazione assistita), alle quali sarà dedicato un secondo autonomo volume.
