Book excerpt: Fall captive to the code—the real-life buccaneer bylaws that shaped every aspect of a pirate’s life. Pirates have long captured our imaginations with images of cutlass-wielding swashbucklers, eye patches, and buried treasure. But what was life really like on a pirate ship? Piracy was a risky, sometimes deadly occupation, and strict orders were essential for everyone’s survival. These “Laws” were sets of rules that determined everything from how much each pirate earned from their plunder to compensation for injuries, punishments, and even the entertainment allowed on ships. These rules became known as the “Pirates’ Code,” which all pirates had to publicly swear by. Using primary sources like eyewitness accounts, trial proceedings, and maritime logs, this book explains how each one of the pirate codes was the key to pirates’ success in battle, on sea, and on land.

Book excerpt: Morris "Moe" Dalitz was America's most secretive and most successful mobster. As a major architect of the United States' national crime syndicate, Dalitz was active in various fields of organized crime from 1918 until his death, all while spinning a web of myth and mock-respectability around himself so dense that decades after his demise, most mistake the legend for reality. From Prohibition-era bootlegging to the Reagan years, no other individual was present at so many pivotal events in gangland history. It's impossible to fully understand the modern Mob without knowing about Dalitz, his career, and the cunning publicity campaign that transformed his image from thug to that of a revered philanthropist. This exhaustive biography tells the story of Dalitz's life and the syndicate that he and like-minded individuals built from scratch.

Book excerpt: Writings on War collects three of Carl Schmitt's most important and controversial texts, here appearing in English for the first time: The Turn to the Discriminating Concept of War, The Großraum Order of International Law, and The International Crime of the War of Aggression and the Principle "Nullum crimen, nulla poena sine lege". Written between 1937 and 1945, these works articulate Schmitt's concerns throughout this period of war and crisis, addressing the major failings of the League of Nations, and presenting Schmitt's own conceptual history of these years of disaster for international jurisprudence. For Schmitt, the jurisprudence of Versailles and Nuremberg both fail to provide for a stable international system, insofar as they attempt to impose universal standards of 'humanity' on a heterogeneous world, and treat efforts to revise the status quo as 'criminal' acts of war. In place of these flawed systems, Schmitt argues for a new planetary order in which neither collective security organizations nor 19th century empires, but Schmittian 'Reichs' will be the leading subject of international law. Writings on War will be essential reading for those seeking to understand the work of Carl Schmitt, the history of international law and the international system, and interwar European history. Not only do these writings offer an erudite point of entry into the dynamic and charged world of interwar European jurisprudence; they also speak with prescience to a 21st century world struggling with similar issues of global governance and international law.

Book excerpt: The philosophical genealogy of a remarkable antagonist: the pirate, the key to the contemporary paradigm of the universal foe. The pirate is the original enemy of humankind. As Cicero famously remarked, there are certain enemies with whom one may negotiate and with whom, circumstances permitting, one may establish a truce. But there is also an enemy with whom treaties are in vain and war remains incessant. This is the pirate, considered by ancient jurists considered to be "the enemy of all." In this book, Daniel Heller-Roazen reconstructs the shifting place of the pirate in legal and political thought from the ancient to the medieval, modern, and contemporary periods presenting the philosophical genealogy of a remarkable antagonist. Today, Heller-Roazen argues, the pirate furnishes the key to the contemporary paradigm of the universal foe. This is a legal and political person of exception, neither criminal nor enemy, who inhabits an extra-territorial region. Against such a foe, states may wage extraordinary battles, policing politics and justifying military measures in the name of welfare and security. Heller-Roazen defines the piracy in the conjunction of four conditions: a region beyond territorial jurisdiction; agents who may not be identified with an established state; the collapse of the distinction between criminal and political categories; and the transformation of the concept of war. The paradigm of piracy remains in force today. Whenever we hear of regions outside the rule of law in which acts of "indiscriminate aggression" have been committed "against humanity," we must begin to recognize that these are acts of piracy. Often considered part of the distant past, the enemy of all is closer to us today than we may think. Indeed, he may never have been closer.
