Download or read book Blinking Red written by Michael Allen and published by Potomac Books, Inc.. This book was released on 2013-09-30 with total page 282 pages. Available in PDF, EPUB and Kindle. Book excerpt: After the September 11 attacks, the 9/11 Commission argued that the United States needed a powerful leader, a spymaster, to forge the scattered intelligence bureaucracies into a singular enterprise to vanquish AmericaÆs new enemiesùstateless international terrorists. In the midst of the 2004 presidential election, Congress and the president remade the postûWorld War II national security infrastructure in less than five months, creating the Office of the Director of National Intelligence (DNI) and a National Counterterrorism Center (NCTC). Blinking Red illuminates the complicated history of the bureaucratic efforts to reform AmericaÆs national security after the intelligence failures of 9/11 and IraqÆs missing weapons of mass destruction, explaining how the NSC and Congress shaped the U.S. response to the 9/11 attacks. Michael Allen asserts that the process of creating the DNI position and the NCTC is a case study in power politics and institutional reform. By bringing to light the legislative transactions and political wrangling during the reform of the intelligence community, Allen helps us understand why the effectiveness of these institutional changes is still in question.

Download or read book The Judge written by Ronald K.L. Collins and published by Oxford University Press. This book was released on 2017-09-01 with total page 144 pages. Available in PDF, EPUB and Kindle. Book excerpt: There is no book of political strategy more canonical than Niccolò Machiavelli's The Prince, but few ethicists would advise policymakers to treat it as a bible. The lofty ideals of the law, especially, seem distant from the values that the word "Machiavellian" connotes, and judges are supposed to work above the realm of politics. In The Judge, however, Ronald Collins and David Skover argue that Machiavelli can indeed speak to judges, and model their book after The Prince. As it turns out, the number of people who think that judges in the U.S. are apolitical has been shrinking for decades. Both liberals and conservatives routinely criticize their ideological opponents on the bench for acting politically. Some authorities even posit the impossibility of apolitical judges, and indeed, in many states, judicial elections are partisan. Others advocate appointing judges who are committed to being dispassionate referees adhering to the letter of the law. However, most legal experts, regardless of their leanings, seem to agree that despite widespread popular support for the ideal of the apolitical judge, this ideal is mere fantasy. This debate about judges and politics has been a perennial in American history, but it intensified in the 1980s, when the Reagan administration sought to place originalists in the Supreme Court. It has not let up since. Ronald Collins and David Skover argue that the debate has become both stale and circular, and instead tackle the issue in a boldly imaginative way. In The Judge, they ask us to assume that judges are political, and that they need advice on how to be effective political actors. Their twenty-six chapters track the structure of The Prince, and each provides pointers to judges on how to cleverly and subtly advance their political goals. In this Machiavellian vision, law is inseparable from realpolitik. However, the authors' point isn't to advocate for this coldly realistic vision of judging. Their ultimate goal is identify both legal realists and originalists as what they are: explicitly political (though on opposite ends of the ideological spectrum). Taking its cues from Machiavelli, The Judge describes what judges actually do, not what they ought to do.

Download or read book Transnational Legal Processes and Human Rights written by Asst Prof Lauren Fielder and published by Ashgate Publishing, Ltd.. This book was released on 2013-03-28 with total page 415 pages. Available in PDF, EPUB and Kindle. Book excerpt: It is becoming increasingly common for human rights norms to be transferred between legal and political systems and this book is a fresh approach to the intersection of transnational law and the protection of cultural difference beyond the single state border. It investigates how the construction and evolution of human rights norms are transferred in transnational legal settings and asks whether law should reflect, express or control any given aspect of culture. The chapters explore the ways that law and cultural identity may or may not co-exist, particularly in circumstances where a prima facie clash is observed. Examining legal approaches to cultural differences from a comparative perspective and across a wide range of locations, the book covers topics such as juvenile punishment, religious defamation, religious rights and conflict between industry and indigenous communities. It will be of value to those working in the areas of transnational and comparative law, as well as those concerned with human rights and the intersection of law and cultural difference.

Book excerpt: The Balanced Budget Act of 1997 established the State Children's Health Insurance Program (CHIP) under a new Title XXI of the Social Security Act. CHIP builds on Medicaid by providing health care coverage to low-income, uninsured children in families with incomes above applicable Medicaid income standards. The latest official numbers show that CHIP enrolment reached a total of nearly 7.4 million children and nearly 335,000 adults in FY2008. In FY2008, federal CHIP spending totalled $7.0 billion, with states' projected spending expected to equal $7.9 billion in FY2009. The Children's Health Insurance Program Reauthorization Act of 2009 (CHIPRA)was first passed in the House on January 14, 2009, and an amended version was passed in the Senate on January 29, 2009. This book examines the history and background the CHIPRA with a focus on the provisions included in the law.
